PHOENIX — Prosecutors have offered a plea deal to an 8-year-old boy charged with murder in the shooting deaths of his father and another man in their eastern Arizona home, court records show.

Complete details of the offer weren't spelled out in a court filing posted Saturday on the Apache County Superior Court's Web site.

But County Attorney Criss Candelaria wrote that he has "tendered a plea offer to the juvenile's attorneys that would resolve all the charges in the juvenile court contingent on the results of the mental health evaluations."

Candelaria was responding to a defense motion seeking to block him from dropping one of two first-degree murder charges the boy faces in the deaths of his father, Vincent Romero, 29, and Timothy Romans, 39, earlier this month.

Defense attorney Benjamin Brewer argued in a filing Tuesday that prosecutors wanted the charge dismissed so they could refile it when the boy was older and pursue case in adult court.

Brewer said Saturday that the deal would resolve the case without it being transferred to adult court, but he declined to provide additional details. Although he is considering the offer, Brewer said he is unsure of his client's ability to understand the proceedings. At least two mental health evaluations are yet to be completed.

The prosecutor explained in his response to Brewer's opposition filing that he wasn't trying to obtain an unfair advantage, but he pressed for the dismissal because the judicial system isn't equipped to deal with an 8-year-old charged with murder.

"It is done to ensure that the juvenile and the two murder victims in this case do not fall through the cracks in the system that might occur if both charges remain in the pending delinquency petition," Candelaria wrote.

Candelaria explained that the boy could be found incompetent to stand trial, and if that happened, the court's options would be limited.

The court would be required to order efforts to restore the boy to competency, but if that couldn't be done within about eight months, the judge would be required by law to dismiss the criminal case and bar it from being refiled.

The court would then be required to initiate civil commitment proceedings, Candelaria wrote. If the boy is found incompetent because of his age, he wouldn't fit the definition of a mentally disordered person and no treatment would be available.

"Such a result denies the victims and public of any sense of justice for these heinous murders," Candelaria wrote. "It also denies the juvenile the rehabilitative services that he apparently needs to both deal with why he was capable of committing these murders and to assist him with the grief and remorse that he is probably feeling."

Police in St. Johns found Romero and Romans shot to death after the boy ran to a neighbor's house on Nov. 5. The boy was questioned after Romans' wife raised suspicions about him the next day, and in a videotape released by prosecutors, he admits pulling the trigger. Both men were shot several times with a .22-caliber rifle.

Romans worked with Romero and rented a room in his home.

Police reports say the boy told a state Child Protective Services worker that his 1,000th spanking would be his last.

The boy is being held in a county juvenile facility, although he was allowed to spend Thanksgiving with his mother.

Brewer said the boy is back in custody. The next court hearing is set for Dec. 8.

My dad was hunting with a .22 when he was about 6 years old. But that was in the Depression, and that was about putting food on the table.

The story on this kid is that his father was teaching him to hunt. But 1000 spankings.­..? I'm sorry, there was something wrong going on in that family, and I think if the guy brutalized his kid and then taught him to kill ... he made an enormous mistake. I feel sorry for the kid.

Remember his so-called confession, which was certainly coerced, is NOT admissible.

So, does 1000 spankings equal child abuse? No, it equals EXCESSIVE CHILD ABUSE.

If he was the father of many of us, the same thing may have happened.

The people who should be on trail are the adults who allowed this child to be abused. The parents, the grandparents, the CPS and other adults who knew of what was happening and did nothing.. The treatment and dehumanizing of a child is unspeakable. Corporal punishment is how an innocent children can be make into a monsters.

A parent who would do this to a child, I say good riddance. Death is to good for them. The victim is this boy, who felt so trapped, that he had to rescue himself, because no adult came to help him.

I hope his stepmother is arrested for child abuse.

Shame on Arizona, for prosecuting and victimizing him once again.

One can only hope Dr. Loomis can get to the bottom of this tragedy, and if he can't, at least ensure that the boy is kept safely in a mental health institution where he belongs.

If the legal system isn't equipped to deal with an 8 year old accused of murder, then it's about time it was. This child seems to be caught between the proverbial rock and hard place because of that. Shameful.

If this kid was spanked 1,000 times, as he says he recorded in his diary, then this is surely justifiable homicide and the boy did the only rational thing he felt he could do.

Given that legal system in conjunction with the mental health system seems to have, by omission and commission, colluded in the almost unthinkable abuse of an eight year old, can we expect appropriate therapies to be available.
This about as messed up situation as could be imagined and makes me, almost, despair of humanity.

This is an outrage!!! Murder is beyond horrible, but one must ask, what led the child to this action? Abuse, misunderstanding of things seen on tv or games? This poor child is in sore need of responsible and intelligent adults, a fact that I feel he lacked before this unspeakable tragedy.

I saw the interrogation the 8 year old child endured. He had no parental representation or legal representation. He was not advised of his Miranda Rights and even if he had been, at 8 years of age there is a real possibility he would not have understood them.

This child should receive extensive counseling and placement in a proper home environment. There is speculation that he was abused or neglected.

Once again, I think we're seeing some corrupt cops trying to pin a HIGHLY underaged child! THEY should be investigated for holding such an interrogation with no one there to help the 8 year old.

Several years ago a 6 year old from Chicago confessed to murdering a young girl. It was later discovered that an adult had killed the girl. The 6 year old had hit the girl with a rock earlier the day she was murdered, and he thought that incident had caused the girl death. I saw a few minutes of the taped confession of this 8 year old child from Arizona on the news. I am stilled not convinced that this child committed this crime. A child this young should not be questioned without a parent or guidance present.

remember, guns don't kill people, but abused kids with access to their parents' gun and ammo damn sure might. If you have those in the house, you better be an informed parent and good to your kids.
Poor kid! For God's sake please don't criminalize him! His life has just begun and look at the frickin culture he is growing up in! He is going to need years of professional help.
