Eric Holder: Can GOP Stop Obama's AG?

The fault lines over the confirmation battle for Attorney General nominee Eric Holder were drawn several weeks ago, when a series of Republican Senators on the Judiciary Committee aired their concerns on the Senate floor.

Over the past few days, however, the objections have grown a bit wider. On Tuesday, Arlen Specter, the ranking Republican on the committee, complained about not being consulted prior to the nomination and questioned whether Holder would be nothing more than a "yes" man for Barack Obama. He was subsequently brushed back by the Obama transition team and the committee's chair, Patrick Leahy, both of whom who touted Holder's integrity and independence.

So political fireworks are expected during the confirmation hearings, now scheduled for January 15. But what, exactly, will happen?

Democratic officials are preparing for a united Republican front and a healthy dose of drama. The obvious area of focus will be Holder's role in pardoning tax-cheat Marc Rich. But the former deputy AG is also expected to be asked about his positions on current hot-button topics, none more so than whether or not members of the Bush administration should face post-office prosecution.

GOP opposition could end up being more bark than bite. An aide on the Hill said it wasn't beyond the realm of reason to see Specter actually voting in favor of Holder's nomination. If he does, the rest of the Republicans may very well follow suit. "It would be tough to envision only a few Republican Senators sticking their neck out on this," the aide said.

If Specter isn't the one to change sides, there are others. Sen. Lindsey Graham has been very silent on the Holder matter, is known for an independent streak, and is a "law enforcement guy," as one person put it. Maybe more importantly, he will be traveling with incoming vice president Joe Biden to Southwest Asia for a week. Jeff Sessions, meanwhile, has objected to some of the information requests Republicans have made from Holder's records, saying they go beyond normal protocol.

There are other variables to consider. Right now, the breakdown of the committee is ten Democrats to nine Republicans. But that number includes Biden, who is still officially a member. In all likelihood, the Delaware Democrat will recuse himself from the hearings, meaning an even partisan split on the committee.

However, a vote on Holder isn't expected to come until after the new administration is sworn in. And according to Julian Zelizer, a congressional historian at Princeton University, Democratic leadership has the power to simply replace Biden when he leaves -- likely with his Senate replacement, Ted Kauffman -- thus preserving the one-vote majority. Holder's nomination already seemed likely to pass; the procedural makeup should not pose any obstacle.

But Rove's opposition to Holder may run a little deeper than this.

In a speech delivered to the American Constitution Society in June 2008, Eric Holder emphasized a judicial philosophy that differs sharply with Karl Rove and the the ultra right view of the Constitution.

Holder described the Constitution as a unique founding document of US society, but ultimately an imperfect document. Citing its initial legalization of slavery and its refusal to give women the right to vote until the 20th century, Holder expressed the view that within the spirit of the Constitution and the ideals of the founders of the country "there is contained the capacity for change. The choices the founders made were not frozen in time." The concepts embodied in the Constitution, Holder said, allowed "the pursuit of a more perfect union."

This philosophical view of the legal system and the Constitution sharply diverge from the so-called strict constructionist view of the Constitution upheld by the right wing. Theoretically, the right wing believes the Constitution to be a static, unchanging document in which is contained all the legal precepts we need.

Among the Bush administration's specific violations of law, Holder cited the authorization of the use of torture, warrantless wiretapping on Americans, secret detention of US citizens without due process, and the suspension of the writ of habeas corpus. While these actions may have been done with the general good in mind, that does not change the fact that they were wrong, Holder said.

Yeah, because the only thing scarier than a black President - if you're a white Republican - is a black AG at the same time!!! Yikes!

A role in the Marc Rich pardon can't drum up all of this drama. It was Clinton's choice and Reno's job to to oversee it. If they were that hurt over the Marc Rich then they had 6 years to investigate her and Holder after Bush took over. Y'all already know what this is about. Maybe, just maybe those civil rights cold cases might actually get solved. Hate crimes laws enforced. And no more state-sanctioned mur.ders and violations of black men by trigger happy cops. That means YOU NYC!

I HOPE the Republicans protest and stop the Holder pick, because he is not the best candidate available. We need a STRONG civil libertarian, which is NOT Eric Holder. We need someone who will take a second look at both FISA and the War On Drugs and ensure that our rights are not being trounced upon by the Federal Government.

This is NOT Eric Holder, and he does not represent the progressive ideal for civil liberties.

PE Obama, please reconsider this choice. If not, Republicans have my blessing to do everything they can to stop this appointment.

Amen. This nominee should be rejected by a bipartisan vote. He is far more competent than Alberto Gonzalez, but his views aren't all that different. Terrible choice, no matter where you are on the ideological spectrum.
