SACRAMENTO, Calif. — With Republicans on the sidelines, Gov. Arnold Schwarzenegger and Democratic leaders met Tuesday to fashion a midyear fix for California's swelling budget deficit.

Senate President Pro Tem Darrell Steinberg emerged from the initial round of discussions and told reporters the talks had been positive. Less than a week ago, Schwarzenegger had threatened to veto the Democratic budget plan that is the basis for the current discussions.

"We're all very committed to making an $18 billion dent into this problem before the end of the year," said Steinberg, D-Sacramento. "That's our obligation."

Steinberg said he hoped leaders could reach a deal by the end of the week and planned to resume talks Friday, likely by teleconference because the governor had left California for the Christmas holiday. He said a legislative vote on a compromise could come next week.

The Democratic plan would begin to address the deficit with $9.3 billion in tax and fee increases, $7.3 billion in cuts and another $1.5 billion in labor concessions, court rollbacks and other moves.

Republicans oppose it because of the tax increases. Last week, Schwarzenegger said he would veto it because it failed to include sufficient measures to stimulate the state's economy.

But California's ballooning deficit _ projected to hit $42 billion over the next 18 months _ is leading to severe consequences that have forced Schwarzenegger and Democrats to act quickly.

On Monday, the state controller warned that California will run out of cash within 70 days if lawmakers don't act quickly to bridge the growing divide between revenue and spending.

Steinberg said he and Assembly Speaker Karen Bass, D-Los Angeles, were willing to give Schwarzenegger more of what he wanted. That could include making concessions on labor rules and environmental regulations to accelerate work on infrastructure projects, agreeing to build more toll roads in the state and expanding help to homeowners facing foreclosure.

The Democratic leaders said they also were trying to accommodate the governor's demands for additional spending cuts, including eliminating two of 14 paid state holidays. Doing so would save an estimated $114 million during this fiscal year and the next one, mostly in overtime costs.

Republicans did not participate in Tuesday's budget negotiations.

Senate Minority Leader Dave Cogdill, R-Modesto, said Republicans would return to the Capitol if a deal were to be reached but said his caucus remained opposed to the package. He and other Republicans believe it is illegal because it contains tax increases yet was passed without a two-thirds vote in the Legislature.

"There's nothing for us to talk about today," said Cogdill, strolling through the Capitol in jeans and a leather jacket.

Anti-tax groups have vowed to sue if Schwarzenegger signs the plan, challenging its legality. Proposition 13, passed by voters 30 years ago, requires a two-thirds vote by lawmakers to raise taxes.

Democrats say they have found a way to get around the two-thirds requirement by claiming their $18 billion plan does not technically increase the amount of taxes on Californians.

Instead, they say it eliminates gas taxes and replaces them with a variety of other charges, including raising the state sales tax by three-quarters of a percentage point, boosting personal income taxes by 2.5 percent, taxing companies that extract oil from California and collecting taxes from independent contractors upfront.

It then replaces the gas taxes with what Democrats call a gasoline fee that would go solely to transportation projects. Because the fee is dedicated to a single purpose, it does not require a two-thirds vote, Democrats say.

Schwarzenegger has said it is necessary to raise taxes, but his opinion about the method contained in the Democratic plan is uncertain. Last week, he called the Democrats' proposal a "terrible budget" that would "punish the people of California." And in a meeting with local leaders in the Central Valley last week, he said their plan included "illegal taxes."

It was not clear Tuesday why the governor had decided to negotiate on a plan that only days ago he said contained provisions that were not legal. His spokesman, Aaron McLear, said Schwarzenegger would not sign anything that is illegal.

After meeting with the Democratic leaders, Schwarzenegger was asked whether he would sign a budget plan that contained tax increases but was passed only by a simple-majority vote.

"I prefer having my Republican friends at the table, and I prefer to get a two-thirds vote. But we do need revenue increases," he said. "To save California, I'm forced to negotiate just with the Democrats. This is the situation I am forced in because of lack of participation by the Republicans."

Schwarzenegger said he would let others debate the plan's legality, ultimately deciding "what is a fee and what is a tax?"

All the Dems were against the one prop that would have gotten some of the drug addicts out of the prison system. I guess they hated the restriction on the judge part, but I thought it would be a way to reduce the prison population problem. The proposition lost.

We're shipping prisoners to other states and have been doing it for awhile, but I think that's a lawsuit waiting to happen. Some of the private systems are truly uninhabitable.

It's a mess.

Arnie wants to run or be President. He is a fair governor as best. Be he is just not very smart or good. Californians hate taxes and thats going to be their downfall. The Jarvis amendment was that worst piece of legislation ever passed in this state. I created a surge in real estate prices, caused a shift in population, emptied the state coffers, schools, hospitals and publice services ran out money. We had to use a lottery system to raise monies. Now that does not work. Our roads are crumbling and are not being repaired, because the gas taxes are used to prop up other governmental programs. Our politicians are not very fiscally educated. They don't know how finance works. Some one has to tell the people that you pay to play. But Arnie beat that governor, Gray Davis. This state is in a mess, with not remedy is sight.

Regarding previous post: I mean progressive income tax system. That's what is needed, a return to a fair and progressive income tax system in which the more you make, the more you pay. The rich avoid that as much as possible, i know, through exemptions and loopholes, and that's what keeps tax accountants and tax lawyers busy. Either that or a progressive flat tax: 30% on anyone making over $10 million,25% on anyone making over $1million, 20% on 100K+, 10% on anything under, and NO EXEMPTIONS OR DEDUCTIONS!

Illegal immigration and entitlement programs are ruining all border states.

As a resident of Phoenix, I can tell you we are beginning to see the same problems, and we now have the 2nd worst state economy.

I can't speak firsthand for California, but I've heard secondhand they're experiencing much of the same trouble we are. Arizona and Phoenix leadership (all Democrats) are uncooperative with federal autorities regarding illegals. Here in Phoenix our mayor has ordered the police chief NOT to report illegals with criminal records to I.C.E. - a violation of federal law. I've heard similar stories from relocated Californians, and we know all large cities in California are sanctuary cities.

People here undocumented cost taxpayers exorbitant amounts of money. When tax revenues go down, as is the case in California due to the outflux of taxpaying residents, illegals continue to need services. Therefore state expenditures don't change. The best solution to this is to create and enforce more stringent sanctions agains employers employing illegals. Our governor, the next Secretary of Homeland Security, fought legislation requiring sanctions against employers employing illegals.

Currently ALL official documents must be created in two languages. Border states also need to pass laws making English the official state language. While this may seem petty, imaging hundreds of thousands of pages of official documents, multiplied twice over in paper and ink use. Talk about a way to go green...

I think that the research shows that the economy would have tanked some time ago without the influx of "illegal" labor. Next to the housing bubble, this is probably what has kept California afloat for so long.

I think that you might need to pay more attention to the cost t of "legal" immigrants to taxpayers. I do not think that the general public understands the number of immigrants who are white and legal but who use various governmental subsidies. Because of their color and immigrant status, they fly under the radar so no one recognizes how costly they are to the economy.

Meanwhile, dems are trying to slip in tax increases by calling them fees, and reps won't sign anything, as far as I can tell. They are the "no-no" folks, no matter what.

Last year every CEO earned way more than any Calif. public servant but we don't hear sniveling and accusations toward them. Not a one earned his salary or perks or stock options. They lie to us and use bailout money for bonuses. Nobody in the real world gets a bonus for running a company into the ground so why do they? 64 million a year + stock options? INSANITY THAT THEY RAPE US BLIND, THEY ARE INCOMPETENT AND YOUR PISSED CAUSE SOME PUBLIC OFFICIAL EARNED $300,000. RESCUE THE MIDDLE CLASS, PUT THE UPPER CLASS IN PRISON.

Sounds like the commenter's here need to learn about a states budget before harping on things in California. There is no way in the world anyone could generalize Cali by a visit to LA or San Fran..we are a huge state with millions of different types of people. As far as taxes being to high? Thats the price of being able to get something plush without paying NY prices. Thats the price of being able to have a multi cultural setting and being able to see the snow, rain, ocean, beach, country or forest..all within a few hours from each other. There is no better state...as far as the budget is concerned...RIGHT NOW as much as I hate high taxes...that is the only way to take care of the economic crisis here. There are no other alternatives...even a pay decrease on our officials wont cover the 43 billion dollar deficit. Kinda like whats goin on in the country..Cali tends to be in tune...

That's not true, it's a lie! Get your facts straight! When taxes are cut, the rich hoard their money, and do not invest it in creating more jobs or businesses. When they are taxed fairly, like before the Reagan Era and starting with the New Deal, they are given an incentive to make more money, and therefore will invest it in jobs, starting businesses, investing in businesses, etc. Warren Buffet knows this well, and that's why he opposed the three George Wanker Bush tax cuts!
Another thing: Americans need to wake up to the fact that services like roads, fire and police, medicare, veterans administration, pubic schools and universities, cost money to run, and therefore taxes are needed to run them. If an 80 year old bridge needs retrofitting, waiting around for it to collapse and kill people is much more expensive than fixing it now! There's no free lunch, and if Repugnantcans thought that borrowing instead of taxing was the cure, they got it all wrong, they flunked the test, as Rickie Lee Jones sang a few years ago!

Hey there People. I have a friend that is really good at this "How to run a state" stuff. He is not really much of an "Action Hero" kind of a guy though. More of a learn, and learn more kind of guy.

His name is Gray Davis. He is not a very sexy guy, but he is really, really smart.

He had all of these tough medicine plans for the State of California, and they were not the repairs that a lot of people wanted to hear or deal with at the time, but he knew what was going to be necessary. You know, things like raising taxes, and figuring out where the waste was. He still has a plan, and actually knows what he is talking about. Funny story, the current Governor who replaced him, is now trying to adopt his plan. Yah, it took a while but reality has caught up with the Governor and his friends who had my friend kicked out of office, and the people who thought it would be a better plan to ditch reality.

Well, just say the word, and I will give my friend a call. He would be more than happy to come back to work and finish the job he was elected to do. And he is a non-smoker.
