Fallout from the surreal political scandal in Illinois has now wafted into Minnesota.

Senate Majority Leader Harry Reid is refusing to seat Roland Burris, appointed by disgraced Ill. Gov. Rod Blagojevich, for lack of state certification. That's a problem for Al Franken, who also lacks final state certification despite the fact that the state canvassing board declared him the winner Monday.

Will Senate Democrats seat Franken without official certification? "I don't think so," said Senate Majority Whip Richard Durbin, a Democrat from Illinois.

"Republicans will object to trying to seat him," said Reid spokesman Jim Manley. Later in the day, Manley said that Democratic leadership would not seat Franken when the new class of Senators was sworn in on Tuesday. "Now that the bipartisan state canvassing board has certified Al Franken as the winner, we hope Senator Coleman respects its decision and does not drag this out for months with litigation... However, there will not be an effort to seat Mr. Franken tomorrow."

The remarks from Senate's top two Democrats cast a shadow on what was an otherwise bright day for Franken's political objectives. The comedian-turned-Senate aspirant claimed victory on Monday after the Minnesota canvassing board's final tallies showed him with a 1,212,431 to 1,212,206 vote victory.

"After 62 days, after the careful and painstaking hand inspection of nearly three million ballots, after hours and hours of hard work by elections officials and volunteers across the state, I am proud and humbled to stand before you as the next Senator from Minnesota," Franken declared before a crowd of reporters.

But even in victory, the Democratic challenger foreshadowed potential obstacles ahead. "There may still be additional legal proceedings related to our recount," he said.

Indeed, in private, some Democrats are conceding that they simply don't have the votes, at this juncture, to seat Franken without certification, though that won't stop them from at least trying to do just that. Moreover, legal challenges to Franken's declared victory seem all but certain to come from Sen. Norm Coleman within the next week.

"The actions today by the Canvassing Board are but the first step in what, unfortunately, will now have to be a longer process," said the Senator's counsel, Tony Trimble. "This process isn't at the end; it is now just at the beginning. We will contest the results of the Canvassing Board -- otherwise, literally millions of Minnesotans will be disenfranchised."

The tone of defiance was echoed in the nation's capital as well. Senate Minority Leader Mitch McConnell (R-Ky.) declared to reporters, "The race in Minnesota is not over." Claiming that Minnesota law doesn't allow certification of a senator while litigation is ongoing, he added, "It's my understanding that litigation is commencing."

And so, an election that went weeks beyond its supposed end-date seems likely to drag on a bit further. Aides to Franken told the Huffington Post that, in the end, they don't see the final tallies changing. But that won't stop Coleman from appealing the results to state and even federal court, where he will argue that some Minnesotans were denied equal protection through the methods of the state's recount process.

In the interim, procedural steps are being undertaken to accommodate a possible transition of power, not just for Franken but for other incoming Senators as well.

Durbin, addressing the even more contentious Senate replacement process in Illinois, said that Burris was welcome to come "to Washington and welcome to have an office, but I can't see him taking any official action." At this point, he added, the potential Barack Obama replacement had been unable to "produce the documentation necessary" to certify himself as a senator.

Coleman, too, had office-related issues pop up on Monday. His staff arrived at the Senate apparently unable to enter their workplaces. The Senate Rules and Administration Committee had followed its own guidelines, which stipulate that the Senator's term expires on January 3rd and therefore their offices should be closed. Coleman had been notified. But aides showed up regardless.

"I think there was a misunderstanding about what they needed to do," said Howard Gantman, staff director for the Senate Rules and Administration Committee. "They corrected it."

Harry Reid and the Democratic Senante leadership boxed themselves in a box with Franken by denying Burress. Remember on Meet The Press Reid stated he would meet with the Republican Senate leadership to reach a "bi-partisan" agreement regarding the seating of Burress. He also said he is an "old trial lawyer", and there is always room for negotiation. If you noticed, the Democratic enate leadership has not shown much overt affection toward Franken. They have been very quiet regarding Franken's Senate battle with Coleman. Franken does not fit into the "old boys network".
Point blank they are afraid of Franken. They cut a deal with the Republicans and they sacrificed Franken so as to not seat Burress. They are treating Franken "sorta like "he is African American. I said on yesterday that Franken would not be seated. I was roundly castigated by several posters here. Coleman is only doing what a true politician would do, fight for his seat and try to help his party, by any means necessary. Burress is also doing the same.Too bad the Democrats don't do the same. Burress and Franken=two(2) Democratic votes not at the Democrats disposal.

lil' normie is NOT doing what a respectable professional would do. He lost...he cheated, he got caught in the recount...and he lost. Nothing will come of any legal actions other than some delay. So I correct you on that. To suggest that lil' normie is just doing what needs to be done is just a bunch of bull.

Even his legal arguments are bullsh#t. They aren't gonna fly, and he knows it.

I DO agree with you on Reid, however. He could have had the option to show some more balls.. Thus far, the party isn't exactly acting like the majority party.

I do wish the Dems had replaced Reid with someone who is less of a wimp.

In an earlier post regarding an article about Burris I stated that this is likely to come down to whether or not the Sec. of State for Illinois certifies Burris. I was taunted and scolded for my lack of understanding of the constitution. Well like I said before, this will likely be halted without certification. Ha! to those that chided me.

Many posters here appear to be asleep at the screen.

Franken can not be seated because of Burriss. The stated reason for Buriss not being seated is his paeprwork has not been signed by the SOS. Well huffsters Franken's paperwork has not been signed by the SOS.

Reid and comapny woudl have egg on their face and a major court case if they seated Franken without appropriate paperwork and not Burriss.

Has nothing to do with Republicans.

Franken was elected and confirmed on a recount.

Burris is an appointee, albeit a legal one.

Honestly, I don't see any reason not to seat both of them. If Buriss is "under the taint" (har-har) of the alegedly corrupt gov. then he'll just have to work with it, or around it.

All true, but the last line. It has everything to do with republicans. Coleman is making the decision to hang up the certification in court for months. Every legitimate vote in the state has been carefully considered and counted. Coleman has as much chance of winning as a vegan at a hot dog eating contest, but he chooses to do fight on anyway. And the republican leadership is complicit through their silence.

That may be true about the legitimacy of the vote counting, but it also may not be true. There are several discrepencies in the way votes were counted, or not counted. There are discrepencies about which votes should count and which shouldn't. There are discrepencies about absentee ballot handling and challenges.

Even our hyper liberal newspaper, the star tribune, has said Coleman is right to go to court. They don't think he will win, but that he is right to challenge the canvassing board's conclusion.

False! Or at least misleading. In Minnesota one can register to vote AT the polls, so that the pre-election registration figures are ALWAYS lower than the votes. There is no way the number of people voting can outnumber the registered voters in MN. You show legal residency in the precinct, you can vote.

The actual sign-in logs match the votes on election day. The campaigns had a chance to challenge "double-votes" (i.e. absentee + day of vote). All these were cleared from the count.

Besides, this is a legitimate election. It's Franken for 6 years. this is not an appointment, it's a full term. 2010 isn't going to matter in this case.

Yes, really, let's see: in Dubya's case, his brother is governor of the state in dispute, the Secretary of State supervising elections is also the head of the committee to elect Bush-Cheney and doesn't recuse herself, 1,000's of minority voters are unjustly struck from voter rolls by the Republican tool Choicepoint, the U.S. Supreme Court issues a never-before decision singular in its nature and insulated from subsequent review, precedence or dispute to stop recounting legitimately cast & close vote totals. In retrospect, Bush's theft and ascendancy to the presidency will be looked upon as one of the worst cases of "woulda, coulda, shoulda" in American history and unfortunately as the beginning of our decline in global stature.

The fact that the election was so close, they never counted the absentee ballots. There were military ballots still in mailbags when the SCOTUS declared Bush the victor.

Bush might have won legitimately, once all of the ballots had been counted, we will never know however because of an unprecedented court ruling..

There is also the fact that neither candidate requested this recount. I it is written in to Minnesota law that if the vote is within a certain percent (I think it is 3%) there is an automatic recount called. People frothing at the mouth over this election and recount seem to keep forgetting this.
