SAN FRANCISCO — The sponsors of Proposition 8 asked the California Supreme Court on Friday to nullify the marriages of the estimated 18,000 same-sex couples who exchanged vows before voters approved the ballot initiative that outlawed gay unions.

The Yes on 8 campaign filed a brief arguing that because the new law holds that only marriages between a man and a woman are recognized or valid in California, the state can no longer recognize the existing same-sex unions. The document reveals for the first time that opponents of same-sex marriage will fight in court to undo those unions that already exist.

"Proposition 8's brevity is matched by its clarity. There are no conditional clauses, exceptions, exemptions or exclusions," reads the brief co-written by Kenneth Starr, dean of Pepperdine University's law school and the former independent counsel who investigated President Bill Clinton.

The campaign submitted the document in response to three lawsuits seeking to invalidate Proposition 8, the constitutional amendment adopted last month that overruled the court's decision in May that had legalized gay marriage in the nation's most populous state.

Both Attorney General Jerry Brown, whose office is scheduled to submit its own brief to the court Friday, and gay rights groups maintain that the gay marriage ban may not be applied retroactively.

The Supreme Court could hear arguments in the litigation as soon as March. The measure's backers announced Friday that Starr, a former federal judge and U.S. solicitor general, had signed on as their lead counsel and would argue the cases.

Proposition 8's supporters assert that the Supreme Court lacks the authority or historical precedent to throw out the amendment.

"For this court to rule otherwise would be to tear asunder a lavish body of jurisprudence," the court papers state. "That body of decisional law commands judges _ as servants of the people _ to bow to the will of those whom they serve _ even if the substantive result of what people have wrought in constitution-amending is deemed unenlightened."

The cases are Strauss v. Horton, S168047; City and County of San Francisco v. Horton, S168078; and Tyler v. State of California, S168066.

I assume that there is something in the California State Constitution about not passing any 'ex post facto' laws?

IF there is,... shouldn't this nullification idea be dead in the water before it gets started?

Can't make something illegal after the fact if it was legal at the time,... you know,... that old legal issue.

You can't use 'tax Free" funds to pay for Lawyers for lobbying purposes.

I can't stand people that use their religion to spread their hate and bigotry. It's just sad. Instead of spreading hate, why not do something to be proud of? Let's see, like feed the hungry, house the homeless and stay out of other people's business and STAY OUT of our government!!!

I am incredibly sad over the dialogue because when solutions are presented they are shot down, it seems as if no one is really listening. I have read the bible invoked on all sides correctly and incorrectly. The sad part about all of this is that it is a powder keg about to explode.

Everyone is dug into their position and the concillitory advice is being brush aside.
I said what I had to say and will not comment further.

Ultimately God will settle the issue. I just wish with all of my heart we can come together
and agree to disagree without taking prisioners.

Before you go, I'd just like to say that the Bible and God really have nothing to do with any state granting everyone, equally, the right to marry the one they love (be it a man or a woman).

The only solution is that marriage will be allowed for everyone regardless of s.e.x.ual orientation.

If you're not gay, then it's difficult to imagine the heartache imposed by a society such as ours. The gay person is damned if he/she does and damned if he/she doesn't. The same religious crowd who'll skewer you for your "promiscuous lifestyle" will then try to keep you from being emotionally, physically and legally committed to one person. My only hope is that the religious right will take this so far that they start movements to make other biblical "sins" illegal. Those "sins" would include not isolating a menstruating woman, not stoning adulterers to death, not marrying you brother's widow (even if you're already married), not following the rules with regard to the treatment of your slaves, etc. Let the religious crazies start enacting propositions against heterosexual behaviors and we'll see some real fireworks. John Bradshaw (to pop psychologist) once said, many years ago, that gays are the most shamed group in American society. If anything, they're more shamed today than they were when Bradshaw made his comment. We're going backwards, and the religious are leading the way!

actually i found it very representative of the situation! There is one basic truth in that alot of people are missing! religions in and of themselves are for weak minded unevolved cultures, There has been more life lost of wars based on faith or ideology than any other root cause. Once we evolve as a world to a place where we no longer have such simple minds and can cast off religious beliefs as myth or lore as they should be viewed things will never change. If the right wing nuts keeps spreading there message of hate and division. They will as they have recently start to see people turn there back on the church as a whole! the only people I know that go to church on a regular basis are old and typically people that are spoken to as slow thinkers!
