CHICAGO — Just days before a high-stakes showdown in the nation's capital, the man selected to take President-elect Barack Obama's vacated U.S. Senate seat sought spiritual and political support on Sunday at a South Side Chicago church.

Warm words of support and prayers for Roland Burris contrasted with the frigid reactions from Senate leaders, many of whom say his appointment by embattled Illinois Gov. Rod Blagojevich is so badly stained that Burris shouldn't be seated when the new Congress convenes this week.

Burris took the stage at New Covenant Church on Sunday evening to a crescendo of drums, organ music and applause from hundreds of supporters, including black leaders and ministers.

"The appointment is legal," he said, thanking those gathered at the prayer service. "That is all there is. I don't know what all the confusion is about."

Before the service, Burris supporter U.S. Rep. Bobby Rush and about 60 ministers condemned Senate Democratic leaders for rejecting Burris.

Rush, a Chicago Democrat, called the Senate "the last bastion of plantation politics."

"We are just faced with a hard-headed room of people in the Senate who want to keep an African-American out of the Senate," Rush said.

The Senate's top two Democrats defended their right to deny the seat to Burris, while refusing to rule out a deal as Congress and its new members begin work this week.

Story continues below

Democrats say Burris' appointment is tainted because it was made by Blagojevich, who is accused by federal authorities of offering to sell the vacancy to the highest bidder. Burris, a former state attorney general, says the appointment is legal and the governor had the authority to do it. He has threatened to sue Senate Democrats if they refuse to swear him in as the chamber's only black member.

"Anything can happen," said Senate Majority Leader Harry Reid, D-Nev. But he described the chances of Burris joining the Senate as "very difficult."

The second-ranking Democrat, Illinois Sen. Dick Durbin, acknowledged that his governor has the state constitutional authority to fill the vacancy. "The Senate of the United States has the U.S. constitutional responsibility to decide if Mr. Burris was chosen in a proper manner and that is what we're going to do," Durbin said.

Burris said he is scheduled to meet with Durbin on Wednesday and possibly could meet with Reid the same day.

Obama has said he agrees with Senate Democrats. But Burris told AP Radio on Sunday that he feels support from Obama.

"He's gotten some advice from other individuals and its not correct advice," Burris said.

While the Burris furor dominated public discussion, Illinois lawmakers quietly continued work that could lead to Blagojevich being removed from office.

Members of the Illinois House impeachment committee reviewed a 54-page draft summary of the allegations against the Democratic governor. Lawmakers said the summary did not include any recommendations on whether Blagojevich should be impeached. That will come after the panel finishes its fact-finding _ perhaps by the middle of this week.

The impeachment committee hopes to learn Monday whether it will be given access to some of the federal government's recordings of Blagojevich. It also wants Burris to testify about his conversations with the governor that led to the Senate appointment.

Burris intended to depart for Washington on Monday.

Reid said he expected to meet with Senate Republican leader Mitch McConnell of Kentucky on Monday evening in hopes "we can solve this issue on a bipartisan basis."

Democratic leaders, however, plan to afford Burris few, if any, privileges even if he were to come to the Capitol with the proper credentials. Senate officials have said a Democrat will object to Burris being duly sworn with the rest of his class Tuesday and will propose that his credentials be reviewed for a time by the Senate Rules Committee. That would give Burris the status of a senator-elect and buy some time as Democrats hope Blagojevich will be removed from office before the committee completes its investigation.

Also Sunday, Reid denied a published report that he told Blagojevich in early December that he opposed the appointments of Democratic Reps. Jesse Jackson Jr. and Danny Davis to the Senate seat out of fear they would lose the seat to a Republican in the 2010 general election. Reid also allegedly opposed Emil Jones, the powerful black leader of the Illinois Senate, on the same grounds.

"I didn't tell him who not to appoint. He's making all this up to divert attention," Reid said. "Anyone who suggests anything racial is part of the Blagojevich spin to take (attention) away from the corruption." The Chicago Sun-Times reported Saturday that in an early December call to the governor, Reid urged Blagojevich to appoint either Illinois Veterans Affairs chief Tammy Duckworth or Illinois Attorney General Lisa Madigan.

Reid appeared on NBC's "Meet the Press," while Durbin and McConnell were on "This Week" on ABC.

The Dems are beginning to look stupid. Blogo has the legal right to appoint someone to replace Obama. If Burris isn't tainted by the Blogo scandel and is qualified to serve then the Senate should seat him. If Franken has the most votes and is certified as the winner by Minnesota then he should be seated. The Republicans will do anything to prevent a clear and overwhelming Democratic majority in the Senate. They plan to obstruct everything they can and filibuster every chance they get. Republicans seem determined to NOT do what's best for the country. For them, it's party first and the US be damned.

Beginning? Since it takes 60 votes to stop a filibuster, and we will not have 60 Dem senators, the repubs will control everything unless Reid invokes the nuclear option, which he has every right to do. But of course, wimpy Reid will not. And the corporate media will not report the truth and will blame the Dems for everything. Harry Reid has got to go.

Right now, the nuclear option is to allow the Republicans to go ahead and filibuster. We can all watch the fun on CSPAN and it will be very clear who is being obstructionist. I'm tired of the Dems taking the fall for the Reps.

It's always helpful to read what the Constitution actually says.

Article I, Section 5 of the U. S. Constitution:
"Each House shall be the judge of the elections, returns and qualifications of its own members. . ."

thank you! I am so tired of people quoting the Powell case, that yahoo was elected, Burris is an appointment, which in my opinion definitely affords the Senate the right to judge if he was choosen in a proper manner.

note - the constitution says nothing about judging appointments... just elections, returns and qualifications... Reid has NO authority to delay or block appointment...

I don't know about you, but the thought of the Senate taking onto themselves the power to reject anyone they don't happen to like, or who has ever shaken hands with someone they don't like is horrifying.

The repubs have totally blown off the Constitution for the last 8 years. Why should we care what it says now?

Because we're supposed to follow the law of the land?
Because without the rule of law, we would have chaos?
Because that is the precious document written by our Founding Fathers?
Because we are supposed to be better than Republicans, not like them?

the constitutional qualifications being: age 35, US citizen, resident of the electing state.
elections, returns, lets add in appointment: Blago is the duly elected governor of Illinois and is required by the Illinois Constitution to appoint a replacement in the event that a senate seat becomes vacant.

reality - If the Senate manages to disqualify Burris then Blago needs to appoint another senator.

Harry Reid is going to let McConnell chime in on this with a suggestion for a special election which a Republican might win under the circumstances? Well, why not, he's been doing Republican bidding for 8 years. Why stop now?

Harry Reid is a conservative Democrat. His leanings - Mormon - are philosophically supportive of Republicans. He is a neo-liberal triangulator who provides his minority leader with privileges that he would not reciprocate if the tables were turned.

He will throw Franken under the bus for Burris. I find that absolutely despicable. Of course, I have found the DLC/DINO neo-lib leadership more than hard to stomach for a long time. They are the best friends that the GOP ever had.

Reid has completely lost it: "There's clearly legal authority for us to do whatever we want to. This goes back for generations."

Clearly???

Article 1, Section 5 of the Constitution gives Congress the power to be "judge of the elections, returns and qualifications of its own members."

Article 1, Section 3 lists those qualifications: "No person shall be senator who shall not have attained to the age of 30 years, and been nine years a citizen of the United States." The potential senator must also be an inhabitant of the state from which he or she is chosen.

NOTE: Nothing about legal appointments.

The "inhabitant" qualification has been bent frequently, a la Hillary and others. But surely Burris has resided in Illinois, he is over 30 years old, and he's a US citizen by birth. He has no legal problems of his own (of which we are aware).

Harry is treading on thin ice.

But since when has the Constitution constrained congress from doing what it wishes? Is there constitutional authorization for welfare programs, for example?

You're forgetting the U. S. Code.

The U. S. Constitution provides the basic legal framework of our government. The U. S. Code is the codification of the permanent federal law of the United States.

exactly. They cannot judge his election, as he was not elected, but they can judge the circumstances surrounding his appointment. And I believe that they have the grounds to do so.

I have never seen such lunacy. If Reid is an old trial lawyer, he should follow the law. No matter how despicable Blago seems, he is still the governor of Illinois. The law allows him to appoint the Senate replacement. The crazy part is that the governor of Illinois has not been convicted of a crime. In Reid's warped mind, a "cloud" makes the appointment invalid. Where is the precedent for such a determination? If that is the standard then there are several senators who should not be currently serving.

Most importantly, this is not a racial issue. It is a legal one. Follow the law. Even the so called law and order party are opportunists. The Republicans want a costly special election which they hope would favor them not because it is right thing to do. Any other time, they would be squawking about it being a fiscally unwise idea. Follow the law:

(10 ILCS 5/25‑8) (from Ch. 46, par. 25‑8)
Sec. 25‑8. When a vacancy shall occur in the office of United States Senator from this state, the Governor shall make temporary appointment to fill such vacancy until the next election of representatives in Congress, at which time such vacancy shall be filled by election, and the senator so elected shall take office as soon thereafter as he shall receive his certificate of election.

Of course he is reaching out to top Repubs. They are his best friend and masters. He falls over himself making sure they are happy. That should not change with the new congress. I am sure the Repubs will find it in their heart to keep another Democratic Senator out of the Senate. Of course Burris being seated is so much more important than the failing economy; Iraq; torture; FISA; Middle East policy, and 1000 quickly passed rule changes by the pretend cowboy that is currently president. This seating affects Reid's pride. He is really upset that Blogojevich released the fact that Reid was pushing for two white ladies and specifically said he did not want Jackson Jr. or Davis appointed. We need a leadership change. I wonder if Reid will vote with Obama or with the Repubs. If he votes with Obama will he have to apologize again to the Repubs.

Reid could be taking the heat of the new administration by doing everything in his power to get Burris and Franken seated, then let the legal chips fall where they may. Instead, he is trying to cut a deal with the opposition. With democrats like Reid, who needs Republicans? Reid, you are spineless, clueless, obsolete and replaceable. Do us all a favor and turn your leadership post over to someone who actually knows how to lead. Do it today.
