GARDEN CITY, N.Y. — The family of a worker trampled to death in a "Black Friday" crush of bargain hunters at a Long Island Wal-Mart store filed a wrongful-death lawsuit on Wednesday, claiming store ads offering deep discounts "created an atmosphere of competition and anxiety" that led to "crowd craze."

The lawsuit claims that besides failing to provide adequate security for a pre-dawn crowd estimated at 2,000, Wal-Mart "engaged in specific marketing and advertising techniques to specifically attract a large crowd and create an environment of frenzy and mayhem and was otherwise careless, reckless and negligent."

Wal-Mart issued a statement saying it would cooperate with local law enforcement officials to develop stronger safety measures for the future.

"We consider Mr. Damour part of the Wal-Mart family, and are saddened by his death," the statement said. "We have been in communication with members of his family to do what we can to help them through this difficult time. Our associates know that when incidents like this occur, we take care of our own."

In addition to the retailer, the adjacent Green Acres Mall, a realty company that manages the property and a security company hired to patrol the property were all named as defendants. A spokeswoman for the realty company declined to comment on pending litigation; none of the other defendants immediately responded to phone and e-mail inquiries seeking comment on the lawsuit.

Jdimytai Damour, 34, had been hired by an employment agency as a temporary worker at the Wal-Mart store in Valley Stream and had been on the job about a week when he died, said his family's lawyer, Jordan Hecht.

The 6-foot-5, 270-pound man died of asphyxiation after being crushed early Friday morning by the crowd, which broke down the electronic doors in frantic pursuit of bargains. At least four other people were treated at hospitals, including a woman who was eight months pregnant.

Authorities suspect that because he was as big as an NFL lineman, Damour was placed at the entrance of the store to assist with crowd control.

"Those hundreds of people who did make their way into the store, literally had to step over or around him or unfortunately on him to get into the Wal-Mart store," Nassau County Police Commissioner Lawrence Mulvey said this week.

Police are reviewing store video to identify possible suspects in Damour's death, but Mulvey conceded that criminal charges are unlikely.

Mulvey said it was apparent to him that the Wal-Mart store about 20 miles east of Manhattan lacked adequate security to handle the crowds. He said police representatives met with retailers throughout the county two weeks before Thanksgiving and made it clear that security and crowd control for the sales were the merchants' responsibilities.

Hecht said Damour's family also plans to file lawsuits against Nassau County and its police department.

County Attorney Lorna Goodman said, "The county has no liability in situations of this kind."

The lawsuit against Wal-Mart and the other companies was filed Wednesday in state Supreme Court in the Bronx, the home of one of the victim's sisters, Elsie Damour Phillipe, the court-appointed administrator of his estate. It does not seek specific damages.

Shoppers around the country line up early outside stores on the day after Thanksgiving in the annual bargain-hunting ritual known as Black Friday. It got that name because it historically has been the day stores broke into profitability for the full year.

The National Retail Federation believes Damour is the first store worker to die on the job in the post-Thanksgiving rush.

I doubt anyone knew there would be a stampede that would trample someone too death. If you say you did then you should be held accountable for not making the knowledge known, kinda silly isn't it?
The store should pay funeral costs but expecting them to make the relatives rich because a bunch of heathens trampled their kin, that is the sick part too me. Litigation nation.

yeah, its all fun and it sounds cute to talk about making some poor family rich because some heathens trampled a man to death while he was trying to protect a pregnant woman from getting trampled to death.

Sean "P. Diddy" Combs had to payout over 3 millions dollars to the victims at an event he promoted they were trampled in a similar fashion to this heroic man at Wal Mart.

If Ohio State can get 100,000 drunk people in and out of a stadium without anyone dying, I'm pretty sure Wal Mart can do better than that with about 2000 people in a heavily promoted event.

Wal-Mart was negligent and should be sued accordingly.

Black Friday crowds are outrageous and to have only one person at the door to manage thousands is ridiculous. To make the argument that someone should be held accountable for knowing there was a stampede is nonsensical. A crowd of 2,000 early morning shoppers allows for the possibility of a stampede, as such they should have been prepared to handle the crowds.

strict liability.­..and negligence­....of course people didn't think this would happen...w­e assume that people are more civilized than this, but these stores should know better. having people running down aisles and fighting each other for products is a recipe for disaster - and the stores are stricly liable for anything that happens on their property.

in this litigous society, walmart should've seen this coming a mile away. that's why many stores only let in a certain number of people at a time and/or give out vouchers to those waiting in line for specific products - it reduces the liklihood of anything happening and it can also provide a defense in court showing that the company took appropriate steps to maintain a safe environment.

Surlybird, I agree with you that there is far too much frivolous litigation clogging up our judicial system but what happened on Black Friday in NY is clear... forgive me if I'm using this term incorrectly, but this has to be gross negligence.

WalMart is the largest corporation on the planet. Unfortunately, much of it's ability to consistently undercut the prices of their competitors has been predicated on cutting corners (especially in terms of safety for their employees, as well as their patrons). There's a history there. Whoever was in charge of security was obviously only really considering one thing, the bottom line. It's truly sickening.

WalMart should pay up. It's their fault.

It is not unusual for management of Wal-Mart to be aware of dangerous situations on their stores. It is there job as managers to ensure a safe environment for the staff.
Unfortunately I have yet to meet or work for a Wal-Mart manger that truly put staff safety and issues as a priority. Teh almighty $$$$$ is all they look for. Cut costs, which would have meant a manger be present, assess the morning, the customers simply by looking out the doors to see. Managers and assistant managers walk by thieir front doors every morning as they walk the store before it opens.

There were more at the door they were scared so as the SAVAGES rampaged they jumped on vending machines to get out of the way.....

I am not saying it was enough I am just thinking it propbably would have taken 30-50 dudes with semi automatics­...put them in those ugly sweatsuits with the skeleton imprints on them with the eyes cut out and then maybe then would stay in line... maybe not that seems to be in fashion.

We have no idea if this man who was not rich, was even laid to rest properly. They said he was rushing to assist a pregnant woman who being pushed belly first against the glass doors at Wal-Mart.

It sounds to me that this man was protecting the life of her UNBORN child. Where is the Rev. Dobson and Pat Robertson????????

I believe this whole culture of crazed one-day deals should be stopped. It's just been an accident waiting to happen, and now it's happened. It's not the first time either, and there are more to come I'm sure. While Walmart isn't the only one encouraging mayhem in the name of saving a buck, they do their part in feeding the frenzy. It's called inciting a riot, which is illegal, and they are the responsible party.

Oh WalMart will pay alright. This is an open and shut case of gross negligence on the company's part. Believe me this is going to be one huge settlement. Wal-Mart will try to get by with making an offer but I am sure the lawyers involved will advise the family to pursue the lawsuit. I would bet that the punative damages awarded will be huge. Deservedly so.

This is a case where a good personal injury lawyer is needed - you know one of those guys that so many wrongfully refer to as "ambulance chasers?"

"No one could have predicted ...." Oh c'mon. For that last several years there have been frenzied rushes on the news the evening of Black Friday. A man is dead because people were venal--the store owners who purposely drew an "attack" crowd, and the shoppers who would kill for a bargain. Some spirit of Christmas.

But, that is what our civil justice system is about. If someone acts with negligent disregard for the safety of others, you have recourse through the courts. The family has every right to sue--a loved one is dead for ridiculous reasons. I would expect that next year no WalMarts or Wally-esque stores will act so carelessly or callously, but we become a nation of slow learners, so I am not going to get my hopes up.

Wal-Mart should pay through the nose. Facts are now out showing they gave this man no training whatsoever in crowd control. Wal-Mart is the most disgusting employer in the U.S. It paysa nothing, give no or few benefits, kills unions, and offers no protection to employees (this story being proof of that). I've been insulted & burned at Wal-Mart so many times, I don't shop there. They are the sleaziest of all stores.

Wal-Mart is partly to blame in this for sure; they should have hired trained crowd control professionals. But I blame the crowd. Those people were savages; barbarians at the gate. A man died for what? So they could spend less on crap they didn't need in the first place? A giant-screen HDTV was marked down? DVDs were cheaper? And again, a man died for this? If they were fleeing a tsunami I'd say, "Well, these things happen." But these were literally bargain crazed freaks with no regard for anyone but themselves (and, presumably, the people on their shopping lists).

That security camera tape should be gone over time and time again and anyone who caused Mr. Damour's death should be rounded up and charged with manslaughter or reckless endangerment or something. But those people shouldn't be living their lives free of consequence. How the hell do you trample someone and not know it? That lump under your feet isn't a clue that maybe you're not running on tile or carpeting? He died for nothing and everyone responsible should be deeply ashamed and face criminal charges.

This is really tragic all round. People are desperate for a bargain, store is desperate for sales, Damour badly needed a job. I wonder if the people who stepped on him were pushed so hard from the back that they couldn't stop. I can only imagine the crush. I am so sorry for his family.
