ST. PAUL, Minn. — A Minnesota board on Monday certified results showing Democrat Al Franken winning the state's U.S. Senate recount over Republican Norm Coleman, whose lawyer promised a legal challenge that probably will keep the race in limbo for months.

The Canvassing Board's declaration started a seven-day clock for Coleman, the incumbent, to file a lawsuit protesting the result. His attorney Tony Trimble said the challenge will be filed within 24 hours. The challenge will keep Franken from getting the election certificate he needs to take the seat in Washington.

"This process isn't at an end," Trimble said. "It is now just at the beginning."

Franken, a former "Saturday Night Live" personality, ended the recount up by 225 votes, an astonishingly thin margin in a race where more than 2.9 million votes were cast.

"After 62 days of careful and painstaking hand-inspection of nearly 3 million ballots, after hours and hours of hard work by election officials and volunteers around the state, I am proud to stand before you as the next senator from Minnesota," Franken said Monday in brief remarks to reporters outside his downtown Minneapolis condominium.

Coleman's campaign said he would make an appearance Tuesday in Minnesota. He was in Washington on Monday.

The recount reversed the unofficial Election Day results, which showed Coleman with a 215-vote lead.

Franken made up the deficit over seven tortuous weeks of ballot-sifting in part by prevailing on challenges that both campaigns brought to thousands of ballots. He also did better than Coleman when election officials opened and counted more than 900 absentee ballots that had erroneously been disqualified on Election Day.

Coleman's lawyers have argued that some ballots were mishandled and others were wrongly excluded from the recount, giving Franken an unfair advantage. The final blow came earlier Monday, when the Minnesota Supreme Court denied Coleman's petition to add hundreds more disqualified absentee ballots from Republican-leaning areas to the count.

Secretary of State Mark Ritchie was careful to note Monday that the board was simply signing off on the numbers found by the recount: Franken, with 1,212,431 votes, and Coleman, with 1,212,206 votes.

"We're not doing anything today that declares winners or losers or anything to that effect," Ritchie said.

All five members of the canvassing board _ Ritchie, plus two state Supreme Court justices and two Ramsey County judges _ voted to accept the recount results.

A lawsuit would extend the fight over the seat for months. Any court case would open doors closed to the campaigns during the administrative recount. They would be able to access voter rolls, inspect machines and get testimony from election workers.

The case would fall to a three-judge panel picked by Chief Justice Eric Magnuson of the Supreme Court. Magnuson served on the Canvassing Board, but declined to say Monday if he would remove himself from the selection process as a result. Magnuson was an appointee of Republican Gov. Tim Pawlenty.

The campaigns continued the political maneuvering that has marked the nearly two months of the recount.

Marc Elias, Franken's lead recount attorney, referred to his client as "Senator-elect Franken."

"Former Senator Coleman has to make a decision," Elias said. "And it is a profound decision, one that he has to look into his heart to make: Whether or not he wants to be the roadblock to the state moving forward and play the role of a spoiler or sore loser or whether he wants to accept what was a very close election."

"The race in Minnesota is over," said Senate Majority Leader Harry Reid, D-Nev. He called the Republican efforts to continue challenging Franken's election "only a little finger pointing."

A spokesman for Reid said there would be no effort to seat Franken when Congress convenes Tuesday.

Trimble, meanwhile, said that irregularities in the recount mean there "can be no confidence" in the results. And he said Coleman didn't want any delay in filing a challenge.

Minnesota law doesn't allow the issuance of a final election certificate until legal challenges are settled, meaning the state will be represented only by Sen. Amy Klobuchar, a Democrat, when Congress convenes on Tuesday. Coleman's term expired Saturday.

Glad to see the clarity with a open and stolen election.

Oh so now the person who said on Nov. 5, 2008 that if he were Franken, he wouldn't let state's financial resources be wasted on a challenge of election night's results, is now considering filing a lawsuit to challenge the election's results. So the say goes, do what I say...

Never mind.

And I don't think Coleman stands a snowball's chance of prevailing.

The Coleman campaign in particular wanted the recount process to reconsider 654 absentee ballots that local officials have maintained were correctly rejected because of errors. Local officials and the two campaigns had agreed to include 933 other absentee ballots that the counties said were improperly rejected, and when those ballots were counted over the weekend, Franken’s lead rose from 49 to the current 225 votes.

But the court, in an opinion written by Justice Alan Page, noted there is no agreement between the two campaigns over including additional ballots. The court had earlier required such unanimity.

“The record before us demonstrates that local election officials have acted diligently. ... The Coleman campaign contends there are 654 ballots, in addition to those identified by local elections officials, that should be examined, but the Franken campaign disagrees,” the opinion said.

“The Franken campaign has itself identified additional ballots that it contends may have been rejected in error, but the Coleman campaign disagrees.

“We take no position on the merits of either campaign’s contentions ... the merits of the dispute (and any other disputes with respect to absentee ballots) are the proper subjects of an election [court] contest.”

I find it rather peculiar that Coleman (when he was thought to be up by 215 votes) was calling on Franken to concede. Now that the roles have flipped, where are the calls for Coleman to concede??? If Norm Coleman cares about the great State of Minnesota he needs to accept the will of the people & his narrow loss & step aside to allow Minnesotans to be represented by Senator elect Al Franken (we can call him that now right)???

Coleman, like most Republicans, has a double standard.

He is expected to mount a court challenge, which could take months, and which he has veryl little chance of winning.

Who pays for all the lawsuits Coleman bring? Is it the people money , state, or what?

Coleman is worse than a hypocrit. The recount was part of MN election law. His lawsuits are just a real waste of taxpayer money. He tried others during the election that were similiar wastes of time.

Really, considering the FBI investigation on him, why does Coleman want this much of a spotlight on himself?

If this holds, Franken will:

A) dutifully serve the people of Minnesota (all the people of Minnesota, not just the Democrats of Minnesota)

B) never again be in the position to make the preposterous claim that W 'stole' 2000

A) Of COURSE all of Minnesota... & the US as well.

B) Why not?

Favorite    Flag as abusive Posted 04:39 PM on 01/05/2009

It's very simple.

Minnesota counted all the votes.

Florida didn't count all the votes.

Glad I could clear that up.

Favorite    Flag as abusive Posted 04:42 PM on 01/05/2009

Minnesota was so dutiful they even counted the votes in 25 precincts twice! Now that's being thorough...

That is SO WRONG. First, Al NEVER bought into the idea that the elections were stolen.

Second, this has no relation whatsoever to what happened in 2000--the NORC study PROVED that Gore won if all the votes were counted. The SCOTUS installed Bush.

Third, if any shenanigans EVER went on with our elections here in Minnesota it was because of the Republican operative evangelical fundie former SOS Mary Kiffmeyer--who we get RID OF in 2006. Mark Ritchie is a GREAT, HONEST, guy.
