MINNEAPOLIS — New York Sen. Charles Schumer said Sunday that Democrat Al Franken is the clear winner in Minnesota's Senate race and should be seated as soon as possible. But a leading Republican lawmaker said calling the race for Franken would be premature.

Schumer, who until recently was the head of the Democratic Senatorial Campaign Committee, made his statement a day after Minnesota elections officials completed the re-count. The latest numbers showed Franken with a 225-vote lead over Republican Norm Coleman.

The state Canvassing Board is expected to certify the results of the re-count Monday, then there will be a seven-day waiting period before an election certificate is completed. If any lawsuits are filed during that waiting period, certification is conditional until the issue is settled in court.

"With the Minnesota recount complete, it is now clear that Al Franken won the election ... and while there are still possible legal issues that will run their course, there is no longer any doubt who will be the next Senator from Minnesota," Schumer said. "With the Senate set to begin meeting on Tuesday to address the important issues facing the nation, it is crucial that Minnesota's seat not remain empty, and I hope this process will resolve itself as soon as possible."

Sen. John Cornyn, the chairman of the National Republican Senatorial Committee, called Schumer's comments premature and troubling, since Schumer is the new chairman of the Senate Rules Committee, which has jurisdiction over contested elections.

"Senator Schumer will likely play a key role in determining who ultimately assumes this Senate seat," Cornyn said. "Pre-judging the outcome while litigation is still pending calls into question his ability to impartially preside over this matter when it comes before the Committee, as it most certainly will."

Coleman hasn't ruled out a lawsuit challenging the election results, claiming there were irregularities that gave Franken an unfair advantage. The Coleman campaign also has a petition pending before the state Supreme Court to include 650 ballots that it says were improperly rejected but not forwarded by local officials to St. Paul for counting.

The court has not said when it would rule in that case.

Senate Republican leaders have said the chamber shouldn't seat Franken until all legal matters are settled, even if that drags on for months.

Franken campaign spokesman Andy Barr said in an e-mail Sunday: "In terms of future planning, we're taking it one step at a time. The next step is the canvass board's meeting tomorrow, where we have every expectation they will declare that Al won the election."

Is Coleman choking on his own advice to Franken about throwing in the towel out of respect?

I'm not sure what Minnesota or Federal law states, but I think once the results are certified, Franken is indeed the winner until and unless a challenge pulls him out of the seat. (As opposed to him having to wait for the court challenges to be over.)

I think Minnesota has handled this with class and everybody just did their jobs. That's how it is supposed to be. Even Coleman and Franken came to terms of the recount as the court required. For Coleman to further challenge it after having made that court-required agreement is not going to set well with more courts, I don't think. If he had wanted more ballots, then he should have insisted on them then.

The way it looks to the public is, "Ron, wants some cheese to go with that whine?"

Has Coleman conceded? Last I heard, he had not agreed on which ballots to count. His lawyer objected to the counting of absentee ballots yesterday, and he has a petition to the MN Supreme Court to count ballots in a different way. His lawyer said that even if the canvassing board certifies on Monday, Coleman might file an election contest, which could prevent the governor from issuing a certificate of election.

The Republicans just don't get it. By playing games and refusing to seat Al Franken, who happens to be the certified winner of the Minn Senate race, they will only alienate the middle.

Doing mischief and playing to the base is so Bush/Rove. Thankfully those are over.

Nothing has been certified by anyone yet.

I think the Canvassing Board will wait until the MNSC clears Coleman's pending litigation before they certify - then there is a seven day waiting period before the Governor certifies.

That waiting period is there, to give time for candidates to contest the election, should they choose to do so.

Harry Reid seems like a decent enough guy - he's just ineffectual - something / someone we can't afford right now. Both he and Nancy Pelosi need to step aside. Desparate time mean we can't afford to have "business as usual" types in charge.

Agreed. I can't figure out how Reid ever got his job. He beat Dick Durbin by one vote. Bet that wouldn't happen again!

If republicans were allowed to set a precedent that no senator who won the popular vote could be seated until all pending law suits were settled----well that could open up a pretty kettle of fish couldn't it? Every time a democrat won a senate seat, the rethugs could file frivolous law suits and then delay, delay, delay thus leaving the seat vacant for months and upsetting the balance of power in the Senate----which is exactly what they're trying to do here. If they can prevent the democrats from having all the votes they've earned in the Senate, especially during Obama's first hundred days in office, then they can perhaps change the course of history for the worse. We mustn't allow that to happen.

Unless you were there to witness what ACTUALLY happened at that memorial, I'll take your point as hearsay and rightly dismiss it.

The difference between the event itself, which I was fortunate enough to participate in, and the one that was selectively edited for television are vast. Please don't bother to be self righteous about something that you obviously don't have firsthand experience with.

Cons problem is that they believe their own nonsense- Franken's books provide an intelligent and fair critique to the right's manipulation of the press- if cons could read they would appreciate Franken- unfortunately (for them and us) they think they are intelligent because they listen to Rush on the radio instead of listening to country and watch Fox news instead of watching wrestling

I am sure that there were plenty of hard working election officials.
The overall way the recount was handled was embarrassing, however, because MN election law is embarrassing.

MN needs to learn from the state of IL how to run clean elections and have good government.

Not permitting a certificate of election to be issued until possibly months of litigation are concluded --- well, that is just embarrassing.

The inability to complete a recount in a timely manner is embarrassing. 12,000 rejected absentee ballots --- that is embarrassing. A MN Supreme Court ruling that gives the campaigns a role in reviewing envelopes to see which previously rejected absentee ballots should be permitted in the final count is embarrassing.

Think about what the consequences to the democratic process could be if republicans manage to set a precedent that no Senator can be seated as long as there is a pending law suit after they won the popular vote. Going into the future that could be a pretty effective way of changing the balance of power in the Senate during the crucial first 100 days couldn't it? It could make all the difference between getting Obama's plans passed through the Senate---or not. This isn't about who won the popular vote legally. We all know the answer to that now. This is about using machinations to manipulate the vote in the Senate during Obama's first several months in office. We can't allow that to happen.

I've also had problems getting my comments posted here.

This is an embarrassingly long, drawn-out counting process and I know it is embarrassing to some; but Minnesota has nothing really to be sorry for. They've done a great job of resolving a very, very close election -- in fact, they've pretty much publicly shown Florida, Ohio and other States how ugly their own election processes are. I would still like to know why Ken Blackwell and Katherine Harris are not in jail.

Speaking of Rush, this situation illustrates just how predictable he claims democrats are. "Found" ballots for Franken..The highly partisan MN election supervisor...Al Gore recounting only in heaavy democrat counties....Power, the acquisition and retention of power is all that matters to dems..The rest is just filler.

There were no "found" ballots for Franken. The ballots-in-the-trunk thing was debunked.

The recount was run mainly by Republicans, wasn't it?

Al Gore would have won a state wide recount in Florida. Stolen by the Republicans on the Supreme Court.
