Florida's Transgender Bathroom Rule Angers Conservatives

GAINESVILLE, Fla. — A blond girl heads from a playground into a women's restroom. A scruffy man, lurking outside, darts in behind her. "Your City Commission Made This Legal," the words on the TV screen read.

The dark ad came from opponents of a gender identity provision added last year to the city's anti-discrimination ordinance, which now allows the city's roughly 100 transgender residents to use whichever restroom they're most comfortable using.

Foes want to repeal the new protection with a March 24 ballot measure that has divided Gainesville, a generally gay-friendly university city surrounded by staunchly conservative north Florida.

Those who support the transgender protections say their opponents are really unleashing a broader attack on the rights of gay, lesbian and transgender individuals in general.

The city commission approved the restroom provision by a 4-3 vote a year ago. Before the ink could dry, Bible-quoting opponents angrily began working for its repeal.

"You are trying to operate in a realm you do not have the authority to operate in," one pastor, George Brantley, told the commissioners.

The debate is expected to become noisier as the ballot nears with opponents resorting to more TV ads and campaigns pegged to such slogans as "Keep Men out of Women's Restrooms and vice versa."

Organizations defending transgender rights are mustering their own campaign.

The National Gay and Lesbian Task Force notes 108 cities and counties nationwide have similar transgender protections. An attempt to repeal an ordinance in Montgomery County, Md., failed when a court ruled opponents did not collect enough signatures to place it on the ballot.

Citizens for Good Public Policy, the group behind the commercial that aired last summer in Gainesville, collected more than 6,000 signatures last summer to win a referendum. If approved, the repeal measure would also prevent the commission from adding protections beyond what the state requires: race, color, sex, religion, national origin, age, disability and marital status.

Cain Davis, chairman of Citizens for Good Public Policy, said the issue is about regulating a "government gone wild" and ensuring public safety, charging that sexual predators could now simply enter a women's restroom claiming to be a transgender individual.

"We know when men go into women's restrooms, bad things can happen," Davis said.

City Commissioner Craig Lowe, leader of a group called Equality is Gainesville's Business, called the ads from Davis' group a grossly distorted attempt to whip up fears.

Lowe's group believes anti-discrimination protections for people who change their sexual orientation are good for business and foster diversity. He noted that 433 of the Fortune 500 companies have policies covering sexual orientation and 153 cover gender identity.

Since the ordinance took effect, police have reported no problems in public restrooms stemming from the law.

Retired postal worker Donna Lee, who became a female with surgery in 2001, moved to Gainesville from Ocala last March after hearing about the anti-discrimination ordinance. The 60-year-old is working to save the protections.

"We just want to live our lives with the basic civil rights that everyone else has," Lee said.

But some are taking no chances.

Computer programmer Clare Holman, who was born male but now lives as a female, said she simply stays away from public toilets.

"I don't want to run afoul of the law by using the wrong restroom," Holman said.

Sigh. So this is what conservatives have come to? Making a big issue out of .....trans­gender bathroom use? I can just see Sarah Palin coasting to Presidential victory in 2012 on this one! Perhaps they should worry more about the many Americans who won't even have a bathroom in a home soon if the economy continues to tank?

I fail to see the harm in this new law. Since when did a little sign on a door ever stop a REAL predator from following a woman or a small child anywhere? Conservatives gnash their teeth over anything that is pro-LGBT.

The little sign doesn’t stop the real pervert BUT when the authorities do respond to a scream from the ladies room, there is no question that he does not belong there. The authorities have grounds to detain and question him. But with this law the pervert or voyeur can claim to be transgendered and that he is being harassed and the authorities would need to back off

The transgendered should have the right to use the public restroom they feel most comfortable. The question is how to do that without making it easier for the pervert or voyeur to go where he does not belong.

Separate single person restrooms with a lockable door is a solution but it is expensive and likely to be years in implementation.

Since 2007, the state of Oregon has had the same anti-discrimination ordinances that the "conservatives" are trying to eliminate in Gainesville FL. Have you heard of any problems as a result? The University of Oregon, in Eugene, has had such protections since 2005. Any problems there?

By the way, many — if not most — jurisdictions (cities, counties, states) have no laws restricting which sex may enter which restroom. It wouldn't be practical, given that parents need to help their children, some people with disabilities need assistance, etc. Disorderly behavior and related laws can be invoked in case of an incident that the "conservatives" claim to be worried about.

And trans people have been using the restroom of their choice for decades, if not centuries.

What's really going on here is that "conservatives" want to control and punish anyone who commits the crime of being different.

If bathrooms were only used to eliminate waste, wash hands, and perhaps reapply makeup, this would be a non-issue.

As it is, there are lots of guys who live hetero lives while they peruse the bathrooms for gay encounters. Trans-gender people confuse them!

I often wish Christianists were required to submit their blatherings to Mrs. Slafkosky, my favorite high school English teacher. I like to imagine her with her intense brown eyes and bright red pen, rapidly scrawling "Unsupported conclusion!" and "Prove!" and "Irrelevant!" and "Ad hominem attack!" down the margins of the entire right wing experience.

Well, here's a solution. The law stays in effect, but the conservatives can minimize it's effect by personally paying for the installation of individual restrooms with the sign that allows use by either men or women. One room, one toilet, one sink, one customer at a time inside a locked door--------all paid for by worried republicans with their knickers in a bunch.

As a boyish looking female, I have been screamed at, stared at, and told I am in the wrong bathroom so many times I can't count. I usually respond by saying that unless this is the men's room and THEY are in drag, I am in the "correct" bathroom. But usually I just stare at them like they are crazy. Which they are-- freakish bathroom-p­olice.But when they stare with rage, I try to humiliate them by "proving" I am female--lol!

A dear friend of mine, a naturally born FEMALE who is 6'4" tall, always has mothers with children give her strange looks when she enters a bathroom. I love it when some mall cop trys to stop her on the way in, SIMPLY BECAUSE SHE IS TALL AND WEARS HER HAIR SHORT. It is all a matter of perception in the mind of the beholder. Men in general have a problem with anyone who would be willing to sacrifice their precious male parts and change them to female. Women usually wind up embracing male to female transexuals as one of them. Now about those toe tapping senators..­....!!!

Surely, in the interests of truth, the ad shoud run as follows:

A blond girl heads from a playground into a women's restroom. A woman (as far as anyone can tell, and who defines herself as a woman) darts in behind her. "We Want To Make This Illegal," the words on the TV screen read. A blond boy heads from a playground into a men's restroom. The woman (who has been unceremoniously kicked out of the first restroom) darts in behind him. "We Want To Make This Illegal Too," the words on the TV screen read. In the final segment the woman is in jail, she isn't allowed to use the "restrooms" there, because that would be illegal under the newly introduced laws, but if she behaves then she's allowed to have a bucket in her cell.

The actual ad is a blatant lie unless the scruffy man in it is actually a transgendered person. Somehow I suspect that the group behind the ad would not be able to persuade a transgendered person to take part, and even if they could they would have no interest in doing so.

Omg, if a scruffy, sillhouette of any gender creeped into a public restroom behind my daughter I'd be in there in a heartbeat.­..and a sign with a woman on it and a law is certainly not going to stop a predator from following a child--boy or girl--or a woman anywhere! They are idiots if they think the pre-transgender law stopped any one. I guess what they are saying is "here in FLA you can molest our boys but not our girls." And are the cops in FLA so useless and dumb that they would simply not stop an assault because of this law???
