President-elect Barack Obama's choice to run the Treasury Department and lead the nation's economic rescue failed to pay $34,000 in taxes from 2001 to 2004, but the last-minute disclosure didn't stop Senate Democrats from moving forward with his nomination.

Timothy Geithner had paid some of the back taxes in 2006 after the IRS sent him a bill. When the Obama transition team discovered he owed even more back taxes, Geithner paid those additional taxes days before Obama announced his choice in November, according to materials released by the Senate Finance Committee considering his nomination.

Obama's staff told senators about the tax issues on Dec. 5.

Finance Committee Chairman Max Baucus, D-Mont., said he still hoped Geithner could be confirmed on Inauguration Day, asking senators for unanimous consent to skirt rules and schedule a hearing as early as Friday.

"These errors were not intentional; they were honest mistakes," Baucus said after he and other committee members met with Geithner behind closed doors on Tuesday.

It was not clear Tuesday whether committee Republicans would sign off on Baucus' request for a quick hearing.

The panel's senior Republican, Sen. Chuck Grassley of Iowa, hasn't decided whether the revelations are reason enough to oppose Geithner, said spokeswoman Jill Kozeny. He believes they are "serious, and whether or not it's disqualifying is to be determined," she said.

Another prominent Republican, however, spoke up for Geithner. Utah Sen. Orrin Hatch, another committee member, said he continues to support the nominee.

"I have no problem," Hatch told Fox News. "He's a very, very competent guy."

After senators met with Geithner, the panel released 30 pages of documents detailing his tax errors -- and also how he came to employ a housekeeper whose legal immigrant work status had briefly lapsed in 2005.

Senate Majority Leader Harry Reid, D-Nev., dismissed the events as "a few little hiccups," and said he was "not concerned at all" about the impact.

Obama reiterated his support for Geithner.

"He's dedicated his career to our country and served with honor, intelligence and distinction," incoming White House spokesman Robert Gibbs said. "That service should not be tarnished by honest mistakes, which, upon learning of them, he quickly addressed."

Geithner, plucked from his job as president of the Federal Reserve Bank of New York to serve as Obama's treasury secretary, told transition officials and senators that he didn't know he owed self-employment taxes when he worked for the International Monetary Fund.

He failed to pay self-employment taxes for money he earned 2001 to 2004 while working for the IMF, according to materials released by the Senate committee. In 2006, the IRS notified him that he owed $14,847 in self-employment taxes and $1,885 in interest from 2003 and 2004, which he paid after an audit. The IRS waived penalties for those tax years.

Transition officials discovered last fall that Geithner also had not paid the taxes in 2001 or 2002. He paid $19,176 in back taxes and $6,794 in interest for 2001 and 2002 several days before Obama announced his choice, the committee documents showed. All told, Geithner had failed to pay $34,023 in self-employment taxes for the years 2001 to 2004.

Geithner and his supporters have said his mistake was a common one for people hired by international organizations that don't pay the employer share of Social Security taxes. The IRS estimated in 2007 that as many as half those employees had made tax-filing mistakes, and offered a group settlement to let them correct the errors. Geithner told Obama's team and senators that an accountant had reviewed his tax returns after Geithner prepared them and didn't discover the problem.

But some tax experts said the problem is not that common.

Tom Ochsenschlager, vice president of tax for the American Institute of Certified Public Accountants, said it would be difficult for someone preparing a tax return for a self-employed person to skip the Social Security and Medicare tax lines.

"It's such a basic mistake that I kind of wonder if we know all the facts," Ochsenschlager said of Geithner's situation.

Geithner filed amended tax returns for 2001 through 2006 after Obama's team reviewed his records.

The committee's materials said Geithner "has experience with Social Security tax issues." He filed the taxes late for his household employees in 1996 for years 1993 to 1995; he incorrectly calculated Medicare taxes for his household employees in 1998 and received an IRS notice; and he received notices from the Social Security Administration and the IRS after not filing 2003 and 2004 forms for his household employees, the report states.

Geithner also said he didn't realize a housekeeper he paid in 2004 and 2005 did not have current employment documentation as an immigrant for the final three months she worked for him, the documents indicated.

One of his housekeepers' legal authorization to work in the United States expired on July 15, 2005, and the person continued to work for Geithner until October of that year, the committee's report states.

Geithner is the second Obama Cabinet choice to face controversy. New Mexico Gov. Bill Richardson withdrew his name on Jan. 4 as Obama's commerce secretary after questions surfaced about a federal investigation concerning contributions and a state contract.

Geithner's tax problem was at least the second time such a situation has touched an Obama appointee. Nancy Killefer, the management consultant selected last week to become the new administration's chief performance officer, failed to pay unemployment compensation taxes, apparently on household employees. In 2005, the District of Columbia placed a $946.69 tax lien on her home over the unpaid taxes. Over a year and a half, she had failed to pay $298 in taxes plus the rest in interest and penalties, and she cleared up the debt within a few months.

The allegations were first reported by the Wall Street Journal:

According to people familiar with the matter, Mr. Geithner employed a housekeeper whose immigration papers expired during her tenure with Mr. Geithner, currently president of the Federal Reserve Bank of New York. The woman went on to get a green card to work legally in the country and federal immigration authorities didn't press charges against her, these people said.


The second issue involved taxes due while Mr. Geithner worked for the International Monetary Fund between 2001 and 2004. As an employee, Mr. Geithner was technically considered self-employed and was required to pay Social Security and Medicare taxes for himself as both an employer and an employee.

He apparently failed to do so, resulting in Internal Revenue Service audits his last two years at the IMF. As soon as the IRS brought the issue to his attention, he paid the taxes with interest, these people said.

Look at it this way. We all have a great excuse now if we get caught forgetting to pay some of our taxes. How can we be expected to understand all these complex filing rules when even our country's Treasury Secretary couldn't figure them out?

To all of you "know nothing doofooses"

I worked overseas for about 2 1/2 years. My salary was paid in 2 portions. 60% of it was paid in the US, properly taxed and SS deductions were made from it.

However, the part I received overseas was not taxed at all. Since I received my statements and seen that taxes have been paid I thought every thing was fine. Even my tax preparer overlooked the fact that on the overseas part there was a cause for mistake.

3 years later the IRS discovered the mistake and required payment of the unpaid taxes, including late fees, interest and penalties. After long negotiations with the IRS, the late fees, interest and penalties were dropped and I ended up paying the due taxrs and SS contributions.

An honest mistake was made and righted after the mistake was discovered.

And did you read and fully understand that part of the article:

It may be a common mistake, but it doesn't inspire confidence that someone who falls for this particular mistake would be considered for head of Treasury. Some other department, maybe, but here it looks particularly bad.

The premise of the AP report, "Unpaid taxes" is not exactly correct. He did pay those back taxes, and furthermore the IRS didn't seem to have problem with it. This is not an evasion case.....l­et's not confuse Mr. Geithner with Leona Helmsley!

He cheated. When he got caught. He only paid for what he got caught for. Would it not come to mind that the prior years might have the same problem? When he got caught again, he paid again.

As an administrator of the IRS, would he give me the same deference if I behaved the same way?

Why are so many people here complaining about Geithner and Obama's team support for him? Are they supposed to abandon someone they just selected and throw him under the bus once these problems surfaced? No one is perfect in this world, and it does not seem like the tax and immigration issues that have surfaced were serious enough to derail the nomination.

Even if we cut him some slack on the the IRS audit for 2003 and 2004 (which we probably should not do), there is absolutely no excuse for his failure to voluntarily pay the back taxes for the same issue for 2001 and 2002. It was only after the transition team discovered it that he paid. This sends a terrible message to the average American who struggling to make ends meet and have their payroll taxes taken out of their paycheck.
Obama, who I strongly supported, needs to send a strong message and withdraw the nomination. We can’t tell the public that things will be different regarding ethics, and then turn the other cheek.

Geithner is suppose to be a tax person,he is just onewho you can not trust . Obama's team was suppose to vet the guy and now they tell the public he just refused to pay his taxes.The IRS sent him 4 thats 4 notices and he just refused to pay. I support soon-to-be­-President Obama 100%. But I support his message and what he stands for more. Having said that, ANY impropriety cannot be overlooked and cast aside. People believe in Obama because they trust him. Better yet, they WANT to trust him. And those he places in high office.

How in the world can Obama abide with a Treasury Secretary that did not sign proper tax forms over multiple years? At the least it's imcompetent. I'm not expected to be too busy or engaged to sign my tax returns properly - why shouldn't the guy who will run our Treasure Department? This kind of stuff just can't be ignored. Perception becomes reality in this country. Why does Obama want to have a notch against him right out of the box? Find another person to run Treasury.

Let's not go through the Clinton-esque parsing games - "it depends on what the meaning of 'is' is" kind of crap. Cut your losses, Barack, and move on to another qualified person.

It is extremely disappointing to hear this story and the way how Obama team is backing this guy. After 8 years of such wayward Bush government, I was so hoping to see "CHANGE" through this new incoming team but putting this guy's failure to pay taxes as just normal mistake is outrageous. It's politics as usual. There will be guys who will be above the law. Guess what happens when normal citizen like us failed to pay taxes? Why do you patronize this kind of behavior and have this guy to lead a crucial sector in times like this? This small behavior in his own personal life speaks very loud and clear to me. Unless he is the absolute person to be nominated, NO WAY, NO HOW, NO THANK YOU, Geithner!

It is good that the issue is being discussed and Senators are asking him questions about it.

However, unless there is more to it than reported in the media thus far, it seems that Geithner made mistakes in his tax returns. And it is not an uncommon mistake for someone working a regular job and doing consulting. It happens all the time.

IRS caught his mistakes for 2004 nd 2003, but not for prior years. The transition team caught the same mistake in 2001 and 2002 records, and Geithner resolved it by filing amended returns. If that's it, I have no problems with him being confirmed.

We shouldn't throw away qualified and capable people for such mistakes.

If George Bush made this appointment for HIS Treasury Secretary, you would probably be derisively laughing and highly critical. You would point to how incompetent the Bush Administration was and would be incredulous as to why Bush would continue to support his nominee.

Apply the same standards here and critique this individual appointment as you would a Bush appointment. We deserve better with Obama.

There are plenty of qualified and capable people available for this position. Sometimes the most simple and innocent of mistakes scr.ew people. This appointment should be withdrawn - the man should withdraw himself - and we should get on with good government.

I worked so hard to get Obama elected. The nomination of Timothy Geithner was the first big stumble that his people have made (Bill Richardson was a small problem compared to this.) I will be very disappointed if this nomination goes through. Right now, above all, Obama needs people in his administration that operate morally and ethically. An example must be set due to the lack of morality on Wall Street. We are not just talking about one thing that he did wrong, but a series of failures to operate honestly. This guy does not deserve to be in this position and will I plan on emailing everyone on the Senate Finance Committee to let them know. If you agree, please email them TODAY!

Im starting to give up on the whole system.The­y are all crooks. I am a CPA and they teach you the difference b/w wages and self employment in accounting 101. He had to have known what he was doing was wrong or pretty aggressive and he happened to get caught. If he didn't know he shouldn't be Secretary of Treasury!
I give the Obama team credit for catching it but he cannot be allowed to run the IRS.
If the IRS doens't follow the law why should we. This is a joke.
By the way a tax professional (or similiar education) cannot use reliance on an accountant as a defense.
