The Franken campaign struck a tone of confidence on Tuesday, insisting that once the votes were counted the numbers will reveal that they had bested Norm Coleman in the Minnesota Senate race.

"I'm very confident that Franken is going to win," said the Democratic challenger's lawyer Marc Elias. "I think we are going to win this recount. I have no doubt in my mind that Al Franken got more votes in this election that Norm Coleman. The only question is, will Norm Coleman have lawyers continue this fight."

There was reason for the optimism. While a local newspaper has the margin by which Franken trails in the recount somewhere in the 300-vote range, the Franken campaign itself says internal figures show them to be within 50 votes.

Perhaps more importantly, on Tuesday the Secretary of State's office directed county auditors and election officials to review previously rejected absentee ballots to determine whether or not they should be counted. For weeks, the Franken camp has argued that while many of the absentee ballots had been rejected for legitimate reasons, a portion of them (ranging from 500 to 1,000) could be deemed legitimate votes.

"We are grateful that the Secretary of State and the canvassing board agree with our assertion that properly cast absentee ballots can't be discounted," said Elias. "We are more confident than ever that these legally cast ballots will, in fact, be counted."

With the recount margin measure, potentially, in the dozens, each and every single vote could very well determine the victor. And the Franken campaign left the door open for legal action should improperly rejected ballots not, in the end, be counted. As if on cue, during the press conference on Tuesday a story emerged from Ramsey County in Minnesota -- a relatively Democratic locale -- that some 200 ballots had not been counted due to an optical scanning error. (updated below: these ballot findings could reduce the margin to a mere 13 votes)

Here are the important dates going forward:

By December 5, the state has estimated that it will have completed its hand recount.

On December 8, the review of absentee votes will begin. The state will have to consider whether the votes were rejected for four specific reasons: if the voter's name and address on the return envelope was not the same as the information provided on the absentee ballot application, if the voter's signature on the return envelope was not the genuine signature of the individual, if the voter was not registered and eligible to vote in the precinct or has not included a properly completed voter registration application, or if the voter had already voted at the election. Every other ballot, according to Minnesota state law, cannot be legally rejected.

On December 16th, the canvassing board is set to consider ballots challenged by the two campaigns.

And on December 26 or before, there will be a meeting of the canvassing board to decide whether to count the absentee ballots that could have been improperly rejected.

UPDATE: The total number of ballots found missing is 171. And it is estimated that, once counted, this could give Franken a net gain of 12 votes. The Coleman campaign is contesting the story, saying that, if these 171 were actually counted it would mean that more votes were cast in the county that the actual number of people who signed in on Election Day. Looks like more legal drama to come in Minnesota.

LATE UPDATE: The Star Tribune reports that Franken actually picked up 37 votes from the discovered ballots, meaning that -- if the campaign's internal numbers are correct -- the margin separating him and Coleman is an estimated 13 votes.

"Hold your horses" and that comes from a Franken supporter. You are relying on info from Franken campaign for these very optomistic numbers. Both "Mpls Star Tribune" and Minnpost.com have been doing an excellent (detailed and thorough) job reporting on the re-count and neither of them have anything close to what you have here.
Go Franken, but let's keep it real...

I think Franken's people have been keeping track of challenges that are likely to succeed and fail and that's where they get their numbers from. So, they're not contradicting the Star Tribune.

i think so too, but it's still a real iffy proposition to report what franken's campaign says as the primary source for information. i noticed huffpo switched to that tactic when franken stopped gaining votes through the official recount numbers, and i really hate it when liberal news organizations behave like drudge.

Why did Reagan's colleagues in Hollywood vote him to represent them in their Guild? Have you ever read Reagan's own radio speeches that he wrote? You may want to read a bit what even lefty historians have to say about him, given the current data available. Actually, I don't think you will do any of that. News Flash - that seat does not belong to Wellstone nor the ghost of Wellstone. Get back in reality.

That seat belongs to who ever the voters in MN elect. That seat belonged to several before Wellstone, then Wellstone, and then Coleman.

Whether it stays Coleman's or goes to Franken has yet to be determined. In spite of my reluctance hoping it goes to Franken, more than anything I hope it goes to the candidate the voters of MN really elected. It's so close I'm not sure we'll ever know for sure.

It may not belong to Wellstone, but considering how he died in a tragic plane crash and he never really got the chance to be elected again, I believe that this is what MNmommy meant. Of course I can't speak for her, but he was a dearly loved senator and such a truly decent person, many, many people feel that he was taken from his seat and from life much too soon.

News Flash- Coleman only won WELLSTONE'S seat because Wellstone died in a plane crash right before the election. By that time it was too late for any Democratic candidate, even someone like Mondale, to take the election back. Coleman doesn't deserve the seat. No one thinks that Wellstone's ghost occupies the seat, but the fact is that he was a sitting senator who died in office just before the election, and it is impossible to deny the very real presence that his legacy still has in Minnesota.

iT WAS NOT "PAST," BUT IT MIGHT HAVE BEEN "PASSED." Nost states (if not all) have laws covering the need for signaturtes to match. Without that, how are you going to know if the person voting is the same as the one registering? Remember all the hullabaloo over ACORN's registrations? I suppose we could require a photo ID to be shown for every voter every time in every state, but so far many of them, including mine, only require that when one initially registers. ut usually ones signature does not change all that much over time, so even a long term voter who's hair color has changed will probalby produce a reliable signature. I supose we could get really ridiculous and require one of those airport finger print machines. I AM SURE THE EWPUBLS WOULD LIKE THAT IF FOR NO OTHER REASON THAN TO COLLECT EVEN MORE INFOMATION IN THEIR PATRIOT ACT FILE.

There is no law PASSED about signatures - our ballots are annonymous. MN law states, "If a ballot is marked by distinguishing characteristics in a manner making it evident that the voter intended to identify the ballot, the entire ballot is defective."

What about dadwd5boys who can't write good? Go finish your homework.

IN many states one has to sign the outside of an outside envelope enclosing the "anonymous" ballot and they check the signature on the outside envelope before removing the ballot from that envelope and putting it the pile of accepted ballots. that way they are able tto determine the ballot got to its destination and was sent in by the true voter. IF nto for that, any corrupt mail deliverer could easily take a stack home and vote multiple times and then send the ballots back and no one would know. Given my cousin's Ditto head listening husband, I would rather take the chance that someone opening my outer envelop in the presence of two clerks of different parties might ultimately know how I voted, than to never get my absentee ballot and have some fool like my cousin's husband vote for me without my knowledge. I bet Minnesota has a similar system to verify the ballots when they come to the election office. I know when I go to polls, I have to sign my name in the election registry.

My dad got his ballot sent back because his signature didn't mach here in Oregon. So I called
and asked about it. They said if you can't sign it the same you have to come down
to the elections office and show ID. I asked them if the they had trained handwriting
experts overseeing the counting. They said yes from both sides. It's an easy way to toss
out ballots.

Actually, its the state of Minnesota that sets the rules. Our Constitution gives EACH state the right to set whatever rules they want. For example, Georgia is holding a runoff election today BECAUSE their rules require 50% + 1 to be elected. Minnesota doesn't have that rule.

I suspect you're a partisan who will accept any deviation from Minnesota's rules IF Franken goes in front in the recount. Otherwise, it's belly aching time here with "mindless" posts such as yours.

I hope the Joker goes down by 1 voted. That would be perfect for you whiners, but if he wins, I can accept that also. Maybe you should try working on your anger issues instead of complaining about Minnesota's voting procedures.
