CHICAGO — The nation's grim economy now has a rallying point: Employees at a window-and-door factory that went out of business have taken over the building in a siege that has come to symbolize the woes of the ordinary worker.

The Republic Windows and Doors factory closed abruptly last week after Bank of America canceled the company's financing. Since then, about 200 of the 240 laid-off workers have taken turns occupying the factory, declaring that they will not leave until getting assurances they will receive severance and accrued vacation pay.

But the standoff has also come to embody mounting anger over the government's willingness to bail out deep-pocketed corporations but not average people.

"There's a simplicity and straightforwardness to this particular case that anybody can wrap their head around," said James Thindwa, executive director for the Chicago office of Jobs With Justice, a national coalition of unions, community groups and other organizations.

Apolinar Cabrera, a 17-year Republic employee, lost his job and benefits just as his wife is about to deliver their third child.

"I don't know what to do," said Cabrera, 44, who worked in Republic's shipping department. He has been shuttling between the plant and home so he can check on his wife.

The workers show up in groups of 50 or 60 to occupy the plant around the clock in eight-hour shifts.

The union assigns some employees to clean the factory and make sure it's safe. Others take in food donations brought to the door. Outside, they hung a huge American flag, and some huddle around a fire in a garbage can.

The protest _ along with vocal support from President-elect Barack Obama, Illinois Gov. Rod Blagojevich, civil rights activists and others _ has also created something else: a chance for unions that have been losing members and strength for years to show they still matter.

"I hope it's the beginning of a real fight-back movement," said Leah Fried, an organizer for the United Electrical Workers, which represents the Republic workers, who are mostly Hispanic.

Jobs With Justice organizers said it was time to seize the moment by reviving a tactic _ the sit-in _ that has not been widely used in the U.S. in decades.

The workers say the company violated the federal law because employees were not given 60 days' notice that they were losing their jobs.

The company did not return calls for comment but issued a timeline of its discussions with Bank of America through a public relations company.

Republic said it presented a plan for an "orderly wind down" to Bank of America in October, including its intention to end manufacturing in January 2009.

Republic said it requested permission Nov. 25 from Bank of America to issue vacation pay to its employees, but said the next day the bank "rejected" that request.

"The company wished to pay but was not allowed to make that payment according to the instructions of the bank," said Tom Figel of Lake Effect Communications.

In a prepared statement, Bank of America said it had "worked with the company and shared our concerns about the company's situation and its operations for the past several months." But the bank said it agreed that Republic should try to honor its obligation to employees.

Most of the anger over the plant closure has been directed at Bank of America, not the company, which has not sought to evict workers from the building.

A meeting to resolve the sit-in ended Monday night without success, but representatives from the company, Bank of America and the union agreed to reconvene Tuesday at the bank's downtown offices.

The law allows businesses to close without giving the required notice under certain circumstances, such as if another company that is the sole source of income suddenly goes out of business, said Mark Johnson, president of Erisa Benefits Consulting in Grapevine, Texas, who said he was not familiar with the Republic case.

Blagojevich on Monday ordered all state agencies to stop doing business with Bank of America to pressure the bank into using federal bailout money it received to help the laid-off workers.

"We hope that this kind of leverage and pressure will encourage Bank of America to do the right thing for this business," Blagojevich said outside the plant. "Take some of that federal tax money that they've received and invest it by providing the necessary credit to this company so these workers can keep their jobs."

Democratic Sen. Dick Durbin of Illinois said he wanted to ask his fellow senators to remind banks that the bailout wasn't to be used for dividends and executive salaries.

"They're for loans and credit to businesses just like Republic," he said.

On Monday, about a dozen protesters, including some former Republic workers, rallied outside a Bank of America branch on the city's West Side, handing out fliers, carrying signs and banging drums. Several tried to enter the bank to deliver their message but were turned away.

The support generated by the sit-in has surprised some workers.

"We never expected this," said factory employee Melvin Maclin, vice president of the union local that represents the workers. "We expected to go to jail."

These idiots on the right have been trying to bust up the unions for almost a half century. They were willing to reck the economy by sending jobs oversees, to Canada and Mexico. These very same people could not figure out something so basic. If people do not have good paying jobs they can't buy your product. That is there is no demand.

Yeah, lets blame Canada where unions are still powerful. I love how you people always like to blame others instead of looking within. Canada also lost jobs in the 90s and mid-2000s. My mother was one of the casualties(she worked in the textile industry). Yet, just recently, when I went back home in 2006, the manufacturing industry was making a come back. It was due to government incentives. So, don't blame us, blame your government for not doing anything and hoping that businesses will help bring back the manufacturing industry to its height

America also loses the tax money that well paid workers pay to the federal government. The problem isn't wages or unions, its that Free Trade has cost our economy a large portion of the manufacturing base, and we continue to ship technical jobs overseas as well.

Funny thing how big corporations will justify outrageous salaries and bonuses for it's management teams by claiming those people are the company's "strongest assets", yet will take no responsibility for the workers that actually produce something - 'white collars' get buyouts & severance packages- 'blue collars' get brushed out with the garbage...­. time for a revolution.

And its a skewed since of value. The CEO's and super-wealthy of this country actually believe that they are better and more valuable than average Americans. The people can win if they stick together and don't submit to hopelessness. The super-wealthy ruling class of America have no conscience, no sense of American patriotism, only an idea that they are better and must use all of their influence to take as much as they can from the working class people of the nation.

Yeah, they could get a phenomenal CEO for as much as a line worker. But instead they give millions to already rich people that don't care about the people, and those same wealthy CEO's always ask what the little guy is willing to give up so that they can keep millions in salary and bonuses.

While one can not get blood from a stone or money from a bankrupt company that has none, the payments owed to these non-management employees should be given equal consideration to that of any other unsecured creditors of the company in any liquidation of the company's assets. Even better would be to make these employees the new equity owners and attempt a restart of the business thus aligning their interests with those of the creditors. Of course, this new cooperative ownership group would need to agree upon a cost structure that would allow the company to return to profitability. These workers would therefore be trading previous employment contract terms and protections for the upside potential of their ownership of the company.

In your anti-union viewpoint, you are blinded to the issue. Of course, companies have the right to close -- these workers aren't protesting Republic's right to close. They are protesting that a 60 day notice was not given per the WARN Act http://www.dol.gov/compliance/laws/comp-warn.htmm passed by Congress in 1988 and signed by President Reagan. The WARN Act protects ALL workers (if a closing plant has at least 100 employees) so they can adjust for the plant closure. If the plant closes in less than 60 days, the workers must get 60 days pay. Also, US labor law provides for all vacation earned but not paid to be paid immediately when employment is terminated. Because these are union employees, they are organized and knowledgable to protect their rights as Americans. The Bank of America issue further adds insult to injury to us as American taxpayers and workers!

I agree wholeheartedly with the first half of your statement.

As cooperative ownership to return the company to profitability though, would not seem to work in this case. Its not about the contract terms or protections, its about electricity, raw materials, etc. If a bank isn't willing to finance the company to keep the lights on, let alone pay payroll, the employees have no way to fund operations let alone claim a stake.

Right, the money was supposed to be to buy bad assets (mortgages) and then the government could renegotiate the terms of those mortgages.

Instead Paulson got the money and gave the banks cash in the form of stock which the banks could use for any purpose they desired, with no strings applied to the banks. Those banks actually used a portion of the money to buy other banks. It was all a ripoff orchestrated by Bush and Paulson. They intentionally let things get out of control so that they could create a "crisis" situation in order to liquidate the Treasury and give the money to their super-wealthy friends.

Yah, right. I live in NC, a 'right to work" state, where you can be fired for NO reason. This is especially handy at Christmastime, so companies can avoid bonuses etc. We call it a "right to starve" state and are fighting the status quo. The worker has to have SOME voice!

Didn't Bank of America get a bailout? (it's hard to tell, so many have got bailouts) but then they go and lay off workers without their severance pay, just wrong. I salute these people. They're not asking for any more, just asking for what they were promised, and before Christmas.

I'd like to see the bank CEOs in front of Congress detailing the hourly wages of THEIR workers! These guys have hit on the right topic - where is the credit the banks promised if they got their billions? Oh - it is next to the plan they provided?

Let's get real, boys. White collar never has to explain or justify, they just need to scare the bejesus out of everyone, blue and pink collar - have to have plans and explanations and take a cut in pay. Sorry. that isn't going to fly any more -- Rue Jan 20, explanations will be due.

Employers don't take on no more risks than thier employees. There is a company right now in Detroit, a teir one supplier, who just asked there employees to work for one full week straight or broken up without pay. If you do not cooperate then there's the door. You got love it.

Obama will put the greedy slug employers in their place! He will make sure ALL workers get everything we have deserved!. High wages, complete healthcare for our families, vacations sick time and educational benefits and much much more. Plus, he will back us up when we strike to get these things and will probably have to the arrest employers who refuse to comply. Our time has come!

Arresting employers who don't give you complete healthcare and high wages? Got news for you, if an employer can't turn a profit, he'll shut the doors and there just won't be any work period. If the choices are to lose money, go to jail or not be an employer or investor, most people will choose not to employ or invest in a business.

I was, and still am, a strong supporter of Obama. He had a moral obligation to speak up for these Union workers, because he won the election by doing something that was long overdue... He awakened the "sleeping giant" - the American people. The situation at this plant is a classic example of what's wrong with our country, the economy... and now, the bailouts. A company get's itself into financial trouble, doesn't take logical, ethical and fiscally responsible action, lies to it's employees & possibly it's shareholders, begs for a bailout, the government grants it and now the company violates Federal law by not giving 60 days notice of termination to it's employees. These union workers in Chicago are my new heroes, they are the "sleeping giant" and are sleeping no more. Who does this country belong to anyway? YOU, the American People. There are companies like this all over what was once "our great nation". We will be silent no more. The bailouts should work for the working class of America, because they suited up & showed up for work, were lied to, lost bonuses, took cuts in pay, had retirement funds stolen & STILL worked hard. OBAMA... if our government MUST give billions of dollars to companies who are sick with GREED, lack common ETHICAL standards, refuse to excercise fiscal responsibility & VIOLATE FEDERAL LAW!, then at least force them to honor their commitments to the employees FIRST!

There were many popular responses to the crisis, from neighbourhood assemblies and barter clubs to resurgent left-wing parties and mass movements of the unemployed, but we spent most of our year in Argentina with workers in "recovered companies". Almost entirely under the media radar, workers in Argentina have been responding to rampant unemployment and capital flight by taking over businesses that have gone bankrupt and reopening them under democratic worker management. It is an old idea reclaimed and retrofitted for a brutal new time. The principles are so simple, so elementally fair, that they seem more self-evident than radical when articulated by one of the workers: "We formed the co-operative with the criteria of equal wages and making basic decisions by assembly; we are against the separation of manual and intellectual work; we want a rotation of positions and, above all, the ability to recall our elected leaders."
