MINNEAPOLIS — New York Sen. Charles Schumer said Sunday that Democrat Al Franken is the clear winner in Minnesota's Senate race and should be seated as soon as possible. But a leading Republican lawmaker said calling the race for Franken would be premature.

Schumer, who until recently was the head of the Democratic Senatorial Campaign Committee, made his statement a day after Minnesota elections officials completed the re-count. The latest numbers showed Franken with a 225-vote lead over Republican Norm Coleman.

The state Canvassing Board is expected to certify the results of the re-count Monday, then there will be a seven-day waiting period before an election certificate is completed. If any lawsuits are filed during that waiting period, certification is conditional until the issue is settled in court.

"With the Minnesota recount complete, it is now clear that Al Franken won the election ... and while there are still possible legal issues that will run their course, there is no longer any doubt who will be the next Senator from Minnesota," Schumer said. "With the Senate set to begin meeting on Tuesday to address the important issues facing the nation, it is crucial that Minnesota's seat not remain empty, and I hope this process will resolve itself as soon as possible."

Sen. John Cornyn, the chairman of the National Republican Senatorial Committee, called Schumer's comments premature and troubling, since Schumer is the new chairman of the Senate Rules Committee, which has jurisdiction over contested elections.

"Senator Schumer will likely play a key role in determining who ultimately assumes this Senate seat," Cornyn said. "Pre-judging the outcome while litigation is still pending calls into question his ability to impartially preside over this matter when it comes before the Committee, as it most certainly will."

Coleman hasn't ruled out a lawsuit challenging the election results, claiming there were irregularities that gave Franken an unfair advantage. The Coleman campaign also has a petition pending before the state Supreme Court to include 650 ballots that it says were improperly rejected but not forwarded by local officials to St. Paul for counting.

The court has not said when it would rule in that case.

Senate Republican leaders have said the chamber shouldn't seat Franken until all legal matters are settled, even if that drags on for months.

Franken campaign spokesman Andy Barr said in an e-mail Sunday: "In terms of future planning, we're taking it one step at a time. The next step is the canvass board's meeting tomorrow, where we have every expectation they will declare that Al won the election."

How long does it take to count 650 damm votes. do it and shut them up for good. How long can the opposing party tie up a result once someone is declared a winner after an official recount?

I say that Harry Reid has one chance to redeem himself with me, and here it is. He needs to effect rule changes at the opening of the new Congressional session to require cloture majority of 55 votes. There is precedent for doing this and was the unraveling of the 67 vote majority that used to be needed. The Repubs would do this in a heartbeat, if they could. Then we could pretty basically ignore the as*hol*es and get on with the People's business without them. Just a thought, Harry.

Actually, the repubs wanted to do this but the gang of 14 made sure it didn't happen because it would be a toxic move. America is not a banana republic. Maybe you're not from here and you think this is a winner take all system but it isn't. To do that would promote the opposite of what you want. Besides Obama wouldn't support it. So there. You will have to learn to live with the opposition. And what happens when the dems become the minority?

There is a difference between opposition and obstruction. So, let's hope that during the most difficult times the country has faced in most of our lifetimes the Republicans don't obstruct for the sake of obstruction. Seat Al Franken. He won when the votes were counted. Why would you suggest in another post that Coleman should go down fighting? The votes were counted. He lost and Franken is about to be certified by the state of MN. Do you favor obstruction for the sake of obstruction like so many on the Right?

Last time I checked Blago was still officially the guv. Last time I checked the courts have not yet officially pronounced him as corrupt. He still has the constitutional authority to appoint Burris and BURRIS SHOULD BE SEATED.

Everything is in place, now, for a true Battle Royal over the issue of Al Franken taking his well-deserved seat in the Senate. At stake is ... one vote. One huge, Balance of Power shifting vote in the Senate.
Spotlight on Al Franken, please.
The idea that Our Man Al Franken would be elected to Senate and provide the vote that will take-away the power which the Republican's have enjoyed for so long is so frightening and repulsive to the Republican Senate Committee that they are making Norm Coleman their puppet to begin filing every possible objection that they can conjure-up, to get more votes counted or the results of election delayed ad-infinitum.
The GOP does not want Franken seated for anything put to a vote in Senate after President Obama's Inauguration, for as long as possible, so the GOP can still play hardball with any slim margin of power left without the tilt of one more Democratic vote.
Al Franken's VOTE!
Senator Al Frankin's Vote. His vote, NOT just for the people of Minnesota; but, for ALL Democrats and everyone who voted Democratic to oust the Republicans before the hole they were digging for us got too deep to crawl out from.
Seat Al Franken.
Seat Al Franken. Let "Seat Al Franken" become a battle cry as important as "Yes, we can!" and put Franken's vote to work in the Senate.
