DETROIT — Medical marijuana became legal in Michigan on Thursday, but smoking a joint could still get patients arrested because the regulations needed to protect them won't be ready for months.

The law approved by voters in November allows patients with cancer, HIV, AIDS, glaucoma and other diseases to use marijuana to relieve their symptoms on a doctor's recommendation.

Qualifying patients can register with the state and receive ID cards allowing them to legally acquire, possess, grow, transport and use a limited amount _ no more than 2.5 ounces and 12 plants _ of marijuana. They also can designate a primary caregiver to receive similar protection.

But those cards won't be issued until the Department of Community Health introduces guidelines addressing how applications will be handled, what fees will be charged and other issues. The rules must be finalized by April 4.

Until then, anyone possessing marijuana _ even patients who could later qualify for the program _ can be arrested and prosecuted, though the law allows patients to use a medical-justification defense at trial.

"We have this void where this takes effect now, but there are no rules, regulations or guidance for the people who want to use it or the people who enforce the laws," said Jim Valentine, chief of police in Lowell and first vice president of the Michigan Association of Chiefs of Police.

Officers in Lowell will arrest marijuana users even if they claim to be patients awaiting cards, Valentine said. He said he'll let the prosecutor decide whether to pursue charges.

A medical-marijuana program nearly identical to Michigan's was implemented without major incident in Rhode Island in 2006, said Charles Alexandre, who oversees the program as chief of health professions regulation in Rhode Island's Department of Health. That state also had a period where the law went into effect before the regulations were in place, and patients simply had to wait until the rules were in order.

"It's been very quiet," Alexandre said.

Michigan is the 13th state to allow medicinal use of marijuana, though the state's law doesn't address how patients can obtain it. It's illegal to sell marijuana, even to registered patients. That's also the case in several other states.

Police in Michigan say they want guidance on the issue, and some experts said the Legislature may have to intervene if that or any other aspect of the program becomes a problem.

Congrat to Michigan. Maybe I will move to Detroit soon (and be the sole person coming INTO the city).

But want to end all economic problems for awhile?

Legalize it!

It will provide income to millions and eliminate the deficit in about a year or two (through high taxation).

Also, I think it would be easier to make into a consumable product – which is better for you than smoking it.

Plus we will all be happy!

eating cannabis is a whole lot different than smoking it. Eating is produces a much heavier high, some people find it very unpleasant. Best way is to use a vaporizer, which heats up the active ingredients and produces an essense smoke, which contains none of the heavy tars, etc.

I take issue with your Detroit comment - the city is actually pretty cutting edge, there's a strong artsy core of young folks determined to bring it back / restore / adaptive reuse architecture, local economics / great music scene, centrally located city, on an international border, with Chicago's housing market in the tank and the eventual (depending on incentive) "greening" of the MI economy, I'd say Detroit is the only sure investment left right now - where else can you get a 4 bedroom pre-war house fully restorable for under $100K - try visiting and you'll know what I mean - it's a real American city with a dark edge like Baltimore or Pittsburgh - not for everybody, for sure - but I did it alot.

something to consider.....

Bill Richardson, I believe, is on record as being in favor of decriminalizing cannabis, maybe even legalizing it. He was just nominated to be Commerce secretary. A couple of years ago, the supreme court heard a case from California that involved medical marijuana, and ruled against the patient in that case based on something called the "commerce clause" in the constitution that involved intrastate commerce.

Any chance Richardson could help sponsor a bill that would take care of the problem? This is coming from a non-legal oriented mind....just asking.

Why take a hundred dollar pill when you have cancer - when you can just eat or smoke a natural plant that will make you giggle and crave twinkies? One that doesn't kill you, is all natural, and has been used for medicine since recorded history. I've seen it help some people that might have otherwise died during cancer treatments. It needs to be legal everywhere.

The greatest album ever done. This is the passage way to becoming a teenager. We didn't turn out bad did we folks????

So why are we burdening our kids with criminal records for the same things we did as teenagers. We all laughed at "The 70's Show" when the kids were in the basement smoking and socializing with our friends, listening to what others felt. I have never met a pot smoker who wasn't CARING!!!

Exactly. Pot should have been legalized by 1970 ... corporate interests and the politicians siding with them have brought America to its knees as we are witnessing.

Pot is just another case of a cheap fantastic aid for humans while the drug industry wants to extract billions instead.

How about a compromise .... lets limit it to 20 plants a year each.

Its High Time for some drastic yet VERY postive changes. Drug War? ... Beyond a Joke.

Abolish the IRS and the Federal Reserve and legalize Hemp. Make America #1 once again.

Forget it, ask them why they called the police and handle the situation...maybe
that's their car that just got stolen!
See that bag of pot on their bedside table?
No? Good, you're getting the idea, let's worry about that car that just got stolen instead.

There's your guidance.
And it didn't cost the state a penny, I gave it away for free!
