ST. PAUL, Minn. — A top Senate Republican said Friday his caucus would block any attempt to seat the winner of Minnesota's close election until an anticipated court case is finished and an official election certificate is issued.

Pending the counting of hundreds of unopened absentee ballots, Democrat Al Franken holds a 49-vote lead over incumbent Republican Sen. Norm Coleman, whose term expires at noon EST Saturday.

Minnesota's other senator, Democrat Amy Klobuchar, has said the man with the most votes after the recount concludes should be seated while legal matters play out. Franken hasn't discussed his intentions.

The new Congress convenes Tuesday. A court challenge and possible appeals could keep the Franken-Coleman contest unsettled for several months. Hundreds of uncounted absentee ballots are due to be opened and examined Saturday, and the Canvassing Board had hoped to wrap up its work by Tuesday.

Sen. John Cornyn of Texas, the incoming chairman of the National Republican Senatorial Committee, told reporters Friday that Republicans would object to seating anyone before the already lengthy process is finished.

"I can assure you that there will be no way people on our side of the aisle will agree to seat any senator provisionally or otherwise unless there is a valid election certificate and all legal issues about who got the most votes is finally decided," Cornyn said.

If even a single Republican were to object to a bid to seat Franken, Senate Democrats would have to come up with 60 votes to call the vote. Counting two independents who align with them, Democrats will have 58 or 59 seats in the incoming Senate, depending on the resolution of the Minnesota race.

On Friday, counties were finishing sorting envelopes containing previously rejected absentee ballots that could still tip the race.

Jim Manley, a spokesman for Senate Majority Leader Harry Reid, declined to comment on what lies ahead. He would only say, "It's important that we wait for the Canvassing Board decision."

The Supreme Court said Friday it needs more information before it can rule on a Coleman petition to add more ballots to the recount. The justices asked several county auditors, the secretary of state and Franken's campaign to supply data by Saturday morning on unopened absentee ballots that might have been mistakenly left out of the counting. The justices said they hadn't decided yet whether they will give the petition a full airing.

Election officials around the state have spent the week conferring with campaign representatives about 1,350 sealed ballots that didn't get counted Nov. 4 but which may have been excluded in error. Under a Supreme Court order, all sides had to agree that an absentee ballot was incorrectly rejected before it could be forwarded to the state for counting.

Republican Gov. Tim Pawlenty said during his weekly radio show that the process may be flawed because the campaigns have so much power to keep ballots out.

"It seems odd that you would turn over somebody's legal right to vote to the campaigns," he said.

Any lawsuit challenging the outcome must be filed within a week after the state board declares the count over. Once a lawsuit is filed, there is a 20-day window for a special three-judge panel to hear the case. There is no deadline for the judges to rule. Appeals would add weeks or months.

Coleman attorney Fritz Knaak said such a lawsuit is certain.

"An election challenge here is inevitable. Whether we bring it or the Franken campaign brings it, there is no doubt in my mind," he said.

I have an image in my head of Coleman's phone ringing off the hook with RNC big wigs offering him big bucks to continue to contest this race, even though he has no hope of winning. They just want to gum up the works for Obama as much as they possibly can.

Final tally:

Franken is up by 223 votes. And we KNOW Coleman is going to court. Even with his lawyers on-site challenging ballots..... it won't matter.

It should be interesting to see what convoluted reason Coleman comes up with.

It really makes me mad knowing that Coleman is going to tie this up in court even though there is no way he can overcome Franken's lead. That is just so childish, but what do you expect from Republicans.

The U.S. Senate could send a strong message that it will not put up with delay. It could announce that it will seat a senator from MN on January 6 based on its own judgment of the likely winner.

Unfortunately I think you are wrong. Even though Coleman would not win if both his challenges were approved (which is highly unlikely) he will still bring a court challenge just for spite.

And there are still about a five hundred Coleman challenges on the remaining absentee ballots that the Canvassing Board will have to review. I suspect that Franken will go up by well over 300. And by then nothing that Coleman can do will result in him winning. It'll be moot.

Counting of the 900+ wrongly disallowed absentee ballots is done. Franken is now ahead by 223.

Time for Coleman to concede. Even if he wins all his challenges, he can't overcome that lead.

Perfect example of how votes should be counted electronically, without bias, instead of having one party manufacture votes after the election is over.

By the by, is this the same Franken who used to show up drunk every now and then on Air America? The same Franken who threw a chair at a talk show host because he was asked a question he couldn't answer?

Having lived in Minnesota and now in Wisconsin. Anyone in the Mid-West knows Minnesota is no Florida. They do things right! They know how to run an election and they will not put up with any nonsense.

The GOP didn't say much when it was Gore vs Bush, now did they?

Simply put ,they sent aides (Tom Delay) to Florida to stop the vote in 2000. I see how it works, it's OK when they are losing to insist on a law suit. Everyone should get that right??????

The GOP will lose even more if they pursue this into the courts after Minnesota certifies Franken.

Actually, this is incorrect. There are only 98 sitting Senators so it will only take 59 to break a filibuster. The Democrats have 57 so they will only need two Republicans to break the filibuster.

I don't like absentee voting and mail-in voting. It is better to find ways for people to vote at polling places. Having the candidates be able to see the signatures of voters and decide whose votes to count is strange.

So, would you rather have everyone be forced to vote on a machine that can easily be hacked to flip votes?

I live in Oregon where we all vote by mail and it works just fine. You can vote up to three weeks before the election and most people vote early. This gives the people running the election sufficient time to compare signatures on the ballot envelope and registration card. And if they see any big difference in the signature, they call the voter to find out what's up. Frequently they find that the person filling out the ballot has suffered a stroke or some other disability that would affect their signature.

I think that Congress should pass a law standardizing federal elections and require that all states vote by mail. That will take away the Republican's ability to 1) disenfranchise voters at the polls and 2) flipping election results in hacked voting machines.

I live in Oregon and we all vote by mail. It works great. NO muss no fuss, zero ability of the Republicans to try to disenfranchise me once I get to a polling place. The vote counters compare my signature on the outside envelope and if it matches, good. If not, they will call the voter to see what's up. Frequently they find things like the voter is ill, had a stroke or some other thing that affects their signature.

I would like to see Congress pass a law saying that all Federal elections have to be held by mail-in ballot. That way all the votes would be standardized and there will be less chance for disenfranchising voters.
