SACRAMENTO, Calif. — Gov. Arnold Schwarzenegger on Friday ordered a state hiring freeze and payroll cuts to conserve cash as California struggles to deal with a $42 billion budget deficit.

The governor issued an executive order that requires state agencies to reduce payroll by 10 percent, which could lead to massive layoffs. He also ordered the state's 235,000 employees to take two days off a month without pay, starting Feb. 1.

Schwarzenegger also issued an executive order calling lawmakers back into session to deal with the budget for the third time in two months. On Thursday he announced he would veto an $18 billion Democratic deficit-cutting package that he said didn't do enough to address the financial crisis.

In a letter to state workers, Schwarzenegger said California must take emergency steps that will require sacrifices from everyone.

"It is imperative that state government look inside itself and be part of the solution," the governor wrote. "We simply have no other choice."

Labor officials said they were considering filing a lawsuit to prevent job losses.

"We definitely think we have grounds for filing an unfair labor charge," said Jim Herron Zamora, a spokesman for the Service Employees International Union, Local 1000, the largest state employee union. "Our contract doesn't allow him to do this."

Officials warn that the state will run out of cash in February unless Schwarzenegger and lawmakers can reach a deal to close the budget gap with spending cuts, revenue increases or a combination of both.

Schwarzenegger ordered all state employees to take two days off a month without pay or take a similar salary cut to achieve $1.3 billion in savings through the next fiscal year.

On top of that, the governor directed agencies that get their money from the state's largest budget account, the general fund, to achieve a 10 percent payroll savings. Officials said that could lead to an undetermined number of layoffs.

Department of Personnel Administration spokeswoman Lynelle Jolley said any workers who lose their jobs as a result of the order could seek employment at other state departments that use special state funds.

"We're hoping we can do this with the least number of layoffs possible but the goal is to address this imminent cash crisis," Jolley said.

Lawmakers adjourned for the holidays Thursday after Democrats pushed through a package of spending cuts and tax increases using a creative maneuver to bypass Republican opposition.

Schwarzenegger's decision to veto the package left Democratic leaders scrambling to save their plan. They argued that it met some of his demands for speeding up public works projects and selling surplus state property.

Assembly Speaker Karen Bass, D-Los Angeles, said it was "mind-boggling" that the governor would throw away a package that begins tackling the state's fiscal problems because it didn't contain exactly what he wanted.

"It's like a child telling Santa if you don't bring every single item on the list, then stay out of my chimney," Bass said. "I am hoping that the governor over these next few days will really reconsider saying he will veto the budget."

Bass and Senate President Pro Tem Darrell Steinberg, D-Sacramento, said they would remain at the Capitol to negotiate with the governor or his staff, but would not call the other 118 lawmakers back until a deal could be reached.

Under the governor's special session declaration, lawmakers have 45 days to send the governor bills that address the budget crisis. If they fail to do so, the Legislature may not act on other bills.

The governor had sought what he said was assistance for homeowners facing foreclosure, broad authority to relax environmental regulation on public works projects and more toll roads. Democrats allowed only partial waivers for a limited number of road projects and for certain state properties up for sale.

Additionally, Schwarzenegger requested deeper cuts than Democrats were willing to offer, such as reductions in welfare and senior assistance programs, greater flexibility to reduce school spending, and the elimination of two of 14 state employee holidays.

Environmental advocates also questioned why the governor would toss aside the only deficit-cutting legislation to reach his desk since he declared a fiscal emergency on Nov. 5. Paul Mason, deputy director of the Sierra Club in California, suggested that by demanding environmental exemptions, the governor was betraying his public image as a crusader against global warming.

How about the 700% growth of the penal system this decade in Ca....the 10.3 billion dollar cost for the prisons this year alone or the court ordered 8 billion dollar cost for 7 new medical centers to be built to provide medical care for prisoners !!! Because of the outlying locations of prisons Ca needs to build hospitals for the rapist and drug dealing gang members ! 8 billion dollars !... while child care and help for the elderly get cut. The lobbyist for the ' for profit ' private owned prisons must be laughing their asses off. Then what do you think these medical facilities would bill for this medical care per prisoner ? Its frightening.
Outsource these prisoners to a Mexican prison. Lets throw some business to our neighbor and pay them X amount a year to house and feed these prisoners to save millions or billions.

My friends let's not take this blowhard too seriously though...we have all heard his nonsense before in this state. He basically uses bluster instead of diplomacy, sure his words worry most of us, but his actions rarely have any effect on anything, much like his governership of CA.

Arnold has been a complete FAILURE as governor. The only reason he was even elected was because Grey Davis, along with the democratic­ally-contr­olled legislature, had dug us in a 15 billion dollar hole. Now, five years later, with 45 billion dollars more in revenue taken in, they've increased the budget 40 percent, and the deficit is even bigger. I would love to ask the Governor and the legislatures these questions: "Sir, at WHAT POINT to we finally start to tell the illegals that that's it.......party is over. 50 billion dollar deficit? Hundred?" At WHAT POINT do we actually CUT spending...... not cut the increase, but actually CUT it. As in, less than it was the previous year. Like education, which has seen a huge decline in student enrollment, even as it begs for more money to produce massive dropout rates? (more 20,000 fewer students this year from just last year alone- here's the link-

I am a state worker employed by a state consumer protection agency. The governor acts as if state government provides frivolous and unnecessary services. This mis-charac­terization is fueled by a bunch of haters critical of state worker benefits. We help consumers every day recover thousands of dollars from companies that rip them off through fraudulent practices. Cutting our services by cutting personnel will seriously hamper our ability to PROTECT the public.

The way people talk, you would think that we get $100 an hour and 100% retirement. NO WAY. NOT TRUE. We are just like everyone else, struggling. In fact, state workers earn LESS than their counterparts in the private sector. A 10% pay cut and worrying about being layed off is going to cause SERIOUS financial damage to me and my family.

One more thing...balancing the budget during a bad economic time is a bad idea. Hoover and Melon tried the same thing in the 1930's and it sank our country deeper in to the depression. Raising taxes is preferable to job loss right now, anything is better than job loss right now. If this kind of thought continues this reccession will truly be a deppression.

IMO, he's an idi0t just like the other re-thugs. So he cuts back gov workers which means they will have less money to spend - which means they will pay less taxes - which means they will apply for and receive unemployment compensation - which they will really have less money to spend - which means small businesses will not be able to sell their products and services.

Way to go gov.

I work for the schools in CA and think Ahnold is ticked that my union The CSEA beat him in his "special" election, and sued him and won money for the school. Cutting jobs is ludicrous, California needs all the jobs it can get.

You can't blame California problems on republicans they don't run the state. We kicked the GOP out of Washington because they made a mess of things. Shouldn't we kick the democrats out of the California because they screwed our state royally? We already have about the highest state income tax in the nation. Our next door neighbor has zero state income tax. Try competing with that. If they would have just capped spending based on revenues ans saved during good times we would be okay now.

Arnold and His wife are multi-millionaires, and while I can't believe they need the gov. salary to make ends meet, he ORDERS middle-class workers to take a pay-cut? All while turning down a sound proposal from the legislators and unions designed to save these people and help the state.

NOOOOOOO, he needs to look good balancing the state budget for re-election time. I guess we get what we deserve in America, when we vote for these people.

I thank God, my state finally woke-up and started getting rid of these America-Haters.

I never said that we should destoy our planet. There is a happy medium. I am all for being a good steward of the earth, but when enviromentalists strangle the law-makers, it is pretty hard to feel good about what they are trying to do.

Mother Earth is good at taking care of herself. We as Americans all have a responsibliity to be good stewards, however, we can no longer allow a few to dictate to the masses.

California is the 4th highest taxed State in the Union while some of it's teachers got almost 100 % their salary as retirement benefits several years ago. Something is wrong here, very wrong ! Schwarzennegar is right this time otherwise, no one will come to California to do business.
It is the equivalent of the auto industry.
