GARDEN CITY, N.Y. — The family of a worker trampled to death in a "Black Friday" crush of bargain hunters at a Long Island Wal-Mart store filed a wrongful-death lawsuit on Wednesday, claiming store ads offering deep discounts "created an atmosphere of competition and anxiety" that led to "crowd craze."

The lawsuit claims that besides failing to provide adequate security for a pre-dawn crowd estimated at 2,000, Wal-Mart "engaged in specific marketing and advertising techniques to specifically attract a large crowd and create an environment of frenzy and mayhem and was otherwise careless, reckless and negligent."

Wal-Mart issued a statement saying it would cooperate with local law enforcement officials to develop stronger safety measures for the future.

"We consider Mr. Damour part of the Wal-Mart family, and are saddened by his death," the statement said. "We have been in communication with members of his family to do what we can to help them through this difficult time. Our associates know that when incidents like this occur, we take care of our own."

In addition to the retailer, the adjacent Green Acres Mall, a realty company that manages the property and a security company hired to patrol the property were all named as defendants. A spokeswoman for the realty company declined to comment on pending litigation; none of the other defendants immediately responded to phone and e-mail inquiries seeking comment on the lawsuit.

Jdimytai Damour, 34, had been hired by an employment agency as a temporary worker at the Wal-Mart store in Valley Stream and had been on the job about a week when he died, said his family's lawyer, Jordan Hecht.

The 6-foot-5, 270-pound man died of asphyxiation after being crushed early Friday morning by the crowd, which broke down the electronic doors in frantic pursuit of bargains. At least four other people were treated at hospitals, including a woman who was eight months pregnant.

Authorities suspect that because he was as big as an NFL lineman, Damour was placed at the entrance of the store to assist with crowd control.

"Those hundreds of people who did make their way into the store, literally had to step over or around him or unfortunately on him to get into the Wal-Mart store," Nassau County Police Commissioner Lawrence Mulvey said this week.

Police are reviewing store video to identify possible suspects in Damour's death, but Mulvey conceded that criminal charges are unlikely.

Mulvey said it was apparent to him that the Wal-Mart store about 20 miles east of Manhattan lacked adequate security to handle the crowds. He said police representatives met with retailers throughout the county two weeks before Thanksgiving and made it clear that security and crowd control for the sales were the merchants' responsibilities.

Hecht said Damour's family also plans to file lawsuits against Nassau County and its police department.

County Attorney Lorna Goodman said, "The county has no liability in situations of this kind."

The lawsuit against Wal-Mart and the other companies was filed Wednesday in state Supreme Court in the Bronx, the home of one of the victim's sisters, Elsie Damour Phillipe, the court-appointed administrator of his estate. It does not seek specific damages.

Shoppers around the country line up early outside stores on the day after Thanksgiving in the annual bargain-hunting ritual known as Black Friday. It got that name because it historically has been the day stores broke into profitability for the full year.

The National Retail Federation believes Damour is the first store worker to die on the job in the post-Thanksgiving rush.

This is ridiculous! I'm no big fan of the Wal-Mart mega-monopoly, but the people responsible are the ones who trampled the guy, NOT Wal-Mart. Blaming Wal-Mart for the man's death is nothing but trying to collect from the one's who have money for them to take! I feel for them, but this is opportunistic and wrong.

Every employee has the right to work in a safe environment. Wal-Mart clearly did not provide this. I agree the tramplers should be sued, but there's no way to do that. Wal-Mart should pay for this mistake and, of course, learn from it. Where does OSHA stand with this?

OTOH, making them ante up will force them to be more worker-friendly in the future. It's the only way a greedy corporation gives a s* it.

The Bushie's took care of OSHA-made it into a do-nothing department. Gov't doesn't work & they will prove it by making it the most expensive, incompetent, spineless entity possible.
BTW, Walmart created the atmosphere that made that possible. They are grossly responsible for his death.

I agree that consumers are responsible for their behavior, but this type of incident has been happening every year. Companies should know by now the effect that their ads have on people and go to greater lengths to protect their employees and shoppers.

Wal-Mart has a responsibility to enact measure that assure the safety of its workers and its customrs. They neglected to protect people, and they are liable in the death of Mr. Damour.

To be bluntly frank about this----the suit is against WalMart because it has VERY deep pockets. The people who trampled the man to death (even if it were possible to identify and locate them) probably have shallow pockets. People who will walk over a body on the ground in order to get a good deal on an HD TV are people who must need a bargain.

I'm not an expert by any means but in many states the workers' compensation laws prevent civil lawsuits of this type, even where the employer's negligence clearly caused the injury or death. That would add insult to injury (death) in this case but it is not at all uncommon for an employer to use workers' compensation laws as a shield from liability. I suspect this is the reason the County was named as a "third party" even though their responsibility is tenuous at best.

The decedent worked for a temp agency, so that complicates the legal picture. His job was as a cleaner, and if his duties did not include opening the door for customers, we have another issue.

Point well taken. Pretty disgusting performance by Wal-Mart and the herd that morning. Trampling another human being just to get to a discount doo-dad reflects poorly on who we are as a people. Anyone in that crush should seek forgiveness in some meaningful way.

If they closed the store it was for a short period of time...not the rest of the day as I recall. To add insult to injury some of the customers were outraged they were being asked to leave because they had been waiting in line all night. Tragically, UNBELIEVABLE and callous. I hope the customers that mowed this poor gentleman down are prosecuted to the max.

I read that the store was closed----but the shoppers got very angry when they were told that it was closing.

WalMart is most likely culpable in this case, but it's a shame that the actual killers----those people who, in their mindless haste to get inside the building, trampled over a man who was on the ground----can't be prosecuted, also. They are probably the same people who run red lights, and who cut in line at the grocery store, and who ride on the right shoulder of the road during a traffic jam so they can get ahead of other drivers. They have some sort of a sense that they are entitled to go ahead of everyone else, no matter what the situation, and they can very easily turn from a crowd into a mob. Also, Black Friday shopping has become such a big deal that some people regard it as some sort of sport; why else would they get up at 3 in the morning to go stand in line, shivering in the dark, in the parking lot of some store?

It has been 30 years since I decided that I would not shop on that day (back then it was just called "the day after Thanksgiving," which didn't have nearly the cachet of "Black Friday"), and I have never yet regretted it.

Why doesn't the family include wrongful death suits against whoever invented Black Friday while they're at it? I agree they should be suing the store, but this kind of blanket "sue everyone within sight" litigation is EXACTLY the problem with American law.

I mean suing the Nassau County police as well? What the hell is that going to serve?

They P.D. will probably get dropped as the case progresses; but, it's typical to name everyone possible when a lawsuit is filed, cause when it comes to damages they want to be able to go after the one with the deepest pockets, which in this case should be Wal-Mart.

I have noticed over the last 20 years of working
in retail, that people are more impatient, more
likely to push and shove their way down isles.
As a shopper I have been literally pushed out
of the way while reaching for an item. When I
am working I have had a person throw a shopping
bag at me and use foul language. It's going
to get even worse.

While suing Wal-Mart is just, especially if the family can prove they were negligent, going after Nassau County and its police department is a huge mistake for a number of reasons.

It's not only difficult to see how Nassau Co was responsible, but an action taken against the local government would probably backfire with the jurors. The plaintiffs need the cops and the town on their side to win.

If the lawyer filed a lawsuit against the County of Nassau - that may be an indication that he/she doesn't know jack about how to prosecute this civil case. Nothing ruins a good case better than a BAD LAWYER. Forget about the country and the police department - no liability there. Concentrate on Wal-Mart.

If they're smart they got the best--wrongful death cases are generally always contingency cases anyway, and while they might wind up having to dole out anywhere from 25-40 percent, what's important is they get someone good.

Actually, if you are "named" in a lawsuit, you have been "sued" for some sort of damages. Same/same. Doesn't mean that the claims against you will hold up in the face of a motion to dismiss for failure to state a claim, which is likely the case for Nassau County and its police department which, unless they have waived it in some way, have sovreign immunity. (Whew, that was a run-on sentence.) But the long and short of it is if you have been named as a defendant, you have indeed been sued for damages (which is all you are entitled to in civil actions.)

I hope they win big. Wal Mart doesn't care about anyone but the bottom line and the color green. Under this administration safety for employees is the last things that companies want. The only thing that gets these companies attention is money. Shame on Wal Mart.

The comparison of Mr Damour's size to that of an NFL lineman is ironic. A photo I saw of the outside of the store right after this tragedy showed a policeman standing next to a sign, evidently posted by Wal-Mart, that said, "Blitz Line Starts Here." Mr. Damour suffered a blitz of several hundred customers encouraged in their mindless mayhem by this reference to a football play where the defensive line rushes the ball handler with object of flattening him.
