The possible, perhaps, impending victory of Al Franken to the Senate has sent GOP officials into a paranoid tizzy.

In an "urgent message" to supporters, the Republican National Lawyer Association accuses Franken and his "liberal allies" of "working feverishingly [sic] to steal the Minnesota Senate election."

"As you may know, the precinct recount phase of the Minnesota Senate race was won by Sen. Norm Coleman on Election Day," reads the petition, signed by the group's executive director, Michael Thielen. "But Al Franken still won't concede. Instead, Franken raised millions of dollars from liberals in New York and Hollywood to fight a "legal" battle to undo the will of the voters. He even got the Minnesota Supreme Court to order canvassing boards to consider about 1600 previously rejected and questionable ballots. Now, Republican Norm Coleman has until December 31st to fight against Franken's liberal legal team to keep his Senate seat. RNLA and Norm Coleman are fighting for every vote -- literally!"

From there, the RNLA asks readers to donate money so that it can uphold the sanctity of the Minnesota election and prevent Franken from "stealing" the Senate seat.

For those following the recount closely, the letter is filled with a variety of obvious misinterpretations and inaccuracies. For instance, the RNLA gives the impression that during the canvassing process, officials "found errors favoring Franken so incredibly statistically improbable that statisticians are questioning the officials in these counties." It's not clear which statisticians the RNLA is referring to. But a study done by a Dartmouth professor actually predicted the very gains made by Franken.

RNLA then says that "during the recount an Election Official explained an error that resulted in Franken losing votes occurred when her precinct double-counted some votes on election night. But after pressure from Democrats made the official change her story the [Secretary of State] Mark Ritchie led Canvassing Board decided for that precinct only the recount did not count and would instead use the more favorable to Franken Election Day total."

In all likelihood the instance they are referring to involved the loss of a very specific envelope of ballots in a highly Democratic district. At first officials assumed they had simply counted those ballots twice on Election Day and could not match that vote total during the recount. Later, however, it became clear that ballots had been misplaced. And when they couldn't be relocated the state decided, as is permitted by law, to simply use the Election Day results and forgo the recount of that district.

The funniest bit, however, comes at the end of RNLA letter, in which the group makes a plea to help Coleman match the money Franken has raised for their "legal battle."

"Since election day when it was clear Norm Coleman had won, Al Franken raised millions of dollars to continue his legal battle. We need to do the same for Norm Coleman."

The Minnesota Republican, of course, is mired in an ethics scandal that could threaten his Senate seat should he win reelection. Franken is just lawyering up for the recount.

I'm hoping the "liberal allies" of Franken are indeed working day and night to certify his election in the Minnesota Senate race. From my perception, it is amazing that there are any votes for Coleman. Do we all know who Coleman "replaced"?

Some of us do remember Paul Wellstone. That he should have been "replaced" by Norm Coleman goes to show that the Universe has a nasty sense of humor.

For most voters, these results should be acceptable. Taking this to the Supreme Court would clearly be foolish.

The only problem with a UN "unbiased" team to supervise elections is that interest in US politics is world-wide and intense. I don't think there is such a thing as an unbiased election team.

Democrats and Republican friends: if we back away from our mutual hysterias for a minute, we might let some facts intervene:

a. Franken or Coleman will be representing the people of MINNESOTA. Neither has "won" the election, that is already obvious. Each got within a smidgen of 50% of the votes, and nobody will ever know who "really" won. Since a Democratic judge will decide, I assume Franken will end up in the Senate where he will almost certainly continue his track record of buffoonery.

b. Both are utterly mediocre. Franken is a second-rate comedian who has cleverly marketed himself to take advantage of justifiable Democrat anger and frustration. His books are full of errors and hate. Coleman is no better.

c. The New York Times and several other newspapers investigated the Florida election and decided that Bush won, and would have won even if Gore had gotten his way on most of his legal initiatives. Remember, Gore fought to BLOCK absentee votes from servicemen overseas. Moreover, the 2004 Washington gubernatorial election was highly questionable. So both sides have a reasonable claim that important recent elections went the wrong way, or indeed were "stolen."

How a group of intelligent people can invest so much energy gloating for "winners" among the most corrupt group of politicians in American history is amazing to me.

Let's move on. Franken or Coleman -- Minnesota is going to get a Senator it fully deserves. Hardly a cause for celebration either way.

and you called me "friend"? If you for one moment think I will take the word of any representatives of the msm to quantify an obvious defunct and corrupt election you and I live at opposite polarities of logic. Did you fail to mention the IT Software producer who testified before congress his conversations with the Florida State Attorney regarding the capabilities of producing a program which would not only produce false voting numbers for a respective party but how he could also write into the program that this same program would actually self-delete so as to prevent any detection of such a program in the first place. To be clear this conversation took place with him being solicited for this information, not the other way around. I don't recall the man's name now but I'm sure if you google something to the effect of congressional voter fraud hearings the video, yes the actual video of the hearing, will come up for you. So please refrain from calling me your friend on this one, I prefer to be a bit more selective towards those who expect to play that role in my life......

Sir, first off, your comments are incoherent. As a matter of form, one uses an outline format (a,b,c) to help the reader follow a line of reasoning. In the case of your writing, such logical flow is absent. Further, your statement of "facts" is mostly a one-sided screed, full of judgments and non-sequiturs. True - subversion of the democratic process is not completely one-sided, but a more thorough review of the facts on your part would hold sway to the notion that the recent Republican hold on power has been lengthened considerably by less than savory means. Any upcoming (one can hope) review of the DOJ's actions and in-actions over the last eight years will reveal unprecendented corruption amounting to fraud and clear contempt for our representational democracy.

I got as far as "track record of buffoonery," and I knew you have no idea what you are talking about. Mr. Franken may have a unique style, but he's smart and well-informed way beyond the Senate average. Would that Coleman's only problem were an excess of "buffoonery." Instead, Coleman appears to be challenged in the area of fiscal ethics. And we will soon be seeing about that.

The only buffonery I see is that displayed by JiminNashville.

Think for a second. That's NASHVILLE, as in TENNESSEE. Think pickup trucks with a gun rack and rebel flag in the back and you understand where he's coming from. He does have a lot of fallacies in his comment.

a) The canvassing board that is doing the recount is made up of two republican appointed judges, one elected in a non-partisan election, who has favored neither political party in rulings, an independent judge appointed by Jesse Ventura and the Democratic Secretary of State. The governor of Minnesota, Tim Pawlenty has called this board a very fair and representative panel.

b) Nothing need be said. There's nothing but partisan opinion in his statement.

c) The New York Times is hardly a neutral source. It's owned by one of the large corporations that love republicans. Many news sources did the same study and decided that Gore would have won. I guess we'll never know for sure since the republican supreme court ruled that Florida didn't have the right to decide for themselves as to whether the votes in their state needed counting. As for the absentee ballots, they were postmarked AFTER election day, and would be illegal in all 50 states.

I think what this all boils down to is that the United States has become one of those Third World Nations in which corrupt elections run rampant. The only real solution is that the U.N. establishes an election oversight capability that would be responsible for overseeing elections in every nation. It would provide unbiased observers who would be available to all nations and make it possible to have honest elections. Since too many of our citizens of late can't be trusted to handle election results with any integrity, and since our election methods have become so easily corrupted, a solution of the sort above would be our only salvation.

Favorite    Flag as abusive Posted 02:15 PM on 12/24/2008

The problem is that whoever controls that oversight system will control the elections.

I can't help but think of the ironly. Do they think we've forgotten the 2000 election? Now suddenly they have a problem with courts intervening in elections?

Ha! Thank you for reminding us of this.

And as long as the process is this uncertain, legal battles over close elections will remain a political reality.

We may as well get used to it.

I like the line "He even got the Minnesota Supreme Court to order canvassing boards to consider about 1600 previously rejected and questionable ballots." These are the ballots described as improperly rejected. I question anyone's commitment to democracy if he opposes counting ballots improperly rejected.

I am amused by Coleman...ah yes, he does protest...a little too much. This "instant re-wind" he is calling for sounds a little fishy - even for ice fishers of MN! Similar to Bush - there are no do-overs.

The appeal by the Republican National Lawyer Association says more about the motivation of its membership than it does about the issues. If the RNLA were truly concerned with preserving the "sanctity" of the electoral process, I am relatively certain that its members would be lining up by the dozens to provide pro bono litigation services. Instead, it is merely seeking money to stoke the litigation boiler. Don't look now, RNLA, but your hypocrisy is showing.

Hello Mr. Stein,

I had read your "article" today on Franken/Coleman and was very disappointed to find it to be the usual hitpiece on a conservative. Your terminology, such as "paranoid" and "tizzy" make it not so much an article or piece of journalism as something deserving of a place on TMZ or the National Enquirer. The job of a journalist, in most circumstances, is not to persuade but to report. You have failed miserably to report in this situation and I hope that, in the future, you can rise above yourself and put some integrity in the "paper" that you represent.

Somehow, "paranoid" and "tizzy" don't seem so over the top in the context of a report on a document quoted extensively as accusing Franken of "working feverishingly (sic!!!!!)to steal" the election and to "undo the will of the voters," and even unconsciously mimicking Joe Biden going overboard - "literally!" Note that the reporting is not focused on the underlying details of the recount, except to rebut lies and hyperbole in the Republican mailer. Do you like the terms "lies" and "hyperbole" better?

You're shouting at the wind. This is a liberal site. There is a left bias here, and that's OK because that's what we want. If you want fair and balanced go to FoxNews.com. You can shout at liberals there with all the other misguided people who voted for and supported Bush II and still think deregulation of markets is a good idea.

Something's fishy in Frankentown. Finding 'missing' ballots that are all for Franken? Who's watching the watchers? Doesn't this raise some sort of red flag or just when it's a Republican doing it? Shouldn't Dems want to win fair and square or is it just to win no matter what you have to do? Questions, questions, questions. My respect is waning.

Please go back and read some archived history of this election. Minnesota has strong and detailed provisions defining what the watchers and their watchers are supposed to do. Minnesota has relatively reliable technology. (no chads or butterflies) This may be the closest election ever, period, in terms of percentage difference between the candidates. Minnesota law strongly favors counting every decipherable vote. That you think the missing ballots were all for Franken is a red flag for ignorance. Check it out!
