CHICAGO — The nation's grim economy now has a rallying point: Employees at a window-and-door factory that went out of business have taken over the building in a siege that has come to symbolize the woes of the ordinary worker.

The Republic Windows and Doors factory closed abruptly last week after Bank of America canceled the company's financing. Since then, about 200 of the 240 laid-off workers have taken turns occupying the factory, declaring that they will not leave until getting assurances they will receive severance and accrued vacation pay.

But the standoff has also come to embody mounting anger over the government's willingness to bail out deep-pocketed corporations but not average people.

"There's a simplicity and straightforwardness to this particular case that anybody can wrap their head around," said James Thindwa, executive director for the Chicago office of Jobs With Justice, a national coalition of unions, community groups and other organizations.

Apolinar Cabrera, a 17-year Republic employee, lost his job and benefits just as his wife is about to deliver their third child.

"I don't know what to do," said Cabrera, 44, who worked in Republic's shipping department. He has been shuttling between the plant and home so he can check on his wife.

The workers show up in groups of 50 or 60 to occupy the plant around the clock in eight-hour shifts.

The union assigns some employees to clean the factory and make sure it's safe. Others take in food donations brought to the door. Outside, they hung a huge American flag, and some huddle around a fire in a garbage can.

The protest _ along with vocal support from President-elect Barack Obama, Illinois Gov. Rod Blagojevich, civil rights activists and others _ has also created something else: a chance for unions that have been losing members and strength for years to show they still matter.

"I hope it's the beginning of a real fight-back movement," said Leah Fried, an organizer for the United Electrical Workers, which represents the Republic workers, who are mostly Hispanic.

Jobs With Justice organizers said it was time to seize the moment by reviving a tactic _ the sit-in _ that has not been widely used in the U.S. in decades.

The workers say the company violated the federal law because employees were not given 60 days' notice that they were losing their jobs.

The company did not return calls for comment but issued a timeline of its discussions with Bank of America through a public relations company.

Republic said it presented a plan for an "orderly wind down" to Bank of America in October, including its intention to end manufacturing in January 2009.

Republic said it requested permission Nov. 25 from Bank of America to issue vacation pay to its employees, but said the next day the bank "rejected" that request.

"The company wished to pay but was not allowed to make that payment according to the instructions of the bank," said Tom Figel of Lake Effect Communications.

In a prepared statement, Bank of America said it had "worked with the company and shared our concerns about the company's situation and its operations for the past several months." But the bank said it agreed that Republic should try to honor its obligation to employees.

Most of the anger over the plant closure has been directed at Bank of America, not the company, which has not sought to evict workers from the building.

A meeting to resolve the sit-in ended Monday night without success, but representatives from the company, Bank of America and the union agreed to reconvene Tuesday at the bank's downtown offices.

The law allows businesses to close without giving the required notice under certain circumstances, such as if another company that is the sole source of income suddenly goes out of business, said Mark Johnson, president of Erisa Benefits Consulting in Grapevine, Texas, who said he was not familiar with the Republic case.

Blagojevich on Monday ordered all state agencies to stop doing business with Bank of America to pressure the bank into using federal bailout money it received to help the laid-off workers.

"We hope that this kind of leverage and pressure will encourage Bank of America to do the right thing for this business," Blagojevich said outside the plant. "Take some of that federal tax money that they've received and invest it by providing the necessary credit to this company so these workers can keep their jobs."

Democratic Sen. Dick Durbin of Illinois said he wanted to ask his fellow senators to remind banks that the bailout wasn't to be used for dividends and executive salaries.

"They're for loans and credit to businesses just like Republic," he said.

On Monday, about a dozen protesters, including some former Republic workers, rallied outside a Bank of America branch on the city's West Side, handing out fliers, carrying signs and banging drums. Several tried to enter the bank to deliver their message but were turned away.

The support generated by the sit-in has surprised some workers.

"We never expected this," said factory employee Melvin Maclin, vice president of the union local that represents the workers. "We expected to go to jail."

Obama's failure to appoint a Secretary of Labor is becoming disastrous.

All efforts now are directed to saving the banks and corporations. These fixes are irrelevant if they don't result in protecting jobs, which is the only way to defeat depression.

There's plenty of pro-worker sentiment out there now, but it factors into the current debate only circumstantially. Everyone wants to cut CEO pay. No one wants to protect worker pay.

A real reversal of the economic collapse cannot begin until pro-worker policies dominate. The right Secretary of Labor could focus that effort. I wish Obama understood that.

Maybe you are unaware that President Elect Obama has not yet taken office and no matter who he appoints as secretary of labor, they will have no authority until January 20th. Perhaps you should wait until he is sworn in before expecting him to perform miracles, which he will not be able to do then. George Bush's policies caused this mess and he is currently the one twiddling his fingers while it continues to worsen!

The incoming President is finally calling a dog a dog. Bank of America is abusing its power and abusing the money given to it by the Taxpayers. It has deliberately sabotaged an American company by terminating a revolving credit facility at exactly the time when it needed to keep the facility open. in order for BoA to receive taxpayer money it also was required not to TANK the economy by yanking credit from operationally sound companies.

And for the owners of Republic to obtain a credit facility for a new company in Iowa, Echo LLC, is also a mystery. How could the owners have bad enough credit that they lost Republic's financing, but good enough credit that they could open Echo's factory in Iowa? Something stinks. And its the American workers in Chicago who are told to suffer for it.

It's the workers, who ACTUALLY PRODUCE something that we need to protect...­.not the mid-level executive in Charlotte, NC who sits and decides the bottom line is not worth more money. Republic was a solvent company. It violated federal law by laying off those workers without a 60-day notice or 60-day severance. Bank of America simply decided to pull all short-term financing to force it into layoffs.

However, the family that owns Republic had already secured a loan (with their really good credit at Republic) to buy a factory in Iowa. They transferred assets out of Republic into this new company (Echo LLC). That was also a likely violation of tax law and corporate contract law. It defrauded investors, creditors and employees of Republic from the funds that Republic legally owes them. The family that owned Republic now is making money with their operation in Iowa. Using stolen Republic assets.

Yet, you Republican Conservatives call that "Free Market" economics. The rest of America calls it highway robbery, thuggery, and thievery. Its reverse socialism -- take from the poor and middle class to give to the rich. Its also known as F@$ci$m. Where the powerful corporate interests take over the State (US Treasury) and use it for their private gain.

The truth is, Paulson is a F@$ci$t oligarch and companies like BoA and the family that owns Republic and Echo are unAmerican thugs.

The Bank got taxpayers' money in a bailout evidently to save JOBS, Instead they want to give $10-million bonuses to their head honchos. Obama is reminding them of their priorities: the workers, the jobs, the mortgages -- the only reason they got the bailout money to begin with.

as long as Paulson is in power, the banks won't lend money to businesses in blue states. Or businesses with unions.

The plot is becoming clearer now. By manipulating the financial system, Paulson/Bush can make sure to put blue-state companies into a financial vice, while funding the same owners who want to open a business in the red states without unions.

Its all about who controls the financing. And right now, with Paulson's blessing, banks rule. This is the most powerful lame duck administration America has ever seen.

TARP was meant to be used to reopen the credit market. Not for bank takeovers. But to be used to lend to businesses and consumers. Neither of which appears to be happening. Instead, banks are hoarding cash so they can be the first ones to buy all the bankrupt companies and distressed properties at firesale prices once a full-blown depression kicks in. And how best to accelerate that depression than to freeze credit on consumers with high FICO scores and freeze credit on operationally sound businesses.

Lay off the most people, eliminate the most consumer financing, kill the retail market, eliminate disposable income, and you will get your depression. but Banks have nothing to fear. They are getting taxpayer money direct from Uncle Paulson. And when the bottom drops, they'll be the ones holding all the cash.

the American Dream. By the banks, for the banks, of the banks.

Hopefully, the employees and their Union will sue Republic and igarnish it's assetts. The equipment that is in their plant has got to be worth something. This unfortunately will take time.
As for me, I'm closing my BofA accounts in protest, think I'll go to a credit union instead.

lending standards? Banks operate under a Charter, a privilege granted by the US government. They have to abide by certain standards. Yanking money from companies that are fiscally sound to force hundreds into layoff is neither smart nor economically sane. It is motivated by politics and discrimination against unionized companies.

Chicago Tribune: "People who apparently have ties to the financially strapped Republic Windows formed a limited liability corporation in Illinois last month, Echo Windows & Doors.... Sharon Gillman, who shares an address with Republic President and CEO Rich Gillman, is listed as an officer of Echo Windows & Doors LLC, which was incorporated in Illinois on Nov. 18, according to secretary of state records."

Dec. 4, 2008: Republic Windows announces closing.
By Mary Ellen Podmolik | Tribune reporter: "Republic Windows & Doors will shut its doors Friday, causing about 300 workers to lose their jobs.."

Dec. 4, 2008 (SAME DAY!!!): Echo Windows BUYS a division of window manufacturer TRACO and a factory in Iowa.
"TRACO has announced the sale of its residential vinyl replacement division to Echo Windows LLC. Echo Windows will assume all TRACO residential vinyl manufacturing and sales operations, and will continue manufacturing TRACO’s Sienna Series and Power Two composite vinyl/aluminum windows in the Red Oak, Iowa, facility, which was purchased as part of the agreement.

MY QUESTION: WHO financed the purchase of the TRACO division by Echo (formerly Republic)? Was it...BofA? In other words, was BofA part of the bamboozle that Republic is playing on it's workers? Either way, Republic should be ashamed and held liable. And BofA should cough up some dough.

Now, we reap the whirlwind.

Money leaves blue-state union-state. Money enters red-state non-union state. Paulson must be proud. Mission accomplished. 42 days left and counting. Paulson/Bush still have a little over a month to do MAXIMUM damage to the economies of union-states and cities that didn't play Bush-ball. Scorched earth.

This past Friday, my ad agency laid off 8 people - not a staggering number, but these 8 people compile over 1/3 of our entire staff! I was one of the lucky 15 who survived, and we were all told, that this layoff was only to keep us afloat until mid 2nd quarter 2009 and if business doesn't pick up, we'll have to close the doors for good!

After the layoff occurred in the morning on Friday, many of us went to the corner bar early in the afternoon.

TO MY SURPRISE, THERE WERE 4 DIFFERENT TABLES IN THIS BAR, EACH WITH DIFFERENT PEOPLE FROM DIFFERENT AREA COMPANIES WHO WERE ALL LAID OFF THAT DAY!!! My quick head count was 19 people from this small corner in the West Loop (not even the main business district in Chicago)!

While the world was awed at the 500,000+ figure of job loss from November, I think we'll be even more shocked once the December numbers come in early next year. Looks grim folks.

I only have one question..­..

WERE WE DUPED BY THE THEORY THAT THE MASSIVE BAILOUT WOULD HELP EVERYDAY AMERICANS IN THESE SITUATIONS?

Let's see if I understand this right....l­arge financial institutions in trouble receive generous bailout check...bu­t apparently severely limit credit to the average small businesses because they are perceived as a credit risk because of the US economic situation.­..so the large financial institutions are hoarding the money that taxpayers (average citizens) gave them...oka­y....

So that is the strategy of these large financial institutions? Hoard the money given to them? What a brilliant "game plan"... Does the end result of this stupidity assist the average tax payer or even the financial institutions in the long run?

Fantastic!!!
These banks had no problem taking our deposits and lending them out at 40 times leverage, leaving us with a massive crisis, mega-debt, and them with fat payouts. I hope Pres O, that this is a sign of things to come.
Hit these bastards hard, and regulate them to hell and back!!!!!!­!!!!!!!!!!­!!
