LOS ANGELES — Lawyers for Roman Polanski, a fugitive for 30 years in a notorious sex case involving a 13-year-old girl, filed a request Tuesday to dismiss the charge against him because of prosecutorial and judicial misconduct.

The motion alleges that a documentary about the filmmaker released this year revealed "a pattern of misconduct and improper communications" between the Los Angeles County district attorney's office and the judge in Polanski's case.

"This case serves as a classic example of how our justice system can be abused, and defendants' rights trampled, by an unholy alliance between courts and criminal prosecutors," said a statement from attorneys Chad Hummel and Brad Dalton. Dalton is the son of attorney Doug Dalton, who represented Polanski in the original case.

The Polish-born Polanski, 75, has been living in self-imposed exile in France since fleeing the United States in 1978 after pleading guilty to having sex with a 13-year-old girl in Los Angeles.

He was initially indicted on six felony counts and faced up to life in prison. Instead, he pleaded guilty to one count of unlawful sexual intercourse with a minor and five other counts were dismissed.

Polanski, who had already been incarcerated for a psychological diagnosis for 42 days, skipped sentencing that would have sent him back to prison, and fled to France. The judge issued a warrant for his arrest that is still in effect.

The maximum sentence was 50 years, although prosecutors had said at the time that the typical sentence was 16 months to three years in prison.

Sandi Gibbons, spokeswoman for District Attorney Steve Cooley, said her office had not been served with the motion and heard about it only through media reports. She said the office could not take a position until they see the legal papers.

"We're looking forward to seeing Mr. Polanski in Los Angeles to litigate it," she said.

A hearing on the matter is scheduled for Jan. 21 in Los Angeles County Superior Court.

Polanski, the director of "Chinatown" and "Rosemary's Baby," has continued to direct films while in exile, including the 2002 Holocaust drama "The Pianist," for which he won the best-director Academy Award.

The woman with whom Polanski admitted having sex has said that she wants the charge dropped and that Polanski should be allowed to return to the United States.

The case was a sensation when it broke. Polanski, the widower of Manson family murder victim Sharon Tate, was arrested for having sex with the girl, whom he had hired as a model for a photo shoot. He was accused of giving her Quaaludes and champagne, taking her into a hot tub nude, and having sex with her.

The new effort to wipe out the charge comes after an HBO documentary, "Roman Polanski: Wanted and Desired," in which the man who prosecuted Polanski, retired Deputy District Attorney Roger Gunson, said that if he had been in Polanski's position, he also would have fled the country.

The documentary also portrayed the late Superior Court Judge Laurence J. Rittenband as a publicity hound who held news conferences and engaged in extrajudicial meetings about the case.

In a legal brief, the attorneys quoted heavily from the documentary, citing statements by former Deputy District Attorney David Wells in which he acknowledged advising the judge on how to sentence the film director, even though he was not assigned to the case.

The lawyers said that Wells' recommendation to send Polanski away for a diagnostic study was illegal without Polanski's lawyers present. They said Wells also inflamed the judge by showing him photos depicting Polanski with girls at an Oktoberfest party in Germany while he was awaiting sentencing. They said the photos were misrepresented.

"As the result of DDA Wells' illegal ... communications, Mr. Polanski has been subject to a punishment that has spanned the course of over 30 years," the motion stated, noting he has been deprived of opportunities to work on films outside France.

The lawyers said the now-43-year-old victim, who never wanted Polanski to go to prison, should have the final say. They said the law requires the courts to consider a victim's wishes.

The woman's "wishes have remained unchanged, and this court has the discretion to finally conclude this case without any further harm" to the victim or her family, the motion stated.

and to bujeboo who is torn because of his talent... what does it matter how good a person is at x,y, or z when they are a rapist or caused harm in "real life"? I mean maybe his art was good in a sense to filter subconscious destructive urges/etc. urges that may have manifest otherwise, as they are for many artists as art can be useful for.... but really... he IS a guy on the sex offender (sic) list with a horrible childhood story.

maybe he should make a film directly about his problems and how they manifest into the violence he personally perpetrated. maybe a story about forgiveness after owning up to his action and getting present to the damage he caused... connecting it to the damage inside.

maybe that would help others end the cycle of abuse... and spare others from abuse if so fortunate... especially the type of sexual abuse.... the "violence" that gets confused as "sex."

I think it is ridiculous to say the charges should be dropped. He pled guilty to having sex with a 13 year old child. He is a pedophile. Who cares if he has been in exile?! He committed a crime, plead guilty and our legal system should impose a sentence. Why should he be allowed to go unpunished? In addition, our legal system does not decide whether or not some one should be punished based solely on what the victim wants. If the victim's family does not want him to be punished they can chose not to pursue civil action. The state decides whether to pursue charges when it is a criminal offense. It is a crime to have sex with a child and he should face the legal consequences for doing so. To LMPE-a difficult life doesn't mean you're not responsible for your actions.

I'm not condoning his actions but the man has suffered so much in his life. Since the victim wants him to go free, I think he should be allowed to return here withour fear of prosecution. At his age he probably can't do much damage.

Howard Hughes dated a 15 year old just a few decades ago. The age of consent goes up and down like a toilet seat.

After 30 years, cut the man some slack...especially considering that his alleged victim agrees:

Report back about your humble learnings... about the notion that a child can EVER give consent of that nature... really learn... it may mean thinking/growing in ways you never considered.

It's not like the 13 year old was the only young girl he was attracted to. Nastassja Kinski was only 15 when he (at age 41) went out with her; that was only a couple years before the "13 year old" incident.

Just because a person has talent doesn't mean they're going to be pillars of society. Certainly doesn't seem so in this case.

Misconduct by attorneys and judges should be dealt with. They need to be held accountable for their actions, but that shouldn't release a predator from being accountable for what he did. One wrong doesn't forgive another.

The LA DA should drop the charges and let Mr. Polanski return to America. The original victim, now middle-aged, supports Polanski in this. And thirty-odd years of exile seems like punishment enough for his crime.

Really? Exactly what punishment was that? I don't see how living a life of celebrity privilege in France is punishment.

This is not some case where the facts are in doubt. We know he had sex with the victim. And we know that she was 13, and he was in his 40s. There is simply no excuse for what he did.

If he had faced the music at the time, he would have been out long ago, especially given the light sentences for this kind of thing then, compared to now. He is the one that decided to string this out.

No way should they drop the charges.

Roman Polanski's life has been one unpleasant incident after another. The Nazis murdered his parents and used him as target practice. The Manson family murdered his wife. He had to flee the US after having sex with a minor. And he couldn't even come back to accept an Oscar!

To Existentialist: 30 years as a famous celebrity in France is not a punishment. Polanski was born in Paris, educated in Poland, and shot three major films in England. He is a cosmopolitan, not an Iowa farmer stranded in Europe.

Boofreakin'hoo, Some things in his life were beyond his control, but the rape of a 13 year old was his own doing. There are college kids doing time for sex with legal aged partners, but were convicted because said partners were drunk. This foul creature gave drugs to his victim and willfully engaged in illegal acts with her. He fled the country and has been living quite well these last thirty years.
