SAN FRANCISCO — The sponsors of Proposition 8 asked the California Supreme Court on Friday to nullify the marriages of the estimated 18,000 same-sex couples who exchanged vows before voters approved the ballot initiative that outlawed gay unions.

The Yes on 8 campaign filed a brief arguing that because the new law holds that only marriages between a man and a woman are recognized or valid in California, the state can no longer recognize the existing same-sex unions. The document reveals for the first time that opponents of same-sex marriage will fight in court to undo those unions that already exist.

"Proposition 8's brevity is matched by its clarity. There are no conditional clauses, exceptions, exemptions or exclusions," reads the brief co-written by Kenneth Starr, dean of Pepperdine University's law school and the former independent counsel who investigated President Bill Clinton.

The campaign submitted the document in response to three lawsuits seeking to invalidate Proposition 8, the constitutional amendment adopted last month that overruled the court's decision in May that had legalized gay marriage in the nation's most populous state.

Both Attorney General Jerry Brown, whose office is scheduled to submit its own brief to the court Friday, and gay rights groups maintain that the gay marriage ban may not be applied retroactively.

The Supreme Court could hear arguments in the litigation as soon as March. The measure's backers announced Friday that Starr, a former federal judge and U.S. solicitor general, had signed on as their lead counsel and would argue the cases.

Proposition 8's supporters assert that the Supreme Court lacks the authority or historical precedent to throw out the amendment.

"For this court to rule otherwise would be to tear asunder a lavish body of jurisprudence," the court papers state. "That body of decisional law commands judges _ as servants of the people _ to bow to the will of those whom they serve _ even if the substantive result of what people have wrought in constitution-amending is deemed unenlightened."

The cases are Strauss v. Horton, S168047; City and County of San Francisco v. Horton, S168078; and Tyler v. State of California, S168066.

Boycott every single Mormon-owned business you know about. Any progressive person who stays at a Marriott, for instance, is probably subsidizing this kind of hatred.

First let's get the numbers straight - despite the historic nature of the election, only 60% of ELIGIBLE voters turned out on November 4th (only in the US do we have the BS of registered voter calculations). Of those 52% voted in favor of Prop. 8. There's NO MAJORITY here - only 31% of ELIGIBLE VOTERS declared their desire to strip the rights of fellow Californians.

All we have to do put an end to constitutional changes by referenda is require that a constitutional measure pass by more than 50% of ELIGIBLE voters. Is that so unreasonable? Oh wait - if we were all reasonable here, gay marriage wouldn't be an issue.

Why do you have to make such a big deal of the gay issue ? In Cologne where I live we have a huge amount of gay men and women. If they were ever threatened, the majority of the hetero people in Cologne would march for their rights. The attitude is live and let live. No government and no church should influence your sexual orientation, this is strictly personal. How can you be free, when even these basic rights are denied to the gay population in America ? The world economy is in bad shape and you fight over gay marriage ? Pathetic.

What exactly are these people asking for? Are we now a country that ignores a Court rulling? Is Starr looking to write another "porn" finding? How is Gay Marriage going to threaten our country? I can't wait for about another 20 years to pass, then all this crap will be over. Most people involved with Prop 8 and these other hateful laws will have died and the rest of us can go on. I don't know anyone under the age of 45 who cares about these issues. Homosexuality has been around since the begining of time, oh and that has been longer than 6000 years"creationist". Each person is different and no matter what people try to do to them they will be who they are. Besides, what are these people scared of? That all of a sudden there is going to be a rash of gayness? With the hate that many gay people suffer, why would anyone choose to be gay? I think it's because of a whole bunch of old white men are scared of their own feelings. It's the only answer. Let everyone be happy, how does it affect me? It doesn't. People need to be concerned with their own lives, not the lives of others, then we might just make it.

Actually its because civil unions with full and equal rights are not currently on the table
in most places.

Also, many gay rights activists see the idea of a special label to be an insult to the idea that gay relationships are exactly the same at their foundation as straight relationships.

I can't blame them for that. We still live in a world where far too many people think of being gay as a perversion, a spiritual corruption or a mental defect.

Possibly for much the same reason as ignorant people who make unthinking comments aren't accorded second class status.

There are gay couples who cannot get into the hospital to see loved ones in some states because "civil unions" have no standing in that arena. They work hard all of their lives, but are not accorded the same retirement benefits as other "legal" couples.

If the Bible tells you that something is wrong for you, DON'T DO IT FOR YOURSELF.

You want to push your point of view about a document that has been written and rewritten over the centuries, and took a huge turn for the worse when the narrow-minded point-of-view of the Dark Ages, that putting up with a horrible life was a good trade-off for the after-life (Early upper class propaganda imposed upon the masses) was put into it. Please.

Half of you don't even know where things in the Bible come from. "The sins of the father are visited upon the son..." Words of God? Hardly. The words of the Greek playwright Euripides in "The Frogs." A copyist in the time of hand re-writes recopying the Bible liked the passage better than what was there and stuck it in.

I propose the following:

No gay marriage if from here on out when a straight couple gets married 'it.. no more divorce, you stay married FOREVER. You cannot move out, you have to stay living together and produce children like good humans. Because if it is that important that we cannot have gay marriage there should be a law that says we cannot get a divorce in a straight marriage.

Then that should be retro-active, and people like Newt, and Gulliani, and all these other jack-O-A$$e$ can prove their Christian worth. American wide I am sure we would have so many happy couples!

This is the best suggestion I've heard yet. But maybe I feel that way because I've been in lesbian relationship for 31 years and just got married last summer in Massachusetts. How many straight couples do you know who have 31 years?

Quite a few actually including all of my six brothers and sisters. My wife and I will hit our fortieth year together next September. Being gay or straight has little to do with compassion, tolerance and commitment. There are gay s**theads as well as straight A successful marriage or any kind of long-term relationship requires all of those and more. I wish for everyone, without regard to sexual preference, the opportunity to experience the kind of relationship my wife and I have shared and still share. I see no threat to America from people who want this for themselves.

Married 18 years and not once has my marriage been at risk for failure because some gay couple was in love... known plenty of other Christians that have lasted less then 5 and they were not gay.

Know 2 Lesbian couples, both >10 years together.. may be batting for the other team but they are doing better then the average "real" marriage.
