MINNEAPOLIS — New York Sen. Charles Schumer said Sunday that Democrat Al Franken is the clear winner in Minnesota's Senate race and should be seated as soon as possible. But a leading Republican lawmaker said calling the race for Franken would be premature.

Schumer, who until recently was the head of the Democratic Senatorial Campaign Committee, made his statement a day after Minnesota elections officials completed the re-count. The latest numbers showed Franken with a 225-vote lead over Republican Norm Coleman.

The state Canvassing Board is expected to certify the results of the re-count Monday, then there will be a seven-day waiting period before an election certificate is completed. If any lawsuits are filed during that waiting period, certification is conditional until the issue is settled in court.

"With the Minnesota recount complete, it is now clear that Al Franken won the election ... and while there are still possible legal issues that will run their course, there is no longer any doubt who will be the next Senator from Minnesota," Schumer said. "With the Senate set to begin meeting on Tuesday to address the important issues facing the nation, it is crucial that Minnesota's seat not remain empty, and I hope this process will resolve itself as soon as possible."

Sen. John Cornyn, the chairman of the National Republican Senatorial Committee, called Schumer's comments premature and troubling, since Schumer is the new chairman of the Senate Rules Committee, which has jurisdiction over contested elections.

"Senator Schumer will likely play a key role in determining who ultimately assumes this Senate seat," Cornyn said. "Pre-judging the outcome while litigation is still pending calls into question his ability to impartially preside over this matter when it comes before the Committee, as it most certainly will."

Coleman hasn't ruled out a lawsuit challenging the election results, claiming there were irregularities that gave Franken an unfair advantage. The Coleman campaign also has a petition pending before the state Supreme Court to include 650 ballots that it says were improperly rejected but not forwarded by local officials to St. Paul for counting.

The court has not said when it would rule in that case.

Senate Republican leaders have said the chamber shouldn't seat Franken until all legal matters are settled, even if that drags on for months.

Franken campaign spokesman Andy Barr said in an e-mail Sunday: "In terms of future planning, we're taking it one step at a time. The next step is the canvass board's meeting tomorrow, where we have every expectation they will declare that Al won the election."

it really is time for reform in the both parties...al, can you help get rid of feinstein, pelosi and reid? We've already ditched William Jefferson and Blago....let's continue the clean up.

I don't know what Coleman is so up set about.
When this is all over he'll have be in a new house that's a lot easier to clean up than that big old place he is living in now..

The pissy Republicans are plotting their strategy for the day that Franken is seated in the Senate.
I have heard from an inside source that they plan to throw themselves on the Senate floor and hold their breath until they turn blue.
If that doesn't work, they're going to moon him.

Thank goodness the best man won! Minnesota is a very fortunate state indeed to have al Franken as their new senator. He will do great work for the people.

The diehard Re.pubs insist on playing their streetpunks' game trying to delay the inevitable. This is not year 2000, and they are impeding the Dem majority from handling the economic crisis and doing the people's business at their peril. They can be as sure as the sun rises in the morning that come election 2010, there WILL BE HELL TO PAY. The wrath of the people will clean their clock, and leave their scattered Re.pub remnants hanging from the ceiling, twisting in the cold wind for a generation.

As usual Harry Reid has it all wrong. He has ample cover to simply seat Burris and see where the chips fall. Burris seems clean and he's a democrat. No one likes who appointed him, but from my reading Blago was within his legal rights at this moment in time.

And now Reid may try to placate republicans by refusing to seat Franken till Coleman exhausts all legal options. This is so bass ackwards. This is the perfect opportunity to tell the republicans threatening to fillibuster if the dems seat Franken to have at it. The press would cover it ad nauseum, shining a klieg light on a bunch of guys fiddling while Rome burns. Why wait to finally show some cajones when the Republicans actually have an issue behind their threats?

Reid has precedent to fall back on with Landrieu being seated despite the legal wranglings in process. For the love of all that makes sense, why not do everything you can to seat two democrat senators sooner than later?

Once it is certified, it should be a done deal. Seat the new Senator to MN and move on. At least that would be the logical progression. We have so many other critical issues at hand that will require time and energy. Let's not create a log jam when we we have to be vigilant and expedient in some of the these issues.

We have tremendous tasks at hand, let's close the election of 2008, for starters!

I fervently hope that this donnybrook ends up in the US Senate. Al won. No doubt about it. Now should the GOP threaten to filibuster, why then, bring it on! They will be reading from the phone books while the country is taking an economic nosedive. How long do you suppose that disconnect from reality will survive? The more they drag their feet, the more vulnerable the next class of GOP senators up for election in 2010. And the House? There's no such thing as too great a majority and if the GOP rump in the Senate is patently stalling ... Do the Dems have the intestinal fortitude to call the GOP's bluff? It's no accident that governors and mayors are aghast at their budget crises and that impacts the whole polity, not just big cities.

Not quite sure why anyone would think Minnesota needs a special election... we here in Illinois need a convicted impeached governor (and, yes, Virginia, there IS a difference... being impeached does not convict you). Minnesota's embarrassment is Norm Coleman's continuing legal shenanigans; ours is our governor, the laughing stock of the nation.

In MN voters have already made the choice. As far as NY and IL goes, voters have a choice to change the law. Till they dont change the law, the law says that governor pick the guy. By the way you missed CO, there too it is same that governor pick the replacement.

We DID have elections. They were conducted on Nov. 4th, and they were special. The people in MN have spoken, it's just taken this long to get there.

Secondly, the law is written that the governor of each state is in charge of "appointing" a replacement of a vacated Senate seat during the mid-term for that open seat. Obviously, controversy clouds the state of Illionois at the moment.

Laws can be changed, but that's the way it plays out right now.
