The Franken campaign struck a tone of confidence on Tuesday, insisting that once the votes were counted the numbers will reveal that they had bested Norm Coleman in the Minnesota Senate race.

"I'm very confident that Franken is going to win," said the Democratic challenger's lawyer Marc Elias. "I think we are going to win this recount. I have no doubt in my mind that Al Franken got more votes in this election that Norm Coleman. The only question is, will Norm Coleman have lawyers continue this fight."

There was reason for the optimism. While a local newspaper has the margin by which Franken trails in the recount somewhere in the 300-vote range, the Franken campaign itself says internal figures show them to be within 50 votes.

Perhaps more importantly, on Tuesday the Secretary of State's office directed county auditors and election officials to review previously rejected absentee ballots to determine whether or not they should be counted. For weeks, the Franken camp has argued that while many of the absentee ballots had been rejected for legitimate reasons, a portion of them (ranging from 500 to 1,000) could be deemed legitimate votes.

"We are grateful that the Secretary of State and the canvassing board agree with our assertion that properly cast absentee ballots can't be discounted," said Elias. "We are more confident than ever that these legally cast ballots will, in fact, be counted."

With the recount margin measure, potentially, in the dozens, each and every single vote could very well determine the victor. And the Franken campaign left the door open for legal action should improperly rejected ballots not, in the end, be counted. As if on cue, during the press conference on Tuesday a story emerged from Ramsey County in Minnesota -- a relatively Democratic locale -- that some 200 ballots had not been counted due to an optical scanning error. (updated below: these ballot findings could reduce the margin to a mere 13 votes)

Here are the important dates going forward:

By December 5, the state has estimated that it will have completed its hand recount.

On December 8, the review of absentee votes will begin. The state will have to consider whether the votes were rejected for four specific reasons: if the voter's name and address on the return envelope was not the same as the information provided on the absentee ballot application, if the voter's signature on the return envelope was not the genuine signature of the individual, if the voter was not registered and eligible to vote in the precinct or has not included a properly completed voter registration application, or if the voter had already voted at the election. Every other ballot, according to Minnesota state law, cannot be legally rejected.

On December 16th, the canvassing board is set to consider ballots challenged by the two campaigns.

And on December 26 or before, there will be a meeting of the canvassing board to decide whether to count the absentee ballots that could have been improperly rejected.

UPDATE: The total number of ballots found missing is 171. And it is estimated that, once counted, this could give Franken a net gain of 12 votes. The Coleman campaign is contesting the story, saying that, if these 171 were actually counted it would mean that more votes were cast in the county that the actual number of people who signed in on Election Day. Looks like more legal drama to come in Minnesota.

LATE UPDATE: The Star Tribune reports that Franken actually picked up 37 votes from the discovered ballots, meaning that -- if the campaign's internal numbers are correct -- the margin separating him and Coleman is an estimated 13 votes.

Are you aware of any time in history when an election was held and millions of ballots were cast and within a few days of the election there was even close to 100% certainty that all ballots were counted accurately and fairly?

The reason that the USA, at least at times, does a pretty good job of being a democracy is because of the myriad of procedures in place to allow ourselves a pretty good chance of getting the count pretty close to right most of the time.

As long as we try as hard as we can to get it right, and as long as no one is complaining that it's taking a little extra time to get it right, and no one is mocking people for trying to get it right...we­ll, then I'm happy.

Any state that has a major election that is a virtual tie like Minnesota where every vote is scrutinized is going to uncover some degree of error and messiness. Happened in Florida in 2000 and Washington state in 2006.

I disagree. Runoff elections are expensive and almost never get the turnout the general election has so the party faithful tend to decide them rather than everyone. Besides, what do you do if a runoff ends up a virtual tie? Have another runoff?

Those statements are only true if you have a separate election for the run offs. There is no reason at all we should not be able to rank our first and second choice on a single, one time, ballot and have the run off automatically performed.

Instant run-off sounds real fine, but if you can't get people to vote for one person correctly, how are you going to get them to vote or two or three in some sort of order? If they can't connect lines, blacken in a oval, or make an X so it can be read, do you really expect them to make a legible mark that signifies their order of choice? If you think the recount in Minnesota is screwed up now, multiply that by 1.5 or 2 or 3.

You mean Obama and Clinton were once involved in a contentious primary battle and they said some bad things about each other? How dare they reconcile and attempt to work together for the betterment of our country! HOW DARE THEY!

By the way - she (Clinton) endorsed him and made a glowing speech about him months ago. He (Obama aka "The One",aka "Mr President Elect") has been playing nice towards her for a while. This is not a story, no matter how much you want it to be, Campbell. Looks like you are going to have to find a different way to snatch a piece of the ratings from Billo and Keitho.

Her phony outrage is laughable.

Al, when you when this recount, will you finally take election integrity seriously? Your past denial of the activists and activity to assure every vote is counted honestly and accurately has been a flaw in your philosophy for far too long. Now you are feeling what we've been talking about for years!

So, when you get to the senate, how's 'bout you sponsor a bill to rewrite the Orwellian named Help America Vote Act (HAVA) to make hand counted paper ballot (HCPB) the only ballot of record for all elections. Ballots will be counted on election night, in the precinct they are cast, in full view of the public, and the results posted in each precinct. Then they can be communicated to a central counting office for the final count. Remove all electronic machines, computers, and software that now stands between the voter and our votes; cast out the vendors and eschew privatization of the vote. You could reduce the 293 page HAVA to about four pages and be a hero!

And, if I'm wrong about the recount, Norm would you . . . oh, of course not! How silly of me. You're a Republican . . .

I started following election/voter stuff for a little under a year now, and it motivated me to be a poll worker this past November. Although I can see in-precinct hand counting working in small low-pop places like New Hampshire, I just don't think its smart elsewhere.

I worked a station in Northern Va near a college campus. I wanna say we had around 1000-1,500 ballots cast (can't recall), and maybe eight workers and 3+ observers/watchers. At ten-second per ballot, that's only 120 ballots reviewed/c­ounted/rec­orded in an hour. Hand recounts would require a TON of man power (which would be great), but where man power fell short corruption would fester.

I think a better solution is something like random hand recounts to verify optical scan accuracy, more flexible recount laws, and ripping the counting process out of the hands of the vendors (no more non-open source code nor closed door counting.) Having maybe a random 5% of the precincts hand counted on election night by coordinated crack teams of traveling poll workers to assist could be easily adapted and would be reasonably sound.

Karl Rove began his career by contesting close elections and then pushing hard enough to get his candidates to win. One notable problem over the years is that Democrats would never push back enough to prevail. In 2000, we saw Gore go down in defeat as Republicans mounted a vigorous campaign that ended in the Supreme Court handing the election to Bush. In 2004, Kerry hardly made a sound as Kenneth Blackwell gamed the system in Ohio and probably stole the election from him. Franken is a part of a new generation of progressives that are willing to fight back, push hard, and go for the gold. I wish him the best of luck. I hope he wins and I hope he becomes a model for a new Democratic Party poised to fight for every vote in every State where they are contesting. It's time to be an assertive Party.

My immediate reaction when I hear about a money scandal is that Democrats are involved. I am right more often than not. When I hear about a sex scandal, my immediate reaction is that Republicans are involved. I am rarely wrong, though the Democrats are quickly catching up in the heterosexual race for sleaziest party.
