ST. PAUL, Minn. — A top Senate Republican said Friday his caucus would block any attempt to seat the winner of Minnesota's close election until an anticipated court case is finished and an official election certificate is issued.

Pending the counting of hundreds of unopened absentee ballots, Democrat Al Franken holds a 49-vote lead over incumbent Republican Sen. Norm Coleman, whose term expires at noon EST Saturday.

Minnesota's other senator, Democrat Amy Klobuchar, has said the man with the most votes after the recount concludes should be seated while legal matters play out. Franken hasn't discussed his intentions.

The new Congress convenes Tuesday. A court challenge and possible appeals could keep the Franken-Coleman contest unsettled for several months. Hundreds of uncounted absentee ballots are due to be opened and examined Saturday, and the Canvassing Board had hoped to wrap up its work by Tuesday.

Sen. John Cornyn of Texas, the incoming chairman of the National Republican Senatorial Committee, told reporters Friday that Republicans would object to seating anyone before the already lengthy process is finished.

"I can assure you that there will be no way people on our side of the aisle will agree to seat any senator provisionally or otherwise unless there is a valid election certificate and all legal issues about who got the most votes is finally decided," Cornyn said.

If even a single Republican were to object to a bid to seat Franken, Senate Democrats would have to come up with 60 votes to call the vote. Counting two independents who align with them, Democrats will have 58 or 59 seats in the incoming Senate, depending on the resolution of the Minnesota race.

On Friday, counties were finishing sorting envelopes containing previously rejected absentee ballots that could still tip the race.

Jim Manley, a spokesman for Senate Majority Leader Harry Reid, declined to comment on what lies ahead. He would only say, "It's important that we wait for the Canvassing Board decision."

The Supreme Court said Friday it needs more information before it can rule on a Coleman petition to add more ballots to the recount. The justices asked several county auditors, the secretary of state and Franken's campaign to supply data by Saturday morning on unopened absentee ballots that might have been mistakenly left out of the counting. The justices said they hadn't decided yet whether they will give the petition a full airing.

Election officials around the state have spent the week conferring with campaign representatives about 1,350 sealed ballots that didn't get counted Nov. 4 but which may have been excluded in error. Under a Supreme Court order, all sides had to agree that an absentee ballot was incorrectly rejected before it could be forwarded to the state for counting.

Republican Gov. Tim Pawlenty said during his weekly radio show that the process may be flawed because the campaigns have so much power to keep ballots out.

"It seems odd that you would turn over somebody's legal right to vote to the campaigns," he said.

Any lawsuit challenging the outcome must be filed within a week after the state board declares the count over. Once a lawsuit is filed, there is a 20-day window for a special three-judge panel to hear the case. There is no deadline for the judges to rule. Appeals would add weeks or months.

Coleman attorney Fritz Knaak said such a lawsuit is certain.

"An election challenge here is inevitable. Whether we bring it or the Franken campaign brings it, there is no doubt in my mind," he said.

Exactly. Guess Coleman's lawyer is better than Al's. After all, the reports indicate the remaining ballots should favor Franken due to the votes county of origination. The only certainty is that Coleman should not be allowed to go up the Hill on Tuesday. His term expires Sunday night.

Waiting for election certification is appropriate. That should happen next week.

Waiting for all the litigation to be settled - no. If you take that position you might never seat a senator. Why does not someone file a frivolous lawsuit arguing that Cornyn is not eligible to be a senator because he is spawn of extraterrestrials. Refuse to seat him until the lawsuit is settled.

Actually, this whole birth certificate schtick might work out even better. Challenge every member of the MINORITY PARTY (I love saying that!) to not only produce a birth certificate, but then go on to prove that it is the actual original and could not possibly be a forgery. Insist on chain of custody from the nurse that slapped their little rear end through every records clerk and night watchman at the county clerk's office from the time of their birth right up until last New Year's Eve. And THEN renew and supplement the demand every 15 minutes after that because, after all, you never know!

There is a need to wait for recounts, because you need to certify the election. But the recount is finished, the election will be certified next week. There is no need to wait for the lawsuits that argue that the election board acted inappropriately. If those lawsuits win they can throw Franken out of office. But there is no need to allow the republicans to just delay seating him on a hope they can pull a rabbit out of a hat.

There is absolutely no reason for Coleman to have his seat after today.

Arrest him and burris since they're both Dems? We don't live in a country where people can be arrested because they're members of a certain party. Granted, Rolland Burris while being a generally good person, has made a mistake in accepting the appointment to the Senate seat. But arrest them because they're Democrats? UNOPENED Absentee Ballots? What on earth excuse does MN have to have not finished opening all of the absentee ballots? Sure, they've had to recount the regular ballots as well, once the totals hit recount range, but they should have finished the absentee ballots in the first week.

In 2005, when Democrats said they would filibuster some of President Bush's judicial nominees, Republicans threatened to change the rules of Senate proceedings to disallow filibusters on judicial nominees using the argument that each new Senate, under Article I, Section 5 of the Constitution, may determine its own rules with a simple majority vote of the Senate. They referred to this as the "nuclear option" or the "constitutional option." That threat was waylaid by an agreement of the "Gang of 14." (see link)

Here is an article by Ronald D. Rotunda of the Cato Institute arguing for the legitimacy of the "constitutional option" of each new Senate to set its own rules with a simple majority: "The Filibuster" by Ronald D. Rotunda. He cites the following as precedent: In 1975, the Senate, under the leadership of Sen. Mike Mansfield (D-MT), concluded that it only required a simple majority of the Senate to change its rules, and after doing so, proceeded to change the cloture requirement from 67 votes to 60 votes.

Using the same argument, it seems that the new Senate, with a simple majority vote, could change any of its Senate rules, including any rules governing filibusters.

During Senator Durbin's speech in June 2008, he countered Senator Kyl's points by referring to a staggering statistic;

the Republicans of the US Senate have performed 77 filibusters during the current session.

This count breaks the previous record of 58 filibusters previously held by the 1999-2002 Senate terms. Durbin stated,

I dare say that the Republicans would not have performed 77 filibusters during the current session if Harry Reid had required them to actually perform a real filibuster as opposed to letting them off easy with a procedural filibuster. In a procedural filibuster, all the Republicans have to do is say they have 41 votes against a bill and intend to filibuster. That's it. No sweat. And Reid lets them get away with it. He does have the authority, under Rule 22, to require an actual filibuster by continuous speechmaking on the Senate floor if he so chooses.
