SAN FRANCISCO — The sponsors of Proposition 8 asked the California Supreme Court on Friday to nullify the marriages of the estimated 18,000 same-sex couples who exchanged vows before voters approved the ballot initiative that outlawed gay unions.

The Yes on 8 campaign filed a brief arguing that because the new law holds that only marriages between a man and a woman are recognized or valid in California, the state can no longer recognize the existing same-sex unions. The document reveals for the first time that opponents of same-sex marriage will fight in court to undo those unions that already exist.

"Proposition 8's brevity is matched by its clarity. There are no conditional clauses, exceptions, exemptions or exclusions," reads the brief co-written by Kenneth Starr, dean of Pepperdine University's law school and the former independent counsel who investigated President Bill Clinton.

The campaign submitted the document in response to three lawsuits seeking to invalidate Proposition 8, the constitutional amendment adopted last month that overruled the court's decision in May that had legalized gay marriage in the nation's most populous state.

Both Attorney General Jerry Brown, whose office is scheduled to submit its own brief to the court Friday, and gay rights groups maintain that the gay marriage ban may not be applied retroactively.

The Supreme Court could hear arguments in the litigation as soon as March. The measure's backers announced Friday that Starr, a former federal judge and U.S. solicitor general, had signed on as their lead counsel and would argue the cases.

Proposition 8's supporters assert that the Supreme Court lacks the authority or historical precedent to throw out the amendment.

"For this court to rule otherwise would be to tear asunder a lavish body of jurisprudence," the court papers state. "That body of decisional law commands judges _ as servants of the people _ to bow to the will of those whom they serve _ even if the substantive result of what people have wrought in constitution-amending is deemed unenlightened."

The cases are Strauss v. Horton, S168047; City and County of San Francisco v. Horton, S168078; and Tyler v. State of California, S168066.

Offense is the best defense!

We should start trying to annul their marriages and adoptions - based on the inequality between the sexes in their marriages for example.

So many nuns marry Christ. Isn't that Polygamy?

There are many grounds on which to challenge religious freaks' ability to raise adopted children - raising bigots, etc.

If we start challenging their rights, that'll keep them busy for a while.

Some reporter should look into Ken Starr's personal life because I would almost bet on it that he sent me a pic a long time ago (during the Clinton brouha) of himself through a Gay site on the net. I'm not sure, but I'm almost positive. I thought at the time it was him but I deleted the message and couldn't find him back at the site where he messaged me from.

It should n't surprise anyone that Starr in involved with this case. The son of a Texas preacher, involved in the Reagan and Bush administrations and then chasing Clinton for three years. He ignored the ugliness of Iran/Contra, went after Clinton on Whitewater, but instead prosecuted him on a "b**w j**b, and now he's taken the high moral road of fighting again equal rights. Model citizen.

I keep watching all the different religious cults around the world and harm they keep doing to societies and nations. All you people claiming to have been duped by Obama were simply not paying attention. He stated his position on gay marriage many times during the primaries and general election. Why do you think Susan Eisenhower, CC Goldwater, Ron Reagan, Chris Buckley, and a ton of Independents and moderate Republicans came out and endorsed him? Because he's a far lefty? Get real. Obama won because he conquered the center, and he made no secret of it.

If people say he's wrong on certain issues, ok, that's opinion. But when you start calling him names, that's going over the line and we'll be in your effing faces. There are a lot of us who are not going to let any shrill extremists on either side ruin this historical moment. It's your right to sit it out, but you'd be missing out.

Well... if the time comes that you find your optimism dashed, your hopes lying broken on the ground and your trust and faith in Obama betrayed, those of us here who have gone through the same exact sort of pain will be here for you.

If we're lucky, all of us, you might be right and he lives up to expectations. God knows we need him to. But all the warning signs I see tell me exactly where this is headed. I'd like to be wrong, I really would.

In the meantime, by all means, don't let us "shrill extremists" defecate on your "historical moment" parade. I dare say you should enjoy it as long as it lasts, certainly.

Karate Kid, something is really bugging you, and you're taking it out here because you have found a good target - 'the gays.' Take a good long look at how angry you are at gay people for demanding their rights. It's way-way-way out of proportion. You sound like someone who's angry because of something you are failing to do. I am reading the above comments, and see people with the same point of view.

The majority of Americans, including myself, DO NOT SUPPORT GAY Marriage.

It has nothing to do with bigotary. It has to do with the belife that Gay people are imoral. What they do to each other is their choice, but it is a behavior NOT some one that is born with.

I am obama supporter, if he try to fight for "GAY MARRIAGE" he will be loosing, and as a chrisitan he doesn't belive in Gay marriage, and he said so duing his campaign.

The majority of democrats, and americans think Gay is sign - you don't have to agree that is what we belive.

I am ok with civil union - and respecting gay's as human beings. But don't try to shove this on us. American's will reject it. And I will bet, if there was vote to amend the US constituion that we will vote overwhelmeingly.

How can anyone support legislating religious definitions of gender, when the clear reality of nature is that gender is a spectrum?

People have been born with ambiguous gender (and biologically ambiguous genitalia- for anyone out there who thinks "intersex" is merely about psychological identity) since there have been people. The same ancient societies that handed down the superstition and dogma filled Old Testament that these religious yahoos like to cherry-pick from would have considered those human beings, born as god made them, as abominations, and called for their infanticide.

Once upon a time the majority of Americans supported bans on interracial marriage. Before that the majority of Americans supported slavery. Both times they claimed it had nothing to do with bigotry. We're they right? Of course not.

Thankfully both times Americans were smart enough not to amend the constitution in support of those views. I'm not so sure now.

This is what infuriates me about the Democratic party a nd now Obama...th­ey still don't get it about the right wing and Republicans in general. Democrats are always trying to "do the right thing " and "can't we all just get along" singing Kumbaya around the campfire while the right wing has billy clubs and torches ready to burn everything down !
It is no surprise to me that the Prop 8 folks want to reverse the marriages. Their orignal proposition called for the undoing the civil unions, domestic partnership, and all other laws protecting LBGT citizens in California. Here is another tidbit:
"Thomasson also pushed hard for Gov. Arnold Schwarzenegger (R) to veto a bill honoring LGBT icon Harvey Milk, saying that it would "positively portray to children homosexual experimentation, homosexual 'marriages,' sex-change operations, and anything else that’s 'in the closet.'"
That is an inkling into the real agenda behind the prop 8 people.
