SACRAMENTO, Calif. — With Republicans on the sidelines, Gov. Arnold Schwarzenegger and Democratic leaders met Tuesday to fashion a midyear fix for California's swelling budget deficit.

Senate President Pro Tem Darrell Steinberg emerged from the initial round of discussions and told reporters the talks had been positive. Less than a week ago, Schwarzenegger had threatened to veto the Democratic budget plan that is the basis for the current discussions.

"We're all very committed to making an $18 billion dent into this problem before the end of the year," said Steinberg, D-Sacramento. "That's our obligation."

Steinberg said he hoped leaders could reach a deal by the end of the week and planned to resume talks Friday, likely by teleconference because the governor had left California for the Christmas holiday. He said a legislative vote on a compromise could come next week.

The Democratic plan would begin to address the deficit with $9.3 billion in tax and fee increases, $7.3 billion in cuts and another $1.5 billion in labor concessions, court rollbacks and other moves.

Republicans oppose it because of the tax increases. Last week, Schwarzenegger said he would veto it because it failed to include sufficient measures to stimulate the state's economy.

But California's ballooning deficit _ projected to hit $42 billion over the next 18 months _ is leading to severe consequences that have forced Schwarzenegger and Democrats to act quickly.

On Monday, the state controller warned that California will run out of cash within 70 days if lawmakers don't act quickly to bridge the growing divide between revenue and spending.

Steinberg said he and Assembly Speaker Karen Bass, D-Los Angeles, were willing to give Schwarzenegger more of what he wanted. That could include making concessions on labor rules and environmental regulations to accelerate work on infrastructure projects, agreeing to build more toll roads in the state and expanding help to homeowners facing foreclosure.

The Democratic leaders said they also were trying to accommodate the governor's demands for additional spending cuts, including eliminating two of 14 paid state holidays. Doing so would save an estimated $114 million during this fiscal year and the next one, mostly in overtime costs.

Republicans did not participate in Tuesday's budget negotiations.

Senate Minority Leader Dave Cogdill, R-Modesto, said Republicans would return to the Capitol if a deal were to be reached but said his caucus remained opposed to the package. He and other Republicans believe it is illegal because it contains tax increases yet was passed without a two-thirds vote in the Legislature.

"There's nothing for us to talk about today," said Cogdill, strolling through the Capitol in jeans and a leather jacket.

Anti-tax groups have vowed to sue if Schwarzenegger signs the plan, challenging its legality. Proposition 13, passed by voters 30 years ago, requires a two-thirds vote by lawmakers to raise taxes.

Democrats say they have found a way to get around the two-thirds requirement by claiming their $18 billion plan does not technically increase the amount of taxes on Californians.

Instead, they say it eliminates gas taxes and replaces them with a variety of other charges, including raising the state sales tax by three-quarters of a percentage point, boosting personal income taxes by 2.5 percent, taxing companies that extract oil from California and collecting taxes from independent contractors upfront.

It then replaces the gas taxes with what Democrats call a gasoline fee that would go solely to transportation projects. Because the fee is dedicated to a single purpose, it does not require a two-thirds vote, Democrats say.

Schwarzenegger has said it is necessary to raise taxes, but his opinion about the method contained in the Democratic plan is uncertain. Last week, he called the Democrats' proposal a "terrible budget" that would "punish the people of California." And in a meeting with local leaders in the Central Valley last week, he said their plan included "illegal taxes."

It was not clear Tuesday why the governor had decided to negotiate on a plan that only days ago he said contained provisions that were not legal. His spokesman, Aaron McLear, said Schwarzenegger would not sign anything that is illegal.

After meeting with the Democratic leaders, Schwarzenegger was asked whether he would sign a budget plan that contained tax increases but was passed only by a simple-majority vote.

"I prefer having my Republican friends at the table, and I prefer to get a two-thirds vote. But we do need revenue increases," he said. "To save California, I'm forced to negotiate just with the Democrats. This is the situation I am forced in because of lack of participation by the Republicans."

Schwarzenegger said he would let others debate the plan's legality, ultimately deciding "what is a fee and what is a tax?"

Ya know what? There are a lot of other states that have received less return on tax dollars than California over the years. On a percentage return basis New Jersey gets the least back. Even Michigan gets a lower return than California does. As far as teh CA economy? It doesn't help the country. It's totally self-indulgent and a lot of US $$ gets thrown over to Asia from CA.

Here's a warning for you: At the height of the US auto industry Detroit was the wealthiest city per capita in the nation.

What's Wrong With California:
In my profession in almost any other state I can get a provisional license almost immediately and a permanent license in usually 2-4 weeks at a reasonable cost. Not so in California.

In California, I have to re-take my professional certification as a state exam, despite the fact that it is prepared by the same organization that makes the national exam and is essentially the same test. Even more insane is that even though it is administered electronically by an international company, I would have to take it IN California- not online from somewhere else.

All of this costs money. The fee is higher, the testing fee and travel to California is a burden on many and getting an application processed takes over 8 weeks. in between, don't expect to her anything from the massive state bureaucracy- even as much as a confirmation that they have your file. BTW- the company that administers the test score them immediately yet the state still takes 8 weeks. No wonder the state has a shortage of healthcare workers.

Now, if it is this difficult to get a licensee as a healthcare worker in California, imagine what a business has to put up with. Not all calls for deregulation are NeoCon attempts to dodge environmental, occupational or consumer protections. Sometimes the bureaucracy needs a swift kick in the a**.

Correct me if I'm wrong, but Reagan didn't pay any taxes in 1980, as he got away with a lot of tax exemptions. See, that's the problem: filthy rich bastards not paying any taxes, and then the burden falls on people like me, who have to get up at six in the morning to go to work! But that's the way the Repugs like it. Supposedly a 1% tax raise on the richest Californians and wealthiest corporations would help out our situation quite a bit, but the Repugnantcans who only need a 1/3 total no vote in the Assembly and Senate in Sacramento won't have it, won't compromise on this one bit!

I once lived in that state. The government spends like drunken sailors on shore leave. Taxes are insane.

I left because the taxes there are insane. High property tax, Income taxes, sales tax is pushing 10% now and you are required use permits and fees to the point where it no longer makes sense except for those raking in the dough.

Cops are now chief revenue gathers. Speed traps, traffic signs meant to trap you.

Just on the fact that citizens of that state allowed the prison-industial complex under the guidance of the Prison Employees Union to fill with people who don't belong there and others who were sentenced under the unconstitutional Maximum-mininum setencing [fake] laws. The state spends billions locking up people who don't belong there.

Asset Forfeiture is being abused, still, but quietly now as this law seems to upset the mainstream citizen. People are ripped off before they are proven to commit a crime. This law works great in a cash starved state when used against powerless people or those with whom you disagree politically.

Most people I meet there now are so stressed they can hardly tell you who they are. My wife says she hates Californians. She said they are rude and too many think they can tell you how to live.

They can keep Arnold. To me he is a big duffus. We should never allow a foreigner to become president of America.

Augh I am moving here permanently next month. Chicago, IL to Los Angeles, CA – I just can’t see to pick a politically competent state to live in.

I do feel that some of these comments directed towards Schwarzenegger have been a bit harsh. This is a man that donates his Governor’s salary to charity! (ok, he can afford to, but still). He seems very willing to work with both Republicans AND Democrats to resolve the budget problem. Every single member of the California Legislature should be working OVERTIME to get the budget crisis resolved as soon as humanely possible. Yes it is the holidays, but they owe it to their constituents to get this matter resolved quickly before it snowballs into something much worse than it already has.

I do find it interesting that Republicans want to block revenue increases because of pledges to protect special interests. Wonder what those special interests are?

And now the unions are mad that Schwarzenegger wants state employees to take a mandatory 2 unpaid days off a month? What, would they rather him fire people in order to balance the budget?? Sounds to me like the Governor’s trying to keep people employed! Don’t get me wrong, I’m not a union-hater, but this is very serious and EVERYONE is going to have to give a little, union members included.

But I partially disagree that he won't challenge his Republican base. Schwarzenegger's spokesman, Matt David, sounds very critical of BOTH parties in this article. But I think that the Terminator needs to lay down the law and publicly call out BOTH parties to quit the bull.

My neighborhood here has a large population of older Russian immigrants which after some getting their airline tickets paid for by a ' sponsor ' sigh up for food stamps, section 8 housing, free shuttle to the free breakfast programs, medicare, medi-cal, free used furniture program, some sublet their section 8 apartments having a family stay with them and pay them rent and if some do work it is for ' cash type jobs where the do not pay any taxes.....­.and middle america wonders why CA is going broke....

How are Buffet's fingers in the cookie jar? Last I heard, he was recommending a tax increase on the wealthy in order to balance the budget. There was some talk that he would become an advisor, but think that this did no happen.

Why is it governments only solution is TAX TAX TAX! That will not work anymore. The citizens of California are maxed out... It is time to cut. A great place to start would be to revoke all welfare for illegals. They do not deserve one dime of my tax dollars. You can debate it all you wish, but any tax increase (.39 per gallon of gas is nuts!) will lead to less revenue... CUT CUT CUT!

I don't think that illegals qualify for welfare. I think that you need to be born in the US in order to qualify. However, if you would like to revoke the welfare for all people who have an immigrant heritage, it would certainly reduce welfare costs.

As a native son of a native son of the Golden West, and proud of it, I could not agree with you more.
There was a way more fair way of property tax relief in Proposition 8 in June of 1978. But it was 13 that passed, and can you imagine that businesses are the ones who've made out like bandits, not so much private homeowners. For one, over time the pre-1978 lower property taxes on homes have changed as homes have been sold and re-sold, though there are exemptions through trusts and such so that inheritors can keep the pre-'78 lower rates. But huge businesses, and owners of huge apartment complexes, are getting away with not paying their fair share of property tax. I believe Macy's owns it's building in the Valley Fair shopping center in San Jose. Can you imagine the low rate of tax on that building, as Macy's's been there since 1958? By the way, I've never known of any filthy-rich person going broke from paying higher taxes. The Rockefellers, Mellons Du Ponts, Kennedys etc. didn't go broke when federal tax rates were well over 50%, or when FDR raised taxes on the wealthiest as part of the New Deal, as the rich paid very low taxes in the years before the Depression.
