GARDEN CITY, N.Y. — The family of a worker trampled to death in a "Black Friday" crush of bargain hunters at a Long Island Wal-Mart store filed a wrongful-death lawsuit on Wednesday, claiming store ads offering deep discounts "created an atmosphere of competition and anxiety" that led to "crowd craze."

The lawsuit claims that besides failing to provide adequate security for a pre-dawn crowd estimated at 2,000, Wal-Mart "engaged in specific marketing and advertising techniques to specifically attract a large crowd and create an environment of frenzy and mayhem and was otherwise careless, reckless and negligent."

Wal-Mart issued a statement saying it would cooperate with local law enforcement officials to develop stronger safety measures for the future.

"We consider Mr. Damour part of the Wal-Mart family, and are saddened by his death," the statement said. "We have been in communication with members of his family to do what we can to help them through this difficult time. Our associates know that when incidents like this occur, we take care of our own."

In addition to the retailer, the adjacent Green Acres Mall, a realty company that manages the property and a security company hired to patrol the property were all named as defendants. A spokeswoman for the realty company declined to comment on pending litigation; none of the other defendants immediately responded to phone and e-mail inquiries seeking comment on the lawsuit.

Jdimytai Damour, 34, had been hired by an employment agency as a temporary worker at the Wal-Mart store in Valley Stream and had been on the job about a week when he died, said his family's lawyer, Jordan Hecht.

The 6-foot-5, 270-pound man died of asphyxiation after being crushed early Friday morning by the crowd, which broke down the electronic doors in frantic pursuit of bargains. At least four other people were treated at hospitals, including a woman who was eight months pregnant.

Authorities suspect that because he was as big as an NFL lineman, Damour was placed at the entrance of the store to assist with crowd control.

"Those hundreds of people who did make their way into the store, literally had to step over or around him or unfortunately on him to get into the Wal-Mart store," Nassau County Police Commissioner Lawrence Mulvey said this week.

Police are reviewing store video to identify possible suspects in Damour's death, but Mulvey conceded that criminal charges are unlikely.

Mulvey said it was apparent to him that the Wal-Mart store about 20 miles east of Manhattan lacked adequate security to handle the crowds. He said police representatives met with retailers throughout the county two weeks before Thanksgiving and made it clear that security and crowd control for the sales were the merchants' responsibilities.

Hecht said Damour's family also plans to file lawsuits against Nassau County and its police department.

County Attorney Lorna Goodman said, "The county has no liability in situations of this kind."

The lawsuit against Wal-Mart and the other companies was filed Wednesday in state Supreme Court in the Bronx, the home of one of the victim's sisters, Elsie Damour Phillipe, the court-appointed administrator of his estate. It does not seek specific damages.

Shoppers around the country line up early outside stores on the day after Thanksgiving in the annual bargain-hunting ritual known as Black Friday. It got that name because it historically has been the day stores broke into profitability for the full year.

The National Retail Federation believes Damour is the first store worker to die on the job in the post-Thanksgiving rush.

Wal-Mart intentionally creates this crowd chaos to promote their existence and intensify consumer demand, and the news media are always there in the early morning hours to report it.

Does anyone wonder like I do, why does it take Christmas spending to make a store profitable. Do people put off buying what they really need until Christmas or is the profit in buying a lot of crap people don't really need? I came to atheism out of the understanding that if I gave up church, religious holidays, and all the other associated activities I retained a large portion of my income and my time for my own use. I have noticed that for the last 35 years life is so much more fun because I get to spend my money and my time doing what I like as opposed to doing or not doing what some religious nut job tells me I should or should not be doing. If there is a GOD, I'm sure SHE didn't put me here for a bad time and that is what religion is, a bad time! And Chritmas is one of those bad times. It cost this poor guy his life!

I don't know if it is a fact or not but my friend who lives in NY said at this exact Wal-Mart last year on Black Friday the crowd ripped the door off as well. If that is the case then they knew what to expect and should have been better prepared for the crowds.

I feel so much for his love ones to lose him this way. It's such an tragedy. I hope Wal-Mart will settle with these people and not drag this out for them any longer than necessary.

the people responsible are the animals in the crowd that trampled a man for a cheap purchase. CNN reported that even after they closed the store when the poor man was trampled, some people insisted on getting their shopping done before they could be escorted out. They just killed someone, and they were worried about getting a deal. I hope they can tell who these people were on the video and prosecute them for whatever they can. I feel for the guys family, I saw his poor father on television, and my heart broke for him. Every store has a sale on Black Friday, and while I despise everything that Wal-Mart stands for, and won't shop there, this isn't their fault, this is the fault of all those people who behaved the way they did.

It's not just Wal-Mart, it's all of the major retailers and "big box" stores... how many times leading up to Black Friday did you see or hear the term "Door Busters" in print, radio or television ads? The stores eat this stuff up, and they love the "tradition" of seeing all those mindless sheep pressed up against the glass entrances of their stores, then flooding in like rats fleeing a burning building.

Look back at the number of rock concerts where a limited number of tickets were sold at the gate and people got trampled and died. Laws were passed to prevent these kind of things happening. Even tho this situation has happened in years past there has been no attempt to pass laws preventing retailers from engaging in this dangerous practice. The reason being that the people who would have to pass these laws are in bed with the retailers and don't want that money to stop flowing into their reelection coffers!

Look, I hate Walmart. But this is an issue of people not showing self restraint.

Ask yourself, would you trample a person or would you stop to help? It's pertty much that simple.

If but one or two people had stopped and helped him, this would not have occured.

When a mob stampeeds, survival is all that matters. Look at the soccer match riots in Europe or the nightclub fires in this country. Once the stampeed starts, everyone is part of it. Or trampled. Wally*World created an attractive nuisance that got out of control. Why not go out at night and pass out entry numbers to the people in line? And BTW, this same scene was repeated all over the U.S. They put a whole lot of greedy little consumers at great risk. SAD.

As is usual in trampling deaths of this sort the problem is simply the number of peoply pushing you from behind.

This is clearly a matter of inadequate crowd control. There is no way that many people (enough to bust it down) should have been hitting the door at once.

I suspect a quick out of court settlement by a combination of WalMart and the security company. WalMart might be able to hide behind worker's comp, but the security company is unlikely to.

Wal-Mart will attempt to settle out of court. The behavior of the crowd itself is not the issue. How the store handled or failed to handle a situation they created and were aware of prior to opening their doors will be at issue. If you were Wal-Mart, would you want a jury to see the security video?

They CAN find those people. Beyond the tapes, these people acutally got into the store. They have them on tape. I don't believe for a second they can't find the perps. AND I think if this was a white person CRIMINAL charges would have been filed the NEXT day!

Each state has its own worker comp laws. New York State has a very competent WC program. They will pay the death benefits to the estate. The benefits are limited to a specific amount usually based on the worker's pay and number of dependents. This assumes Mr. Damour was legally employed by WM and not there as a contract labor service employee. In the latter case, things get complicated. There may also be Social Security Benefits for any of his dependents.
