Obama Birth Certificate Lawsuits Flourish Everywhere

Yesterday, I made note of how one of these nutlog lawsuits alleging that President-Elect Barack Obama was not an American citizen had been appealed to the Supreme Court. Well, apparently, that's not the only lawsuit of this sort snaking its way through our court system. The Honolulu Advertiser has the news:

Similar legal actions have been filed here and in several other states, including New Jersey, Pennsylvania, Ohio, California, Georgia and Mississippi.

And maybe one of these suits will be coming to your state, very soon! Maybe we'll be treated to the sight of all these plantiffs piling into a clown car to seek writs of certiorari from John Roberts, so he can hear more about this magnificent criminal conspiracy between Barack Obama's parents, Hawaii state officials, the Weather Underground, and the Mauna Loa Macadamia Nut Company to one day plant Obama in the Oval Office.

A quick note to all the people who are bringing up the fact ( yes it is a fact ) that McCain was born in the Panama Canal Zone, and therefore is not a natural born citizen. The First Congress, on March 26, 1790, approved an act that declared, "The children of citizens of the United States that may be born beyond sea, or outside the limits of the United States, shall be considered as natural-born citizens of the United States."
John McCain meets this qualification, therefore, that argument is invalid

Senator McCain was born in 1936 in the Canal Zone to U.S. citizen parents. The Canal Zone was territory controlled by the United States, but it was not incorporated into the Union. As requested by Senator McCain's campaign, distinguished constitutional lawyers Laurence Tribe and Theodore Olson examined the law and issued a detailed opinion offering two reasons that Senator McCain was a natural born citizen. Neither is sound under current law. The Tribe-Olson Opinion suggests that the Canal Zone, then under exclusive U.S. jurisdiction, may have been covered by the Fourteenth Amendment's grant of citizenship to "all persons born . . . in the United States." However, in the Insular Cases, the Supreme Court held that "unincorporated territories" were not part of the United States for constitutional purposes. Accordingly, many decisions hold that persons born in unincorporated territories are not Fourteenth Amendment citizens. The Tribe-Olson Opinion also suggests that Senator McCain obtained citizenship by statute. However, the only statute in effect in 1936 did not cover the Canal Zone. Recognizing the gap, in 1937, Congress passed a citizenship law applicable only to the Canal Zone, granting Senator McCain citizenship, but eleven months too late for him to be a citizen at birth. Because Senator John McCain was not a citizen at birth, he is not a "natural born Citizen" and thus is not "eligible to the Office of President" under the Constitution.

I just have to say, cal5000, that your explanation of McCain's legal reasoning for citizenship is one of most succint and lucid postings I've ever had the privelage of reading of huffpo. It makes an excellent summarization of the legal points and questions. Too bad that most of the individuals who continue to attack Obama's citizenship (which to be true would have to involve a multinational, multiagency, multistate conspiracy to place a mixed race, fatherless infant in the White House 48 years later) will simply see it as "more liberal legal witchcraft that flies in the face of our founding fathers wishes". Namely, to keep blacks out of the White House. Sorry about that last sentece, but it was just too easy.

see the issue is that the citizenship of Mccain is truly the questionable one, he was not even born in the USA, the panama canal was not really part of the uas at the time, and it is so hilarious how the RNC machine spends money and time on such nonsense all to convince other they are right, when they are so blatantly wronggggg.
in the end, between the two, mccain's citizenship should be scrutinized more, i say this because , Obama was born on American Soil, and his mom was a US citizen, that is enough for me and most who have read the constiution,

You are indeed correct on this issue. In fact it has been a continuing source of irritation for the resident of the minor US territories. Guam or American Samoa for example are not "organic" territories of the United States and for a long time Guam's citizens did not obtain US citizenship by birth. That right was accorded them by an Act of Congress after the Second World War due to their patriotism during that conflict. The Northern Mariana Islands negotiated for citizenship rights in their compact. I do not know if American Samoa ever finally did so but when I lived there, a child born there was a US national and not a citizen. I can't recall how it works for Puerto Rico but I do recall as a child, it was a similar situation.

The right wing is really going off the deep end on this phony issue. Obamas birth certificate is posted on his website, authenticated by the state of Hawaii, and there is even a birth notice in the Aug 13 1961 Honolulu newspaper (which of course is phony and fraudulent so that Obama could become a citizen).

This wacko story has taken on a life of its own. I predict it will be with us for another 4 years, at least, no matter what evidence is brought to bear.

John McCain was born in Panama. Yes, Panama, or rather the Canal Zone, was controlled by the United States at the time, but neither that entity nor Panama itself was ever part of the United States. In fact, Panama was then as it is now even less "American" than lets say Puerto Rico or the Virgin Islands, yet I don't hear any of the hogwash being levelled at Barack Obama by these nutcases being lobbed in John McCain's direction. Like so many bloggers have said: "Get over it, you sad morons. Barack Obama is the President-Elect of the United States (and legally so) and there's nothing that you imbeciles can do about it.
