In what may very well be the death knell for Norm Coleman's time in the U.S. Senate, the Minnesota Supreme Court on Wednesday unanimously dismissed one of his last legal objections to the recount process.

In a five-to-zero decision, the court rejected a Coleman campaign lawsuit that sought to block the course of the recount due to concerns that some ballots had been counted twice. It was the Minnesota Republican's last legal angle for making up the 47-vote deficit he currently faces against Al Franken.

Coleman had argued that in the process of recounting, some precincts had accidentally counted both the original ballots and duplicates that were used for those original ballots that couldn't be properly scanned. But the campaign asked only for the state to look at 25 specific counties, suggesting that the argument was politically and not legally motivated. Moreover, it couldn't provide evidence that voting tallies during the recount exceeded those on Election Day -- which would have been the obvious result of duplicates being counted.

With this issue, seemingly, out of the way, the recount process will come to an end once the state and both campaigns decide what to do about improperly rejected absentee ballots. That should come in early January. And while it would be foolish to predict how the counting and disbursement of these 1,600 ballots would proceed -- the two camps have agreed on principles by which the process will be conducted -- it seems likely that the results will favor Franken.

Franken's campaign has been pining to have these wrongfully rejected absentee ballots counted from the beginning of the recount process, suggesting that they believe the votes will favor Franken. It is more common for Democratic voters to make clerical errors on their absentee ballots than it is for Republicans.

All told, the window through which Coleman was looking to hold unto his Senate seat just became measurably narrower.

UPDATE: Not entirely surprising, the Coleman campaign says a lawsuit challenging the results of the election is now a near certainty. According to the Hill:

The Coleman campaign had claimed [duplicate] ballots, created by local election officials to mirror original ballots that were somehow damaged, were sometimes counted twice by accident, and should not be included.

"We are deeply disappointed in that result. The Supreme Court decision virtually guarantees this election will be decided with an election contest," Fritz Knaak told reporters on a conference call on Christmas Eve. "There's no question, I mean no question in our minds that [a lawsuit] will happen now."

Should the Coleman campaign file a contest, which it must do within seven days of the end of ballots being counted, the election results cannot be certified and no one will be sworn in when the 111th Congress meets January 5.

I am sure he was just hoping that at some point, the public would tire of this....Fr­anken would be made to look like a whiner.... and the status quo would just be maintained. No doubt that was his plan because, for sure....he knew on Nov. 4 that he had lost, but had simply manipulated enough results to make it appear the opposite. Every time I see a photo of Coleman (even when he was a Democrat), I am reminded of Truman Capote's description of one of the killers in "In Cold Blood"....­.he has a face like an apple that has been cut in half and reassembled crookedly. We lived on the east coast when he was elected mayor of St. Paul, and friends who are active in politics there said few people trusted him even then, and that he invariably turned political conventions into "the Norm Coleman show."

it is instructive to look at his vote totals in St. Paul after he endorsed Bush. He is utterly rejected there, even though that is where he got his start in MN politics. The general belief is that he will change his positions whenever there is a shift in the length of the line to run for higher office. He wanted to be mayor of St. Paul, and that job usually goes to a Democrat (well, ALWAYS). The line to national office was too long in the Democratic party, so he became a Republican.

That is what makes him so annoying when he (pretends to?) take those strongly conservative positions. The irony is that he made the wrong choice, jumped the line in the wrong party. Whatever obscurity is in his future, he richly deserves.

Coleman suing won´t prevent Senator Franken from being sworn in. He can go ahead with his frivolous lawsuit.

On another note, I´m happy to hear that the Federal Government will give him a consolation prize of three hots and a cot ... unless that scrooge Bush pardons him!

Yes, even his threat makes it obvious that he will alienate the people in Minnesota furious. He will also look like a sore looser and forever make any election bid on his part impossible. My cousins in Minnesota say they are so sick of Coleman and embarrassed at the behavior of their own party nominee for supporting Coleman in spite of his obvious loss. Coleman just MIGHT have had a chance for returning to the Senate if he had acted more cooperative and anxious for the correct count to be reached. It is obvious that so many of his challenges were made just to cloud the issue of who won, and were thus, disallowed­.. He will pay a big price for that to be sure.

Minnesotan's hate soreheads. ...and they also hate self-promoters. When Mondale was elected VP, the then-governor Wendell (Wendy) Anderson, the hockey player, chose himself to replace Mondale in the senate. When the seat came up for election, Anderson was trounced, and that was pretty much the end of his political career. As far as I know, not much is heard about him anymore, unless one reads Loni Anderson's book about how he wanted to marry her even though she was a teenager.

Of course, that was the old MN, the one that elected people like HHH, Eugene McCarthy and Mondale in the first place The new suburban MN (the one that elects Coleman and Bachmann) could be totally different.

Exactly what the Gore campaign did wrong (at least according to SCOTUS) in 2000. You'd think that lawyers would remember that kind of jurisprudence. Or maybe they were hoping the rules would be different for Republicans.

..except that, while Coleman was trying to be "selective", Gore (unfortunately) bowed to the limited recount because of the amount of time a full recount would have supposedly taken..and because of all the flack he was getting about the country being in "chaos", because of the delays that had been caused already..a bunch of hysterical baloney perpetuated by the GOP. Too bad he didn't stick to his guns and take it all the way..recou­nting every single vote in the country! We would have been just fine as froghair during however long that took..and actually, you can bet he'd have suddenly been given a ton of extra help for the recount, instead of all the loudmouth door-bangers that showed up, bussed in from RNC-HQ! No doubt, the GOP did realize that Obama wouldn't roll over that way or put up with any of the rest of their shenanigan­s..and I doubt any Dem ever will again! Go Al..take it all the way!

I believe the republican party is stepping in to cover Coleman's expense. There was an article earlier reporting that the GOPs are mobilizing their donors suggesting that Franken is robbing MN voter's in borad day light. Clearly, if they lose MN senate seat this wrecks havoc into their legislative maneuvering plan. At this point, every senate seat counts.

DEMs are likely to find 2-3 sympathetic GOPs to break filibuster (specially the ones in New England area) and I also have a feeling - Binden will spend most of his time in Senate Chamber to break a tie.

The problem is that suing can hold up the seat for months at a time when we need a full contingent of Senators to work on the horrible problems we are facing TODAY not in six months.

I'm hoping that the Senate will seat whomever has the most votes after tallying the absentee ballots.
