ST. PAUL, Minn. — A top Senate Republican said Friday his caucus would block any attempt to seat the winner of Minnesota's close election until an anticipated court case is finished and an official election certificate is issued.

Pending the counting of hundreds of unopened absentee ballots, Democrat Al Franken holds a 49-vote lead over incumbent Republican Sen. Norm Coleman, whose term expires at noon EST Saturday.

Minnesota's other senator, Democrat Amy Klobuchar, has said the man with the most votes after the recount concludes should be seated while legal matters play out. Franken hasn't discussed his intentions.

The new Congress convenes Tuesday. A court challenge and possible appeals could keep the Franken-Coleman contest unsettled for several months. Hundreds of uncounted absentee ballots are due to be opened and examined Saturday, and the Canvassing Board had hoped to wrap up its work by Tuesday.

Sen. John Cornyn of Texas, the incoming chairman of the National Republican Senatorial Committee, told reporters Friday that Republicans would object to seating anyone before the already lengthy process is finished.

"I can assure you that there will be no way people on our side of the aisle will agree to seat any senator provisionally or otherwise unless there is a valid election certificate and all legal issues about who got the most votes is finally decided," Cornyn said.

If even a single Republican were to object to a bid to seat Franken, Senate Democrats would have to come up with 60 votes to call the vote. Counting two independents who align with them, Democrats will have 58 or 59 seats in the incoming Senate, depending on the resolution of the Minnesota race.

On Friday, counties were finishing sorting envelopes containing previously rejected absentee ballots that could still tip the race.

Jim Manley, a spokesman for Senate Majority Leader Harry Reid, declined to comment on what lies ahead. He would only say, "It's important that we wait for the Canvassing Board decision."

The Supreme Court said Friday it needs more information before it can rule on a Coleman petition to add more ballots to the recount. The justices asked several county auditors, the secretary of state and Franken's campaign to supply data by Saturday morning on unopened absentee ballots that might have been mistakenly left out of the counting. The justices said they hadn't decided yet whether they will give the petition a full airing.

Election officials around the state have spent the week conferring with campaign representatives about 1,350 sealed ballots that didn't get counted Nov. 4 but which may have been excluded in error. Under a Supreme Court order, all sides had to agree that an absentee ballot was incorrectly rejected before it could be forwarded to the state for counting.

Republican Gov. Tim Pawlenty said during his weekly radio show that the process may be flawed because the campaigns have so much power to keep ballots out.

"It seems odd that you would turn over somebody's legal right to vote to the campaigns," he said.

Any lawsuit challenging the outcome must be filed within a week after the state board declares the count over. Once a lawsuit is filed, there is a 20-day window for a special three-judge panel to hear the case. There is no deadline for the judges to rule. Appeals would add weeks or months.

Coleman attorney Fritz Knaak said such a lawsuit is certain.

"An election challenge here is inevitable. Whether we bring it or the Franken campaign brings it, there is no doubt in my mind," he said.

Republicans still think they matter. Force them to fillibuster, I mean actually standing on the floor and talking. None of this nonsense of letting them defeat cloture and they win.

With only 41 seats, Republicans should be unable to block Franken and Eric Holder like they threaten. Force the Maine Senators to vote against Obama openly.

IN GENERAL, whenever the Rethugs threaten to filibuster, we need to call their bluff and make them do it--not just withdraw from the mere threat.

There has been many a time lately where Dem leadership allowed them to obstruct us on the mere threat of a filibuster, when making the obstructionists stand up there and defend their indefensible positions would have made them look petty and wrong. Much public favor would have shifted to the left after putting GOP obstructionism on prominent display.

They want to filibuster? Let 'em GO AHEAD! But do it the traditional way. where they have to stand up there and show themselves to be obstructionists. Then maybe the general public would understand WHY the Dems haven't done much since their slim majority was seated in '07. (Hint: all-time record filibusters by the minority.)

Here we go. You can expect the Republicans to try obstructionist tactics again. Reid should call them out and make them filibuster. Then he should call a news conference and explain what the GOP is doing. The conservative way is to scream bloody murder. If it was the opposite way around they'd be screaming that freedom and voting is being undermined. It doesn't matter what the Dems do, the GOP will act like the injured party. Give them something to squeal about like the pigs they are.

The Dems in the Senate need to actually make the Rethugs go through with a true filibuster for once. The fact is the Rethugs just threaten filibuster and never really have to proceed with it. A true filibuster means Rethugs have the hold the floor up with debate until a 60 vote majority is reached. In the old days the party in power would actually lock down the Senate until debate ended and if they did not reach 60 (66 a while ago) they would make the opposition party stay in on the floor and continue to debate indefinitely. Now all the tro//s have to do is bluff a filibuster not actually perform one.

i can't imagine the Republicans could really do that. How could they schedule everyone with their dinners at the country club, tee times, squash matches, Klan meetings, etc. to contend with. When the Dems threatened filibuster, the Rethugs threatened to do away with the filibuster. It's time to play hardball with these gangsters: If they filibuster Franken, refuse to seat David Vitter, consort of prostitutes. Or, just do away with the filibuster. That will give them something to think about.

And for G-d's sake, get a leader with a backbone and send Harry Reid back to his seat. Someone who will go to the media hourly to complain about how the Rethugs are holding up the business of the Senate. No, instead these fools are going to keep Burris out because he's supposedly tainted by association with Blagojevich! I'd say they deserve to be kicked around, but it's the only party we've got! I want Joe Cornyn to imagine the media actually was as "Liberally biased" as Republicans whine. Wouldn't such a media point out that they didn't wait until "all legal issues about" whether George W. Bush "got the most votes is finally decided?" Why should Al Franken's mandate be any more dubious than Dubya's? I mean apart from Franken's being a Democrat?

Thank goodness for the re-count and all those "found" Franken ballots. Otherwise, Franken would be back on Air America, oh wait, there's not much of Air America left. Minnesota makes Florida look like a well oiled voting machine.

The Minnesota recount was required by law and has been carried out with extraordinary care and transparency. You can even go online yourself and see a high-res photo of EVERY disputed ballot.

Insofar as there were any "found" ballots heavily benefitting Franken--a claim which is beyond dubious--one wonders who managed to "lose" them in the first place.

Now be a good lad and repeat after me: "Senator Al Franken."

Music to my ears! Now run along and listen to some more right-wing radio so you'll know what to type on here tomorrow.

Fortunately, Coryn doesn;t get to decide. Once the Minn board certfies Fraken the winner, what happens in court is rather besides the point and if Republicans want to fillibuster after a winner has been certified hopely Reid will let them.
