SEOUL, South Korea — One of South Korea's most famous actresses was convicted of adultery Wednesday in a high-profile case that drew renewed attention to a decades-old law prohibiting extramarital affairs.

Ok So-ri, who was handed a suspended jail term, had lost a battle in October to have the ban declared unconstitutional.

"I would like to say I'm sorry for causing so much trouble to society," a somber Ok told reporters after the verdict.

A district court in Goyang, near Seoul, handed Ok a suspended eight-month jail sentence, South Korean media reported, meaning she will not have to serve time. Ok's lover received a six-month suspended term.

There was no immediate word on any plans for appeal.

The sensational sex-and-celebrities case has been tabloid fodder for months, with Ok's challenge to the adultery law adding extra spice.

Last year, Ok acknowledged during a news conference that she had had an affair with an opera singer who was a friend of her husband for a few months in 2006. She stressed the affair was a result of her loveless marriage to actor Park Chul.

The court appeared to show some sympathy for Ok's predicament.

"Though the fact of adultery should be criticized, (the court) issued this ruling taking into account that husband Park Chul's responsibility was not small," the court said, according to cable news channel YTN.

She also "suffered mental pains" due to the exposure of her privacy, the court said.

Ok earlier this year filed a petition to have the adultery ban ruled an unconstitutional invasion of privacy. But in October, the Constitutional Court upheld the ban, part of South Korea's 55-year-old criminal code.

Despite decades of Western influence, South Korea remains deeply conservative and is influenced by a Confucian heritage. Those convicted under the anti-adultery law face prison sentences of up to two years, though few serve time.

Supporters of the adultery ban say it promotes monogamy and keeps families intact. Opponents argue the law violates privacy. Complaints have been filed with the Constitutional Court three times in 1990, 1993 and 2001 to abolish the law, but the court has upheld it every time.

While women's rights group were the ban's biggest supporters in the past when the law was meant to keep philandering husbands in line, in recent years some husbands have begun pressing adultery charges on their unfaithful wives.

The number of adultery cases filed in South Korea has dropped in recent years, declining to 8,070 in 2006 from 12,760 in 2000, according to the Supreme Prosecutors' Office. About 80 percent of those cases were dropped before formal charges were filed, largely because complaints were withdrawn.

Many Muslim nations have anti-adultery laws, some with harsh penalties. Taiwan, Austria, Switzerland and some U.S. states also have laws prohibiting extramarital affairs, according to the Korea Legal Aid Center for Family Relations, a government-funded legal counseling office.

Same for Switzerland. They abolished that in 1989. I'm also wondering if such a low wouldn't be unconstitutional in the U.S.

There has never been a law about adultery in the US, that I know of, everyone in the US commits adultery lol, please, half the senators and congresspeople in the US would be in prison if adultery was illegal, LMAO. Our own president cheated on his wife...the US if pretty open when it comes to divorces lol, we have a 50% Divorce rate in the US.

This is nuts. I was stationed in the ROK (U.S.Army 1978-79) and I thought the country was nice. Archaic, but nice and I enjoyed my tour. But I was raised in a state (North Carolina) that still has "Alienation of Affection" laws on the books. While I AM NOT a fan of Adultery, it is not a crime that my tax dollars should pay for. And for all you "Law-and-Order" types, Jaywalking and Loitering are crimes, too. You wanna start locking up folks for that?

Most jurisdictions use loitering statutes to get troublesome people off of the street who, in all likelihood, are on the verge of committing a real crime. Jaywalking is dangerous and should be illegal.

Good point. This law is hardly ever enforced these days, and is only ever used as a tool of revenge. The fact that her husband fully went through with the prosecution says much about how much he wants to get even with her, as opposed to whether this really serves justice.

For those who do not get it...
First we need to start by defining what is a crime...
If you do not put your seat belt on, you get fined,
If you betray your country you can have capital punishment.
It is absolutely mind buggling to me that one can go to
court for breaching a contract, yet one does not have
to suffer any punishment for breaching the contract of
marriage; Unfortunately there are many who lack the insight
to see the analogy. Lots of people do not put any value or physical
counterpart to such things as courage, loyalty, etc...
though they are real...since we feel them...
Yes, Korea has defined adultery to be a crime, cause it is
a crime for those who are blind... Hence it needs to be legislated.
you cannot go out there " bunking " left and right even if you are a single
Pursuit of happiness and freedom come with responsibility.ife is not all

In most western countries, a breach of contract is a civil offense, not a crime. You are not at risk of imprisonment for civil offenses. The penalties are usually fines.

I agree that the marriage contract isn't given the honor and solemnity it deserves. But, if more countries begin prosecuting people for committing adultery you know who those "people" will be-----women. Do you really want to see more women buried in the ground with their heads exposed so a bunch of feral men can throw rocks at it until it's crushed? That's what happened to a 13 year old girl in Somalia recently. She had been raped by THREE men but the "court" decided she had committed adultery and her sentence was beyond horrific. Never again!

This is a good point. In a perfect world, we'd all be held accountable to word given, word broken. At first glance, I thought, good for the South Koreans for caring about vows exchanged...but just that the focus of the scandal was a woman's infidelity, and not that a man involved himself with a married woman, does indeed speak volumes, her celebrity status aside.
