RAYMONDVILLE, Texas — A judge dismissed indictments against Vice President Dick Cheney and former Attorney General Alberto Gonzales on Monday and told the southern Texas prosecutor who brought the case to exercise caution as his term in office ends.

Willacy County District Attorney Juan Angel Guerra had accused Cheney and the other defendants of responsibility for prisoner abuse. The judge's order ended two weeks of sometimes-bizarre court proceedings.

Guerra is leaving office at the end of the month after soundly losing in his March primary election.

"I suggest on behalf of the law that you not present any cases to the grand jury involving these defendants," Administrative Judge Manuel Banales said in court while ruling that eight indictments against Cheney, Gonzales and others were invalid.

He also set a Dec. 10 hearing on whether to disqualify Guerra from those cases.

Even in defeat, Guerra saw the outcome as confirmation of the very conspiracy he had pursued. "I expected it," he said. "The system is going to protect itself."

Banales withheld judgment on whether probable cause existed for the Cheney and Gonzales indictments because they were not represented in court and did not present any argument. For the other defendants, he found no probable cause to support the charges.

A White House spokeswoman said Monday night that Cheney's office had no comment. A call to Gonzales' attorney was not immediately returned.

Three of the eight indictments returned Nov. 17 targeted private prison operator The GEO Group, state Sen. Eddie Lucio Jr., Cheney and Gonzales, as part of an investigation into prisoner abuse at privately run federal prisons in the county.

Guerra ran the investigation into alleged prisoner abuse with a siege mentality. He worked it from his home, dubbed it "Operation Goliath" and kept it secret from his staff, he said. He gave all the witnesses biblical pseudonyms _ his was "David."

Banales dismissed all eight indictments because GEO Group attorney Tony Canales showed that two alternate jurors were part of the panel that day but had not been properly substituted.

Five of the indictments _ against two district judges, two special prosecutors and the district clerk _ were dismissed because Guerra was the alleged victim, witness and prosecutor. The indictments accused the five of abusing their power by being involved in a previous investigation of Guerra.

The indictment against Cheney alleged that his personal investment in the Vanguard Group, which invests in private prison companies, made him culpable in alleged prisoner abuse at privately run federal detention centers.

Gonzales was accused of using his position to stop an investigation into abuses at a federal detention center.

Lucio was alleged to have used his Senate position to profit as a prison consultant, but Banales ruled that the indictment failed to address whether Lucio knew he was only being hired to consult because he was a state senator.

Well, DUH! Who didn't see this coming? I knew from the start this was going nowhere. Cheney is too powerful and just plain evil. No one will be the first to risk their career to bring this treasonous cabal to justice. Sad, but true.

I believe these 2 along with others really need to be prosecuted to the fullest extent of the law. However, just in gathering the information that led to the initial charges more than likely exposed things on a much higher scale that would set this country on its ear around the world. So, instead of making a further mockery out of the US it was concluded to let these a**holes off the hook. I also believe something will come to light on Dick Cheney that will bring him the demise he deserves.

Cheney, Gonzales, Bush, Rice, Rumsfeld, Feith,
Perle, Wolfowitz and all their assorted water-carriers
should be tried as WAR CRIMINALS before the world
at The Hague.

Sure, they are all culpable and IMO deserve to swing, but their supporters, while currently only 25% of the populace (approx. 1/2 the repug party) are also to blame for enabling them. The main reason Bush has lost popularity is economic, not moral.

I don't know the law, but it seems to me that if you stop an investigation into something to protect your investment, that is illegal!!! (Kind of like McCain tried to use his position of power to influence an investigation).

Justice is a perception in part, not a reality. It's only a reality to people who are accused of a crime that they actually committed and are found guilty for. These guys nor Bush or any of their high level friends will ever pay for their wrongs. At least not in our "justice" system.

I've NEVER been arrested, never broken the law, don't drink, don't smoke, take care of my family, pay my bills on time etc... BUT, let someone accuse me of a crime that I didn't commit, I'll probably be found guilty and go to prison. That would be perceived as justice, but would be my reality.

If we can't get this bunch to face punishment, then life pretending America is great is not worth living. Justice is more than perception for us outside of bars. Justice is the example to others that nobody is above the law. Without the perception of justice then ch aos br eaks out. We know what happens when real economic policies are abandoned; the bottom falls out. Do you really want to test what happens when justice is not served?

I hear you blueskybigstar, and I agree. I'm just makng reference to the fact that most of the criminals that should be doing time, get off on some technical faslehood. Having deep pockets and connected friends shouldn't be the rod to measure real justice. Rich or poor, right is right and wrong is wrong and prosecution should be persued based on that fact and nothing more.

Life IS worth living, but like you say, we need to ensure that white collar crime is punished as well. Tired of these guys getting off (Rove, Cheney, Gonzales,
Bush, Craig, Carl S, Ally North, etc...

yeah, it's really 'justice' in this country isn't it? there was a documentary on marijuana last night on national geo channel---800,000 people have been incarcerated for it --90% for simple possession--just another way to keep those private prison owners rolling in the dough---these people are in prison and the fat cats are above the law....doe­sn't make me think we have any justice in this country

Talk about your frivilous law suits. What a distraction. All this nutcase prosecutor accomplished was to give C&G a favorable headline. There are plenty of good reasons to go after Cheney and Gonzales. This was not one of them. What is GEO Group saying, or haven't they stopped laughing yet?

I feel a little empowered to comment as an attorney:

First, the indictments seem really BOGUS. Merely investing in a company should not subject a person to criminal liability. Vicarious liability in tort law (i.e., civil liability, similar to a car accident) is one thing, but to subject someone to criminal law due to their investment, rather than management, etc., is a terrible precedent.

Second, the judge is clearly going too far -- according to this VERY LIMITED QUOTATION. Because we only get a few words from the judge, it is difficult to place the court's words in context. Huffington Post: You can do better.

Finally, prosecutors should exercise caution. The Bill of Rights centers upon rights of the accused. Any liberal should want this. Unfortunately, I cannot imagine a Texas judge saying this in any other type of case. But that does not mean that liberals should bash the concept of prosecutorial restraint. Overzealous prosecutors are usually bad news for poor people and persons of color. If you are in one of those groups, you might see this case in a different light (as I do).

Considering the disconnect between the law and the concept of justice, I'd say that your status as an attorney makes you one of the least qualified people to comment on this matter. For some time now, the practice of law has been merely a convoluted exercise in ignoring justice in an effort to come to a desired (or, in this case, preordained) outcome. If the field of medicine operated the way the field of law does, every doctor would be Josef Mengele.
