GARDEN CITY, N.Y. — The family of a worker trampled to death in a "Black Friday" crush of bargain hunters at a Long Island Wal-Mart store filed a wrongful-death lawsuit on Wednesday, claiming store ads offering deep discounts "created an atmosphere of competition and anxiety" that led to "crowd craze."

The lawsuit claims that besides failing to provide adequate security for a pre-dawn crowd estimated at 2,000, Wal-Mart "engaged in specific marketing and advertising techniques to specifically attract a large crowd and create an environment of frenzy and mayhem and was otherwise careless, reckless and negligent."

Wal-Mart issued a statement saying it would cooperate with local law enforcement officials to develop stronger safety measures for the future.

"We consider Mr. Damour part of the Wal-Mart family, and are saddened by his death," the statement said. "We have been in communication with members of his family to do what we can to help them through this difficult time. Our associates know that when incidents like this occur, we take care of our own."

In addition to the retailer, the adjacent Green Acres Mall, a realty company that manages the property and a security company hired to patrol the property were all named as defendants. A spokeswoman for the realty company declined to comment on pending litigation; none of the other defendants immediately responded to phone and e-mail inquiries seeking comment on the lawsuit.

Jdimytai Damour, 34, had been hired by an employment agency as a temporary worker at the Wal-Mart store in Valley Stream and had been on the job about a week when he died, said his family's lawyer, Jordan Hecht.

The 6-foot-5, 270-pound man died of asphyxiation after being crushed early Friday morning by the crowd, which broke down the electronic doors in frantic pursuit of bargains. At least four other people were treated at hospitals, including a woman who was eight months pregnant.

Authorities suspect that because he was as big as an NFL lineman, Damour was placed at the entrance of the store to assist with crowd control.

"Those hundreds of people who did make their way into the store, literally had to step over or around him or unfortunately on him to get into the Wal-Mart store," Nassau County Police Commissioner Lawrence Mulvey said this week.

Police are reviewing store video to identify possible suspects in Damour's death, but Mulvey conceded that criminal charges are unlikely.

Mulvey said it was apparent to him that the Wal-Mart store about 20 miles east of Manhattan lacked adequate security to handle the crowds. He said police representatives met with retailers throughout the county two weeks before Thanksgiving and made it clear that security and crowd control for the sales were the merchants' responsibilities.

Hecht said Damour's family also plans to file lawsuits against Nassau County and its police department.

County Attorney Lorna Goodman said, "The county has no liability in situations of this kind."

The lawsuit against Wal-Mart and the other companies was filed Wednesday in state Supreme Court in the Bronx, the home of one of the victim's sisters, Elsie Damour Phillipe, the court-appointed administrator of his estate. It does not seek specific damages.

Shoppers around the country line up early outside stores on the day after Thanksgiving in the annual bargain-hunting ritual known as Black Friday. It got that name because it historically has been the day stores broke into profitability for the full year.

The National Retail Federation believes Damour is the first store worker to die on the job in the post-Thanksgiving rush.

You know, I really don't want to make huge generalizations but I really want to talk about Walmart Nation. Now, I've been to Walmart, most of us have for one reason or another. I'm not a regular customer. But, I remember Sarah Palin extolling the good old Walmart and talking about how she married a couple there in the Walmart Wasilla. There's this overall sense that Walmart is the keeper of the so-called American Way of Life and it really makes me sick. No corporation sellings goods and services should be representative of the way that you and I choose to live our lives. We are human beings, not mechanically controlled shopping machines. For all the fake outrage that Bill O'Reilly and his cohorts vomit up each year about the War on Christmas and all that, I really have to say that Walmart and every other store like it that has decided the Black Friday is this year's ticket to paradise are really the perpetrators of the War on Christmas. Time to simplify people. Time to figure out how to grow one's own food and get the hell out of the consumption business. We are killing ourselves and now, literally, other people with our terrible need for big TVs.

why sue the county? When the stores claim their little fiefdom of private power they can and do call for the arrest of people wearing anti war t shirts. If it is their fiefdom in political speech is their fiefdom in security too. Or as this country sold out with legalistic sophisms and chicanery to corporations for everything but really everything?

VERY SAD... I hope the family takes those miserable pigs at Wal Mart for all they can get. Millions of others have sued and gotten no where...their pockets are too deep and they are filled with judges too. But Xmas and unnecessary death ought to bring justice a little closer than just getting off the hook as they usually do. Still, another example of how little Wal Mart cares for its employees.

I do not shop at Walmart. This is my personal boycott.

They get away with unnecessary deaths because we allow them .They realize how greedy we
are and that we have bought in to their hype. When they stop promoting 'Made In America"
I left them.Sure I pay a little more at the other stores,but the quality is better.

I don't care for them. They (Wallie)and their executive are pathetic human beings.And they are
the prime example that greed and unchecked power indeed corrupts!!!!!!!!!!!!

Jdimytai Damour's death is a logical outcome of our corporatized society where profit trumps every other concern. Jobs are outsourced to third world sweat shops, labor is nothing but an expense line on the corporate balance sheet, and worker safety is under attack RIGHT NOW by the outgoing Bush administration.

Don't just sue Wal*Mart. Sue the rightwing think tanks that have set the stage for global corporations to take over American business. For starters, sue the American Enterprise Institute and the Heritage Foundation. They mapped out the values and policies that culminated in Mr. Damour's death.

Normally I'm disgusted by a sue-happy public. But I'm somewhat sympathetic in this case.

When a retailer runs an ad that screams "$20 laptops! Only 5 units per store! Friday Only! Hurry, Hurry, Hurry!" can that be the equivalent of shouting "Fire!" in a crowded theater?

Ok, that wasn't the ad that Wal-Mart ran. I don't know what they were advertising but we've all seen the frenzy that retailers try to whip up for Black Friday. Insane discounts on extremely popular items with insanely limited availability. If that isn't designed to insite a stampede then what is it designed to do? There's a reason they call them door-crasher items.

And it doesn't even have to be crazy shoppers. When you have a mass of people packed tight and you open the doors there's going to be an explosion of human beef. Yeah this was a big guy but just four people falling on top of you can be nearly a half-ton of pressure on internal organs.

Maybe retailers need a rope line or line tickets or some other crowd control. Or maybe retailers need to offer adequate supplies of sales items instead of one or two door crasher items.

They know what they are doing when they whip up consumer frenzy and they need to be prepared to manage the consequences. A lone Wal-Mart greeter is not crowd control

The local paper there said that the main stampede was caused by two groups: one were people who had waited in the cars and ran over & the other were the people in line who said "no way are you going to cut in front of me." Simple, isn't it?

I hate WalMart! Who wants to shop there? They sell so much crap. I just saw a special on WalMart where these hillbilly executives were talking about how they are expanding their empire all over the world. It's just another embarrasment to the United States.
Anyways, I hope the family of this poor guy who was trampled to death gets a lot of money from them. I wish that Sam Walton would get charged for murder. I know that's not realistic, that's just a fantasy of mine.

The lawsuit was filed in the Bronx because Bronx juries give the biggest awards in NYC. Victims' attorneys always file in the Bronx if a close family member lives there.

Maybe stores will reconsider how they plan those deceptive ads for door-buster sales. I'm really sorry that it was an employee--he didn't deserve it. He wasn't one of the throng, he was just trying to pay the rent.

What does God have to do with it? This was the result of corporate greed run amuck.

By throwing God into the equation, you're throwing out personal responsibility.

Actions have consequences. Wal-Mart, the store management, anyone involved in the decision to NOT provide adequate security is personally responsible for Mr. Damour's death.

Monetary sanctions are not enough. They should all be put on trial for involuntary manslaughter and sent to prison.

Wall Mart will pay and pay huge.

They have no choice. This would be a gigantic public relations disaster of Biblical proportions if they tried to fight it. I would imagine corporate is already trying to figure the best way to handle this.

If it was me in charge all costs would immediately be born regarding funeral costs etc.

THEN finding out about children and setting up trust funds for college and all education leading to college and a wife that would be taken care of for life.

The amount? That's difficult to say. but I'd figure about 25 mil overall should cover it

Except that Corporations tend to be willing to spend 100 million to fight these suits because of the long term implications. It would be worth that amount of money to dupe a jury into believing that the "Corporation, as a person," is not responsible for these stupid acts because they are engaged in business and the Constitution protects their rights. See the verdict regarding Chevron's culpability in the trial over the corporations payments to the military government and their providing helicopters to take paramilitary units to a barge occupied by unarmed protestors. Some protestors were killed and the rest were imprisoned and tortured. The jury just took 30 minutes to find Chevron not responsible for the deaths. Americans are so totally oblivious to the culpability of corporations acts of negligence both here and abroad. They think the WalMart Greeter is WalMart, not the million dollar management that exploits workers and customers alike.
Do the right thing? They think they are when they put the business's interests before those of the emplyees!

Yes, I agree that Wal-Mart is culpable to a degree. On the other hand, what is wrong with the mentality of people, like my sister, who get up at 4:30 am to go to a store opening at Wal-Mart at 5:00 am? My stipulation would be that most of the people there have a loose screw by evidence that they are THERE. I'm not blaming the victim, but I have to admit that this mind set has me baffled at best and depressed, at least.

The family ought to ask if Walmart had a seperate insurance policy on this man, they do that you know. They take life insurance policies on people and get the money for them.

This is shame and everybody that shops at Walmart should stop now, I have for two years. If Sam Walton was alive today, he would be ashamed at what has happened to his company by his greedy spoiled grandchildren.

I only go there if I absolutely have to, I shop at Kmart/Sears, still an American company. Walmart sucks, they treat the Chinese like slaves, and if they could do it here, they would. I HATE WALMART.

K-Mart filed for bankruptcy protection, emerged with enough money to buy Sears? How come? I don't think they needed to be protected in the first place. It is a ploy to cheat creditors and expand at the same time.
