CHICAGO — The nation's grim economy now has a rallying point: Employees at a window-and-door factory that went out of business have taken over the building in a siege that has come to symbolize the woes of the ordinary worker.

The Republic Windows and Doors factory closed abruptly last week after Bank of America canceled the company's financing. Since then, about 200 of the 240 laid-off workers have taken turns occupying the factory, declaring that they will not leave until getting assurances they will receive severance and accrued vacation pay.

But the standoff has also come to embody mounting anger over the government's willingness to bail out deep-pocketed corporations but not average people.

"There's a simplicity and straightforwardness to this particular case that anybody can wrap their head around," said James Thindwa, executive director for the Chicago office of Jobs With Justice, a national coalition of unions, community groups and other organizations.

Apolinar Cabrera, a 17-year Republic employee, lost his job and benefits just as his wife is about to deliver their third child.

"I don't know what to do," said Cabrera, 44, who worked in Republic's shipping department. He has been shuttling between the plant and home so he can check on his wife.

The workers show up in groups of 50 or 60 to occupy the plant around the clock in eight-hour shifts.

The union assigns some employees to clean the factory and make sure it's safe. Others take in food donations brought to the door. Outside, they hung a huge American flag, and some huddle around a fire in a garbage can.

The protest _ along with vocal support from President-elect Barack Obama, Illinois Gov. Rod Blagojevich, civil rights activists and others _ has also created something else: a chance for unions that have been losing members and strength for years to show they still matter.

"I hope it's the beginning of a real fight-back movement," said Leah Fried, an organizer for the United Electrical Workers, which represents the Republic workers, who are mostly Hispanic.

Jobs With Justice organizers said it was time to seize the moment by reviving a tactic _ the sit-in _ that has not been widely used in the U.S. in decades.

The workers say the company violated the federal law because employees were not given 60 days' notice that they were losing their jobs.

The company did not return calls for comment but issued a timeline of its discussions with Bank of America through a public relations company.

Republic said it presented a plan for an "orderly wind down" to Bank of America in October, including its intention to end manufacturing in January 2009.

Republic said it requested permission Nov. 25 from Bank of America to issue vacation pay to its employees, but said the next day the bank "rejected" that request.

"The company wished to pay but was not allowed to make that payment according to the instructions of the bank," said Tom Figel of Lake Effect Communications.

In a prepared statement, Bank of America said it had "worked with the company and shared our concerns about the company's situation and its operations for the past several months." But the bank said it agreed that Republic should try to honor its obligation to employees.

Most of the anger over the plant closure has been directed at Bank of America, not the company, which has not sought to evict workers from the building.

A meeting to resolve the sit-in ended Monday night without success, but representatives from the company, Bank of America and the union agreed to reconvene Tuesday at the bank's downtown offices.

The law allows businesses to close without giving the required notice under certain circumstances, such as if another company that is the sole source of income suddenly goes out of business, said Mark Johnson, president of Erisa Benefits Consulting in Grapevine, Texas, who said he was not familiar with the Republic case.

Blagojevich on Monday ordered all state agencies to stop doing business with Bank of America to pressure the bank into using federal bailout money it received to help the laid-off workers.

"We hope that this kind of leverage and pressure will encourage Bank of America to do the right thing for this business," Blagojevich said outside the plant. "Take some of that federal tax money that they've received and invest it by providing the necessary credit to this company so these workers can keep their jobs."

Democratic Sen. Dick Durbin of Illinois said he wanted to ask his fellow senators to remind banks that the bailout wasn't to be used for dividends and executive salaries.

"They're for loans and credit to businesses just like Republic," he said.

On Monday, about a dozen protesters, including some former Republic workers, rallied outside a Bank of America branch on the city's West Side, handing out fliers, carrying signs and banging drums. Several tried to enter the bank to deliver their message but were turned away.

The support generated by the sit-in has surprised some workers.

"We never expected this," said factory employee Melvin Maclin, vice president of the union local that represents the workers. "We expected to go to jail."

As a former employee of BofA, my accounts are subject to closure based on their response. Don't look at the bottomline, look at human suffering and do the right thing. It is time for all American to raise our voices that Greed will no longer control the US, we the people will.

I didn't close mine but my friend and I went to my branch here in Raleigh today and requested a large check. Fortunately I bank with Wachovia and my credit union so I could talk tough to BOA. I don't have a problem with them personally but I made it clear I was transferring my funds to Wachovia and told them why. Remember what snowflakes can do when they stick together.

BofA is notorious for this type of behavior. They like Citi get cheap taxpayer money from the fed and mark the interest rate up 500%. They do not try to work things out in distressed businesses or poor/middle class neighborhoods on mortgages. They want to take businesses and property. They have a slew of companies/friends lined up to purchase distress properties and businesses. They get a huge tax write off and they use the taxpayer money to finance the property with their "preferred" clients.

They are the exploiter of the small business and middle class just like Wal-Mart..­Oh by the way they are one of the largest outsourcers in the financial industry. IT, customer service centers, and brokerage management are now offshore. They have used the "bailout" money to expand their bank and business acquisition programs.

Contrary to their commercials they are the Robin Hood that steals form the poor/middle to give to the rich .... a little bit at a time .... and has been getting away with it.

Think about that and have a nice day.

It is certainly true that banks force people and companies into foreclosure of valuable assets that they then have their 'friends' purchase at knockdown prices. If people really understood what is going on they would be marching with torches and pitchforks.

Please support the workers in any way can. THEY are not at fault. Here's some ways how (all the links are at my site noted below, I didn't want to gum up the Comment with too many links):

1. Contribute to the UE (United Electrical) workers Local 1110 Solidarity Fund. The families have to eat, pay rent and utilities.

2. Send an email message of support to the workers over the web.

3. Send an email to Bank of America, demanding that they do the right thing.

4. Or, do as Fred Klonsky did, and get out there and bring the workers some coffee!

But here's the deal: while they were planning to shut down the Illinois plant and lay off the workers due to the "lack of credit" from B of A, some principals of Republic Window were starting ANOTHER company, Echo Windows LLC, and have already purchased another company and its factory in Iowa! Yes, yes yes!!!! Think, those of you with good history backgrounds, this is not unlike the Little Steel Republic Issue of the 1930s. Today we have politicians who are finally - FINALLY - empowered to pin the responsibility where it always lay: corporate greed. Get the 1990s PBS multi-part documentary on the Great Depression and listen to the hate against working people - you see it reflected today. These men and women are making a simple declaration - human beings are not disposable and are NOT 'cash cows' for B of A. Hooray for the state of Illinois for defending its own in a really powerful way!

The poster that indicated BOA is the real predator is correct. By cutting off the credit line they have put the company in a position where it is violating the federal law. The company looks like the heavy when in fact BOA is pulling the strings. BOA is willing to violate their own lending covenants in todays atmosphere because they believe they can scurry away in the haze of all the forced defaults leaving the Window comapny to take thge blame. It's BOA that needs it's complete Board of Directors replaced with the current board jailed for fraud in the inducement.

Federal Law (not a union contract) requires that employers give employees 60 days notice of a mass layoff.
Republic Windows and Doors gave 260 employees less that 5 days notice of a mass layoff.
It appears that Republic Windows and Doors will have broken federal law if it does pay it's employees to the full term of the mass layoff notification.

The 260 workers are owed for vacation time earned, and not used, while they were employees of Republic Windows and Doors. In addition any additional benefits earned by the employees needs to be payed.

I don't see where anyone can look at this as a handout. It is about a Company obeying the law of the land, and paying people what they owe them for work done.

Bank of America, in canceling the company's line of credit , enabled the company to walk away from it's obligations to it's employees.

There should be a question about complicity between Bank of America, and the management of Republic Windows and Doors in the timing of the cancellation of the line of credit.

Did management of Republic Windows and Doors have to notify Bank of America that they were relocating a good deal of heavy manufacturing equipment over the Thanksgiving weekend? Wouldn't the ability to manufacture from that plant dictate it's credit worthiness?
