WASHINGTON — His Supreme Court confirmation hearings three years old, Justice Samuel Alito apparently still harbors some hard feelings toward one Democratic questioner at the time.

Alito made several joking references to Vice President-elect Joseph Biden during an after-dinner speech Wednesday, including Biden's withdrawal from the 1988 presidential campaign over plagiarizing parts of a speech from a British politician.

"To coin a phrase, in the spirit of the vice president-elect, you can't always get what you want, but you get what you need," Alito said, an imperfect rendering of a Rolling Stones lyric.

Then, he added, "Did someone say that before?"

A bit later in his talk at an anniversary dinner for the conservative American Spectator magazine, Alito said he was about to quote liberally from a magazine article. "In the spirit of the vice president-elect, I want to honor the copyright laws," Alito said.

What could be the impetus for these comments?

Alito didn't specifically explain, but he recounted questions Biden asked during the Senate Judiciary Committee's consideration of his nomination.

Biden "became quite agitated about my supposed connections with a sinister Princeton University alumni group...that took up virtually his entire time during the first round," Alito said.

The Senate approved his nomination 58-42, although both Biden and President-elect Barack Obama voted against Alito's confirmation.

"When I look at all the evidence before us, Judge Alito's writings, his statements, his judicial records and his opinions, and the little we learned about him in these hearings, I am forced to conclude that he should not serve in the Supreme Court," Biden said in January 2006.

A Biden spokesman did not immediately comment Thursday.

Alito also described change at the Supreme Court musically.

The late Chief Justice William Rehnquist favored standards and light opera. His successor, John Roberts, became the first justice to quote Bob Dylan in a Supreme Court opinion issued earlier this year, Alito said.

"In the space of a generation, we have gone from Irving Berlin to Bob Dylan," he said. "These are the evolving standards of a maturing society."

As for his own musical tastes, Alito said little, although he used song lyrics from James Taylor, Dylan and the Rolling Stones in his talk.

He conceded that as a high school student on New Year's Eve 1967, he sat at home and watched on television as Guy Lombardo and his Royal Canadians performed at the Waldorf Astoria hotel in New York. Alito said his parents liked the annual program.

The economy is on everyone's mind these days, even Roberts'. He has life tenure and an annual salary of more than $200,000.

But he sounded like an everyman this week at arguments in an environmental case over whether energy companies should have to install technology to reduce the number of fish that are killed at older power plants that draw in billions of gallons of water for cooling.

"I mean, maybe the industry could have borne these costs two years ago, but they probably can't today," Roberts said. "Nobody has money in the bank today."

Roberts comment is concerning. We have the real economy which is a question of the earth bringing forth fruit and other resources like fish. then we have the economy imposed on that by man's rules of ownership and commerce. Roberts apparently thinks we should put at risk the real and real basis for the economy to avoid disrupting the man made rules. Where will that fishing industry be if it destroys the real basis for its existence-- the fish population.

Roberts might want to look for a job in the private sector for a significantly higher income.
And bring Alito, Thomas and Scalia along with him.

Don't sweat it, Joe. If Alito had valid, rational, or even real opinions, Bush would have NEVER selected him. Bush did say that Miers was the most qualified candidate, he didn't say that about this jerk.

Poor, sad, Alito... In all of the Supreme Court decisions I have read, it is Alito's language that upsets me the most. He is, at his core, a very angry little man. His brilliance cannot outshine his small-mindedness. Alito has once again shown himself to be the ultra-partisan, uber-conservative throw-back we have all come to expect him to be. I agree that it is inappropriate for a Supreme Court Justice to attack the incoming Vice President in such an open and public manner. He must be very upset that a conservative majority in the court was so close at hand, and now his dream is gone. He will have to work with new justices appointed by two men who voted against him. Although I usually cringe when I read Alito's angry words, I am rejoicing in them today because the fact that he is angry right now means something good has happened.

We have the supreme ill fortune of being cursed with Roberts, Alito, Thomas, and Scalia for years unless the people rise en masse and demand that lifetime appointments be abolished. A huge trouble with the nation as a whole is the lack of spine in the very people themselves. I cannot stretch my imagination far enough to grasp how in this world LOUISIANA went to mcsame. With New Orleans still in ruins, how can anyone vote for more of the same incompetence?
When the people, like you and me who trudge off to work in the morning or at whatever hour your labors begin, pick up our courage and write, write, write to Congress, our newspapers, our local radio stations and put our voices together to demand that this sort of buddy system of placing cohorts in positions of authority for which they are in no way qualified be STOPPED, the repubs will continue to worm their ways into the fabric of the country until they succeed in creating the dictatorship we got a peek at in the bush administration.
No one serving on the Supreme Court should be childish enough to hold a grudge. That type of person does not have the maturity and judgement to decide points of law, he creates law as he wants it.

Go to "Change.gov" and sign up. Then, USE it. We cannot afford to be complacent any more in this country. We, the people, have to pay attention to what is going on in OUR government, and then stand up for what we believe in. If you have strong feelings about what Obama or anyone in his cabinet or the Democrats in Congress, WRITE THEM and demand to be heard! If they won't listen, then prepare to vote them out of office when they come up for re-election. If the whole country would do that, we could straighten this mess out once and for all. We have been saying "Not this time", but now it is time to start saying "Never again"! We need to make the electorate respectful of the 'power of the people' again.

Nothing makes me feel more confident about the integrity of our Supreme Court than to know that one of only nine justices with lifetime tenure has the maturity of a junior high schooler and the vengeful nature of a "Mean Girl".

It is a first, he is known for his calm demeanor and deep intellect-- and then this has to be a quote, because I didn't hear him say it. Rather like the 'bitter' comment Obama made (if you listened to the comment) it was a fact and reference to the difficulty reaching certain people in PA. But a blogger decided to repeat the remark out of text (before we heard the remark from Obama's mouth) to the highest bidder and Hillary had a field-day with it. The misquote spread much faster than the truth.
