NEW YORK — Police are reviewing surveillance videos of a post-Thanksgiving shopper stampede that trampled a suburban Wal-Mart worker to death, but they acknowledge it may be difficult to bring criminal charges.

Nassau County police and Wal-Mart Stores Inc. said no new information was available Saturday on the employee's brutal death, which rattled shoppers even as they flocked to the Valley Stream store a day later.

"It felt a little freakish," customer Ellie Berhun, 48, told the Daily News. "Some man lost his life because a VCR was on sale? Please. It's just too sad for words."

Police said the temporary worker, Jdimytai Damour, was mowed down as about 2,000 bargain-hunters surged into the store at Friday's 5 a.m. opening, leaving a metal portion of the door frame crumpled like an accordion.

Other workers were knocked to the ground as they tried to rescue Damour, and customers simply stepped over him and kept shopping even as the store announced it was closing because of the death, police and witnesses said.

At least four other people, including a woman eight months pregnant, were taken to hospitals for observation or treatment for minor injuries. The store, about 20 miles east of Manhattan, closed for several hours but reopened Friday afternoon.

The day after Thanksgiving is known as Black Friday because it has traditionally marked the point when a throng of shoppers pushes stores into profitability for the year.

Bentonville, Ark.-based Wal-Mart said it added staffers and outside security workers and put up barricades to try to prepare for the crush. But police spokesman Detective Lt. Michael Fleming said Friday that security was inadequate for a scene he called "utter chaos."

Criminal charges are possible, but identifying anyone in the store's videos may prove difficult, Fleming said.

Damour, 34, came from a temporary agency and was doing maintenance work at the store, Wal-Mart said.

A woman reported being trampled by overeager customers at a Wal-Mart opening Friday in Farmingdale, about 15 miles east of Valley Stream, Suffolk County police said. She suffered minor injuries but finished shopping before filling the report, police said.

Items on sale at the Valley Stream Wal-Mart included a Samsung 50-inch Plasma HDTV for $798, a Bissel Compact Upright Vacuum for $28, a Samsung 10.2 megapixel digital camera for $69 and DVDs such as "The Incredible Hulk" for $9.

this is disgusting. now we don't even have to make claims about how capitalism leads to the deaths of workers in developing countries. instead its just right here screaming in our faces. come on people wake up! our species should be better than this.

I've been reading these comments and I've been hearing people saying that it's all walmarts fault or that it's all the mobs fault. I believe it's both of their faults, but mostly the mobs and especially the ones on the front line. I was looking at the video and I could tell that the man that got trampled wasn't a little guy... He's a pretty good sized man, so people can't use the excuse that no one saw him.

Something that really pisses me off about walmart is that they hired a temp to open the door when his job assignment was maintenance (I hate temp agencies by the way, but that's a completely different topic), why the hell was we opening the doors?

What I'd really like to see happen is that these monsters that trampled this man death be found on christmas morning before they open their presents and be found by the police and taken to jail to serve their long sentence for manslaughter. That would be so awesome. When the jury finds them guilty and after the judge bangs the gavel the jury can yell Merry Christmas!

I have never and will never be at one of those rediculous "sales" I dont understand what kind of person is so desperate for a purchase, that they find it neccessary to be in a line at 5 am. I dont want or need anything that badly! These sales are an accident waiting to happen and should be outlawed!

Thank you. Tragedies like the one the killed this employee are sickening. For what it's worth, I stay home on Black Friday and do most of my shopping online or when there are fewer people out. I'm not a big fan of crowds.

It would seem that Walmart handled these issues admirably. Is there some indication other than your dislike of Walmart that justifies blaming the victim (the store) for the bad acts of the people in the line?

I found an interested site called Crowd Dynamics. While they don't mention Walmart, they cover stampedes at Ikea and other places. There is a long list of stampedes and crowd disasters, mostly in other countries and often related to religious events.

I offer this mostly for the woefully uninformed who imply that the human stampede is an American phenomenon.

One last time to drill this into your thick skull. The liabiltiy has nothing whatsoever to do with is it was sale, a concert, a soccer match, a nightclub. Nor does it have to do with the day of the week. Legally, it has to do with forseeablity, and whether a reasonable person could determine that their might by injuries caused by the crowd. Please study tort law and criminal law before you try to assist in the defense of Wal Mart, who has plenty of lawyer do do this for them.
By the way, are you that Wal Marts general manager? If so, I would sugest you get separate legal counsel; because I guarantee you , that they will through you under the bus.

This has happened for years and years when store do these type of promotions. Cabbage Patch, Pac Man, Wii,. That is beside the fact that regardless of the motive or purpose of a "crowd"; there are standard procedures and protocols that all businesses are supposed to follow created by their risk managment people and if they don't want exposure to criminal prosecution.. The point in time that the crowd reached a critical mass, management should have forseen the consequences of the rush at door opening. The door opening should have been delayed or cancelded. Law enforcement should have been called for a riot situation. Then a controlled entry should have been coordinated. "They" learned their lesson years ago during the deaths caused by "general seating". They knew, they just didn't care to spend the money. If you engage in something that creates the crowd, you are responsible for the consequences. "Crowd rushes" are NOT "unforseen circumstances". We all have read about deaths at the doors from fire, panic, and free or cheap merchandise.

My bad. There were tramplings, but no trampling deaths on this list. Sorry about that. Got some trampling hospitalizations for you, though. The Black Friday shopping deaths were due to other causes.

9. Torrance, Calif.: Gift certificate stampede

Black Friday 2006 resulted in hospitalization for one California woman who was seriously injured in a 2000-person stampede at a shopping mall. The stampede was instigated when as a promotion, the mall dropped some 500 free gift certificates from the ceiling for prize hunters to collect.

8. Sunrise, Fla.: BrandsMart stampede

A 72 year-old woman was hospitalized on Black Friday 2005 when she was literally trampled by a panicked rush of shoppers trying to get into the store when it opened. Shoppers stomped on the woman's back as they hastily ran into the store, dying to get their hands on the scarce deals.

Correct me if I'm wrong, but it seems that over the years, every time there's been a death or injury during a Black Friday melee, it's always been at Wal-Mart - which seems to indicate a lack of attention to crowd control and security that stems from the corporate level. Wal-Mart won't improve unless criminal charges are brought against it, which seems very unlikely. Nor should we expect Wal-Mart shoppers to become outraged against this latest tragedy and boycott.
