SPRINGFIELD, Ill. — Gov. Rod Blagojevich's lawyer said Monday that a vague array of charges and evidence doesn't merit removing the governor from office, and he urged a House committee not to recommend impeachment. Attorney Ed Genson complained bitterly that lawmakers were considering snippets of tape-recorded conversations that are quoted in a criminal complaint against the Democratic governor. He said no one knows the full context of those remarks or whether they are quoted accurately.

"We are fighting shadows, and that's not right," Genson said.

Monday's hearing was the first time Genson has comprehensively responded to the impeachment charges. Blagojevich was arrested by the FBI Dec. 9 on a variety of corruption charges, including scheming to benefit from naming President-elect Barack Obama's replacement in the U.S. Senate.

The governor denies any wrongdoing and has vowed to fight both impeachment and the criminal charges.

It was clear from the lawmakers' questions that they had little sympathy for Blagojevich or for Genson's arguments.

At one point, Genson grew so frustrated that he pleaded for help.

"Isn't anyone here going to stand up for the governor, or is it going to be one (critic) after the other?" he asked. "This is the impartial panel?"

Meanwhile, federal prosecutors filed a motion Monday asking for court permission to release four of the Blagojevich conversations caught by wiretaps.

A judge will hear the motion next week. Genson said he hadn't seen the federal request and didn't know whether he would support the release of the recordings.

Genson told the committee that the quotes from the federal complaint reveal talk but no action. They include the governor talking, sometimes using foul language, about how to benefit from appointing a senator, withholding state money from a children's hospital unless he got a political donation, and pressuring the Chicago Tribune to fire editorial writers.

"It's just talk. That's what it is. Unfortunate talk, talk that shouldn't have been made, perhaps. But not actions," Genson said.

The committee has also reviewed misconduct allegations including claims that Blagojevich unconstitutionally defied legislative decisions, spent money without proper authority and impeded audits of his administration's activities.

If Blagojevich were impeached, the state Senate would then hold a trial to decide whether he's thrown out of office.

Subpoenas released Monday by the Better Government Association show that federal investigators looking into possible hiring fraud in Blagojevich's administration asked for the personnel files of more than a dozen people.

The 2006 subpoenas show investigators even sought documents and computer files that date from Jan. 1, 2003 _ 12 days before Blagojevich was inaugurated.

"It appears the feds are looking at literally every aspect of how he exercised his authority, whether it was legitimate or not," said association executive director Jay Stewart.

The Chicago-based watchdog group sued for the documents after the Blagojevich administration denied a Freedom of Information Act request. A state appeals court ruled last month that Blagojevich had to comply with the request.

Why do you think Gensen is using Obama's report to clear his client? It's subtle way of suggesting this was all talk & further action against Blago will implicate Obama's staff.

Remember, these people are cronies: Emanuel, Obama, Resko (convicted of federal corruption charges, &sold discounted land to Obama for his multi-million mansion, &who deals with gov's wife, realtor Patty Blagojevich. Emanuel took Blago's HouseRep seat when he won Governor & Fitzgerald'. The wire taps were in place before Obama ran for Pres. Look carefully, Blago's atty wants to subpeona Emanuel &Jarret, furthermore the Fitzgerald team interviewed Obama, Emanuel, Jarret, &Jackson Jr. &taken their statements.
And don't be fooled by Fitz saying this or that person not target of investigation. On the surface that looks like these people are clean, but Fitz really means something else: they are not object of *Blago* investigation
Finally, we must remember the president -elect denied knowing about Wright offensive sermons only to admit he did know later on, same thing with Resko he didn't realize he was under federal investigation and then again later said he did, now he started this whole thing saying **no** contact whatsoever with Blago, but now he's saying something different b/c in fact Emanue spoke with Blago more than 1x about Obama's replacement. Folks these aren't mistakes of speaking they are out & out lies!

Genson is the epitome of what's bad about criminal defense lawyers. He feels that he can twist the system any way he wants. He fails to remember that the hearings on whether to recommend impeachment or not are (a) NOT a trial, so rules of evidence do not apply and (b) are based on FAR more than what the government has on Blagojevich. Our dear plastic-haired governor has, for a long time, ignored the wishes of the people and of our legislature, passing executive orders that are subsequently struck down by the courts (by which time they've cost the state millions of dollars). Like Bush and Nixon, he feels that whatever he does cannot be illegal, because he is the governor. What bills he does sign into law are mainly "grandstanding" bills that do flashy things like give senior citizens free bus & train rides, not taking into account the lost revenue for transit agencies that now is resulting in fare hikes for everyone else. He is ill-equipped for his role and, if we had a recall statute on the books, we'd have voted him out long ago.

Solicitation of a bribe is itself a crime. The bribe itself doesn't have to happen for the Gov to be charged, impeached and convicted. So it's not quite politics as usual. Smart politicians simply imply that they want something in return for something else. They're not foolish enough to come out and demand it -- in cash!

Blago was not doing anything that is beyond what is ALWAYS done by the politicians, namely soliciting campaign contribution and bargaining behind the scenes. It was just a conflict between Rahm and Blago about who gets to appoint the Obama replacement. Blago had a formal right to do that, but Rahm was feeling lucky..

Much like any lawyer... you have evidence "A" and they want to talk about evidence "Z"... when you get to evidence "Z", they want you to think that it doesn't matter....

They will drag their feet, they will want to show so-called-proof of nothing illegal, which any resonable person can see that its not the case nor do the matter of the content apply to the hair helmeted one... just like how they want to show Obama's involvement as their innocents.­.. all that shows is the Obama did nothing wrong.

I agree and Blago will eventually resign. Right now, he is just or should I say STILL holding out for the best deal no differently than in those phone calls when he was asserting "pay for play". The same game is being played now with Fitz and the courts by Blago. The stakes are just higher now, a get out of jail card and/or leave the governorship. Either way, it seems Blago still has them by the you-know-what.

After reading that report, no one will think that it clears Blagojevish. The report contain some comments that he made that might hurt him - e.g. making comments like he wanted more than an appreciation if he has to choose someone from Obama's recommended list.

The person I blamed seriously in all these is Fitzgerald, he rushed to judgement too early; it is obvious that the Gov. was upto something regarding Obama's seat. Fitzgerald would have waited a little longer for the deal to go through, for an appointment to be made by the Gov. and since they will have everything on wire, it would have been more easier. The person appointed under that circumstance would have either resigned from the Senate in shame or face the rant of his/her colleagues in the Senate.

Right now, this case is very fluid, the way I look at it, is that it is just like accusing someone of saying that, he is going to "steal", that in itself does not constitute a crime. If this go to trial, I will watching very closely espentially after-the-trial analysis and Jury interview with the media to see what they looked at.

I disagree. Fitzgerald is extremely thorough, he's not one to rush into charges and allegations.

I believe there is more to this story than what has been disclosed. Fitz's got more in his cards.

I had read somewhere that the Sun Times (I think?) had the story and sat on it for one week before running it. This forced Fitzgerald's hand to move on the case since efforts to listen in would be fruitless.

That was the Chicago Tribune that sat on the story for a week. Considering that a shakedown of the Trib was in the works, I think I get that (though their coopration with the feds makes me a little queasy.).

Maybe Fitz did rush to judgment but can you imagine the scandal, if say, Jesse Jackson was appointed Senator and then the scandal came out?

My understanding is that there has been a massive push by Blago to collect contributions before people awarded state contracts couldn't contribute any more due to new ethics rules. I think he's been caught dead-to-rights on several counts regardless of conviction on the Senate point in specific.

The senate appointment had risen to the point where Blago's actions would directly impact a constitutional branch of the federal government. Though political fallout probably would cause an appointment to resign under the circumstance, if they decided to play hard ball like Blago and fight for the seat - it would have been a serious dereliction of duty if Fitzgerald had let it happen knowing the appointment would be the result of a criminal act.
