"Lost" Star Wins Sole Custody Of Toddler After Witchcraft Allegations

Naveen Andrews has just left family court with his son, and the baby mama is sitting on the courthouse steps bawling.

The "Lost" star and Elena Eustache, the mother of three-year-old Naveen Joshua, were in L.A. County Superior Court, where a judge changed the custody order after Elena allegedly took the boy out of L.A. County without permission. Naveen also claimed Elena kept the boy from him.

The parents had joint custody, but today, with the help of disso-queen Laura Wasser, the order was modified so Naveen now has sole physical and legal custody pending a full hearing next month.

We're told Elena has alleged Naveen's girlfriend, Barbara Hershey practices witchcraft and that Naveen and Hershey have poisoned the boy. In response, Wasser asked the judge to order Elena to undergo psychiatric testing.

I hope, the mother Elena Eustache gets her kid back as soon as possible. She didn't take the kid out of the country but out of L.A. and she returned while he gets to take the kid to Hawaii and that's not extreme? Barbara Hershey could very well be practicing some type of new age religion (like Madonna) or even Wicca, so how is the Mother crazy for bringing that up? I don't give the L.A. court system the benefit of the doubt; look at what happened with David Hasselhoff.

David Hasselhoff was given custody of his teenage daughters (the mother had that crazy female attorney who represented Larry Birkhead, (Anna Nicole's baby's daddy, before he fired her)). Anyway Hasselhoff got the kids even though video showed him rolling around drunk in his own vomit, but supposedly the mother, whose never been found intoxicated, was asked to take a drug test herself and evidently she refused so they gave her kids to a proven drunk.

Well, Hasselhoff could not keep sober so the children were living with the Mother despite the judgment and Hasselhoff's demands that she leave their home so it could be sold; when he was finally put into the hospital for self- inflicted alcohol poisoning. Only then did David .Hasselhoff settled with his wife. Yet the LA court system put Mrs. Hasselhoff through the ringer. I sincerely hope Elena Eustache gets her child back as soon as possible.

Well, the mother ignored court orders. Does not matter the level of infraction, you don't tick off the judge, or you pay the price. He has court permission to take the kid to Hawaii, so there's really no issue there.

Witchcraft unto itself is no big deal. What was the mother's intent by raising it as an issue? Apparently the mother has issues with it, or she would not bring it up. Judges hate when divorcees start sniping at each other, especially in the public eye with unfounded or ludicrous intent. They will almost always remove parental rights from the parent who is launching ill-intended statements towards the other parent.

So if the mother ignores the judge, starts rumors about dad to gain an advantage. Judge wasn't playing ball, and she got burned, and deservedly so.

Who the f*#k cares if she practices Witchcraft? Aroma Therapy, Meditation, The Secret, Wortcunning, who doesnt practice some form of the craft?

It is totally uncool for that kid to see his mother devastated, she should not have taken him without permission, but to see your mother cry sucks.

However, every woman should aspire to be a "Witch" and free themselves. The more advanced a society the more freedom they give their women and vice versa.

Funny, how different cultures, countries & religion's view these accusations. Hershey & Naveen would have different fates if they were another country say, PNG.

Oh, he'd have to be in his thirties. It's funny, but the image of Carradine and her appearing on the Tonight Show barefoot and singing some hokey folk song, while Carradine strummed the guitar, is an image burned into my brain that won't leave.

I feel badly for the child. His mother appears to have a serious mental illness. Thinking somebody is a witch and people are poisoning her son suggest a paranoid schizophrenic thought disorder. I hope she can get help for herself and can regain enough stability to be a positive influence on her son's life.

Why does that make her mentally ill? Wiccans practice what they call witchcraft and no one is calling them mentally ill. And who knows if her son came home after eating with his dad and was sick? It's unfair to label someone as mentally ill without investigating the claims to see if maybe there is some merit to them.

That's because Wicca and other Pagan based traditions are legitimate religious practices.
Wicca is recognized in our country (USA) as a religion by the military and the government. But of course there are still people around who want to demonize Wiccans because they are different. Personally, I'm glad this mother didn't get away with that....

It's not the Wiccan aspect of this so much, but the belief that her child is being poisoned, which is a very common delusion of people who are paranoid schizophrenic. Of course nobody can diagnose a person as schizophrenic on the basis of a report in the news, but anybody that doesn't at least consider this a serious possibility in this case is seriously naive.

I'd like to hear her side of the story. He's rich and his lawyers are capable of painting a very bad picture of her. I'm sure she cannot afford the best lawyers. She looks devestated. They are both the child's parents. They should share custody.

I suspect what weighted with the judge is (if you read) the birith mother broke the custody agreement by taking the child out of the country.

Witchcraft aside...you don't flout court orders and not pay for it.

She didn't take him out of the country. She took him outside of L.A. county. That is an extreme punishment. Are the going to punish the dad for living in Hawaii which pretty much prevents the mother from seeing her own child. Very unfair court system if you are not a celebrity .

This is where some women mess up. When you use your child as a prop to hurt his father, you only mess yourself up.

That's what happened here. Now he's got full custody and she's got visitation. I've seen this kind of thing a thousand times and it's always for the same reason -- he didn't wife her and she's angry, so now I'm going to use this child to get back at him.

I have to say that in some cases, what you're saying is true. However, there are women who can walk away from a relationship with dignity and class.

Not every woman reacts the same way. My rule of thumb is to always exit a relationship with the same grace and dignity that you showed when you entered it.

People split up sometimes and get back together. Sometimes things happen in the interim. I know more than one person with a sister or a brother conceived while their parents were on the skids.
