WASHINGTON — Senate Democratic leaders plan to grant few if any privileges next week to Roland Burris, the man picked by Illinois Gov. Rod Blagojevich to represent the state in the Senate, even if Burris arrives on Capitol Hill with the proper credentials.

Senate officials involved in the tangle of legal and logistical planning said Friday that a Democrat will object to Burris being duly sworn with the rest of his class and will propose that his credentials be reviewed for a period of time by the Rules Committee.

That would give Burris the status of a senator-elect to the seat vacated by President-elect Barack Obama in the juiciest of several dramas swirling around open Senate seats days before the 111th Congress convenes.

Senate Democrats are slow-walking Burris' appointment because they hope Blagojevich will be removed from office before the Rules Committee completes its investigation.

As early as next week Blagojevich _ federal authorities accuse him of offering to sell the appointment to the highest bidder _ could become the state's first chief executive to be impeached. A state Senate trial would follow and if he were convicted, Blagojevich would be removed from office.

For his part, Burris planned to argue his case in the news media and threatened to sue Senate Democrats if they refuse to swear him in as the chamber's only black member.

Race is a prominent force in the dispute. Rep. Donald Payne, D-N.J., said he called Majority Leader Harry Reid of Nevada and Sen. Robert Menendez, D-N.J., and "made it abundantly clear that we felt that they should reconsider."

No luck, Payne reported on Friday.

"I have heard no one say that they felt that he is not qualified," Payne said. Race would not be a factor, he added, were there black members of the Senate. "There is a legitimate opportunity to have the Senate at least start to look a teeny bit like America."

Democrats have said that their opposition to Burris is not about Burris but the fact that anyone appointed by Blagojevich would be tainted by the corruption charges against the governor.

And they're not budging, despite significant questions about whether they have the legal standing to block an appointee of a sitting governor.

The only way Burris will be allowed on the floor, according to Democratic officials who asked not to be identified, is if he possesses a certification of appointment signed by Blagojevich and Illinois Secretary of State Jesse White.

Burris would then be treated as a senator-elect, which by tradition means he'll be allowed on the Senate floor without voting or speaking privileges _ and he wouldn't be granted a desk, according to the officials. They requested anonymity because they weren't authorized to speak publicly on the matter.

The man charged with letting people through the door of the chamber, Senate Sergeant-at-Arms Terrance Gainer, said he expects the two sides to work out a deal before Tuesday.

Gainer has known Burris since their days in Illinois law enforcement, when Burris was attorney general and Gainer was the director of the state police.

"He is a good man," Gainer said in a telephone interview. "He plays by the rules. I don't think there's going to be a confrontation."

Republicans have been wary about commenting, pleased to see Democrats mucking through a political mess of their own party's making.

But Republican Whip Jon Kyl of Arizona said Friday that he wants to review state and federal law before opining on whether Burris should be seated. Still, he questioned whether the legal status of the patron is enough reason to block the appointee.

"The Senate has to be very careful of setting a precedent that just because it doesn't like the governor that appointed (Burris) we therefore refuse to seat a qualified appointee," Kyl said in a telephone interview.

Not that Republicans are against blocking people from being seated. Another Republican leader, Sen. John Cornyn, R-Texas, told reporters Friday that he would object to seating any new senator from Minnesota until an anticipated court case is finished and an official election certificate issued in the battle between Republican Sen. Norm Coleman and Democrat Al Franken.

In contrast, nobody's objecting to Denver Public Schools Superintendent Michael Bennet, who is expected to be named to replace Sen. Ken Salazar, D-Colo., set to be Obama's interior secretary.

In the Illinois case, Senate Democrats believe the Constitution and their agenda-setting power give them the tools for a slow-motion rejection of Burris' credentials if they are not signed by both the governor and White, who has refused to certify anyone Blagojevich appoints.

If Burris appears at the Capitol with his certification signed by Blagojevich and White, the officials said, Burris would be permitted on the Senate floor.

Vice President Dick Cheney, as president of the Senate, would then ask whether anyone objects to the senators-elect being duly sworn. A Democrat would object and propose that Burris' credentials be referred to the Rules Committee for an investigation. If no one objects to that motion, the credentials go to the panel for a period of perhaps 90 days.

In the meantime, Burris gets the privileges of an unsworn senator-elect. The Senate's unofficial customs and traditions leave unclear whether that status would come with a pay check, but Burris could be accorded a stipend for staff and given office space.

What the Dem. need to do is hold a special election to fill this Senate seat. With their racism showing and the blacks feelings hurt this will in most cases cause a Republican to win this seat in an election. The Dem. have cut their noses off to spte thir faces.

Though Burris has been, technically, legally appointed to the Senate seat, the fact that he hasn't won an election in the past 18 years, in the several contests he's entered (including one for the Senate), and the following, may not make him a great loss if he's not seated:

I don't think it's up for debate that whether or not he's convicted, Blago isn't the best guy to be appointing Senators.

That said, he's not convicted (or even indicted) on any charges. He's the sitting governor. He has the legal authority to appoint a replacement Senator. The guy he picked has done nothing wrong and seems to be reasonably capable. The State of Illinois is entitled to representation by 2 Senators. I don't think you can do anything but show the new Senator from Illinois to his office at this point.

The Governor of Illinois has the sole legal authority to appoint a replacenment for Obama. He has not been found guilty in a court of law. I would love to hear the tape recording of Reid attempting to influence Blago regarding the appointment. We are a nation based on the rule of law. Obama, Reid, Durbin and the politicians in Illinois do not pre-empt the lawful authority of the Governor. The Democrats in Illinois are silly for the in- fighting over the position. The Democrats in Washington are silly for fighting their own Democratic appointment to the Senate. By the way the Governor of New York is legally authorized to make the appontment to replace Hillary Clinton, as is the Governor of Colorado authorized to replace the Senator from Colorado . Why is there such an uproar over the African American appontment to the Senate rom Illinois? There is not a politician worth his/her salt that would turn down an opportunity to become a Senator. Politics is not a place for wimps. Those who are willing to stand and fight succeed. Obama fought for the Presidency. Had he not fought for it , he would have been pushed back and out. The race card has always been played against Blacks, Blacks have always had to fight for entrance into the political system. The rule of law will prevail over veiled racism. It always has.

He lost a total of five elections, and never got past a primary. He was last elected for public office in 1990, just over 18 years ago. He has been a lobbyist/ lawyer/ consultant, and has received more than $700,000 in fees from the State of Illinois, under Blago. He has reportedly donated $14,000 to Blago's campaigns.

Why because Burris is an African American? You obviously don't know a thing about him. He wasn't anything special during the time in which he served the State of Illinois in more than one capacity..­.didn't do any harm but didn't do much good either. Blago is a crook and Burris was talking to Blago about this senate seat BEFORE Blago go arrested for trying to sell it. I for one, wrote to Harry Reid asking him NOT TO SEAT ANYONE OF BLAGO'S CHOOSING..­.which is my right as a resident of Illinois. Don't tell us who should be representing our state...th­at's our choice thank you very much and RACE has nothing to do with this. Danny Davis, who is an African American and a VERY GOOD MAN, turned Blago down when it was offered to him FIRST! If Burris is such a great catch why was he SECOND choice? Danny had the good sense to see that ANY afilliation with Blago would be tainted and therefore said NO THANK YOU...too bad Burris doesn't have the same scruples as his counterpart Mr. Davis.

Nothing you write changes the fact that Blago had the legal authority to appoint Burris and the US Senate has no legal authority to block the appointment. The citizens of Illinois have not lost anything by Blago making the appointment. They did not have a right to vote for a temporary replacement. That right is Blago's and Blago's alone, in accordance with Illinois law and the US Constitution. Race may or may not have been a factor in the appointment. It also may be a factor in all of the objections to the appointment. Nevertheless, this is a country of laws and regardless of what Blago may or may not have attempted to do related to selling the appointment, in the appointment of Burris, he followed the law. The US Senate should do the same.

I think you think the other appointment of buffons by other governers is ok if they r whites. Of course being black matters when the senate is all white. I'm not black too but I believe in diversity.

QUALITIES being the keyword, although he has never questioned Kennedy's ( NY) QUALITIES, since they make a big issue to point out that Reid called Blagojevich as well as other governors who had Senate vacancies in their respective states.

Yet, when He (Reid) gets over to ILL., his worry is, Jackson, Davis or Jones to be appointed, fearing they'd lose to a GOP opponent in a future election."

It's called, reading between the lines, or something like that!?!

These guys (and gals) need to get their butts in gear, put this pettiness behind them, roll up their sleeves and get to work. This country is in serious trouble at this point and the sooner we get on it, the better. Wasting time, energy, and feeding the media's desire for tabloid news isn't going to make anything better.
