WASHINGTON — His Supreme Court confirmation hearings three years old, Justice Samuel Alito apparently still harbors some hard feelings toward one Democratic questioner at the time.

Alito made several joking references to Vice President-elect Joseph Biden during an after-dinner speech Wednesday, including Biden's withdrawal from the 1988 presidential campaign over plagiarizing parts of a speech from a British politician.

"To coin a phrase, in the spirit of the vice president-elect, you can't always get what you want, but you get what you need," Alito said, an imperfect rendering of a Rolling Stones lyric.

Then, he added, "Did someone say that before?"

A bit later in his talk at an anniversary dinner for the conservative American Spectator magazine, Alito said he was about to quote liberally from a magazine article. "In the spirit of the vice president-elect, I want to honor the copyright laws," Alito said.

What could be the impetus for these comments?

Alito didn't specifically explain, but he recounted questions Biden asked during the Senate Judiciary Committee's consideration of his nomination.

Biden "became quite agitated about my supposed connections with a sinister Princeton University alumni group...that took up virtually his entire time during the first round," Alito said.

The Senate approved his nomination 58-42, although both Biden and President-elect Barack Obama voted against Alito's confirmation.

"When I look at all the evidence before us, Judge Alito's writings, his statements, his judicial records and his opinions, and the little we learned about him in these hearings, I am forced to conclude that he should not serve in the Supreme Court," Biden said in January 2006.

A Biden spokesman did not immediately comment Thursday.

Alito also described change at the Supreme Court musically.

The late Chief Justice William Rehnquist favored standards and light opera. His successor, John Roberts, became the first justice to quote Bob Dylan in a Supreme Court opinion issued earlier this year, Alito said.

"In the space of a generation, we have gone from Irving Berlin to Bob Dylan," he said. "These are the evolving standards of a maturing society."

As for his own musical tastes, Alito said little, although he used song lyrics from James Taylor, Dylan and the Rolling Stones in his talk.

He conceded that as a high school student on New Year's Eve 1967, he sat at home and watched on television as Guy Lombardo and his Royal Canadians performed at the Waldorf Astoria hotel in New York. Alito said his parents liked the annual program.

The economy is on everyone's mind these days, even Roberts'. He has life tenure and an annual salary of more than $200,000.

But he sounded like an everyman this week at arguments in an environmental case over whether energy companies should have to install technology to reduce the number of fish that are killed at older power plants that draw in billions of gallons of water for cooling.

"I mean, maybe the industry could have borne these costs two years ago, but they probably can't today," Roberts said. "Nobody has money in the bank today."

A supreme court justice who carries a grudge... tipping the scales there aren't we? This goes against the balance we expect them to have, and why the founders decided they should have a life term, so they would not have to deal with the political pressures. Personal pressures? Alito...th­is is not a good stance.

somebody might want to remind these black robed devils that even the right wing wants them OUT.
Justice Alito might want to read the case of Justice Chase, whose acquittal set Impeachment precedent insulating Justices from Impeachment EXCEPT for criminal activity.
When there were still old school American Revolutionaries in Congress, they played the game with more youthful vigor. Perhaps our disgraceful Supremes need culling.
It might be time to revisit that precedent.

This man is a disgrace to the court. He will always be known as Bush's little stooge.---­Those on The Court that still have character and honor should move to have him censured for those types of public, political comments. Oh, that's right, there are no members of the court with honor after Sandra left.

Sandra was the vote that gave Bush the election in 2000. And she couldn't stand the thought of Gore being President so she decided the case based on her personal political feelings not on professional jurisprudence.

It is amazing how revealing it is what Alito said about the case of the energy company not having the money to install the technology to reduce the number of fish killed. Conservatives always seem to find a reason to not do the right thing. Always!

Isn't Alito one of those ultra conservative moral values republican? Then why is he violating the Code of Canon Law and the American Bar Association's Principles of Ethics and Personal Conduct.

Alito may not be a Liberty University Law School grad, but he is an idiot just like the rest of the Liberty University Law School grads that Bush/Gonzales had over at the Department of Justice.

Alito must be off his meds -- Anyone forget how bugged eyed he was during his confirmation hearings, those pupils were whacked out. His eyes looked just like that runaway bride from Georgia and that psycho diaper wearing lady astro-"nut"

Is there no way to remove such an incompetent political judge? All of his decision are colored by his politics. The Supreme Court of the United States should be apolitical! If he can't put aside his politics he should be removed from the court!!!!!

Get over it you giant bag of hot air, how long are you going to carry this around? Guess what it is no big deal that biden barrowed someone elses words, one time without crediting the author, he had always credited him before, big freaking deal. You know what is a big deal, the fact that sometime in the next few years you are going to be so out numbered your vote won't count. You will be just sitting there on the bench taking up space, no change right, that's been what you have been doing scince you got there. Grow Up.

boosh got lucky for hiring these right wing judges during his administration, king boosh thought he could change the consitution while him and then controlled rethuglican in the house and the senate. the law is the law, only way to change the consitution is by 290 votes approved by the congress, not by the judge...he­hehe boosh thought wrong!

Actually the only way to change the Constitution is the having the amendment approved by a two-thirds vote in both houses of Congress and then ratified by three-fourths of the states, typically within seven years.

Disgusting! This is a slap at the dignity and importance of the office he holds, and at the memory and stature of the many conservative judges there have been who were nevertheless worthy of respect and knew how to conduct themselves. --- As someone above said "Joe was right and Alito just proved it." And boy, did he. -------- Apparently there is going to be a fight for the bottom rung on that ladder - between Alito and Thomas! And at least Thomas doesn't get smarky in public. THANK GOD John McCain was not elected!!!!! McCain I could have dealt with -- the judges he would have appointed to 'please the base' - no way.
