President-elect Barack Obama's choice to run the Treasury Department and lead the nation's economic rescue failed to pay $34,000 in taxes from 2001 to 2004, but the last-minute disclosure didn't stop Senate Democrats from moving forward with his nomination.

Timothy Geithner had paid some of the back taxes in 2006 after the IRS sent him a bill. When the Obama transition team discovered he owed even more back taxes, Geithner paid those additional taxes days before Obama announced his choice in November, according to materials released by the Senate Finance Committee considering his nomination.

Obama's staff told senators about the tax issues on Dec. 5.

Finance Committee Chairman Max Baucus, D-Mont., said he still hoped Geithner could be confirmed on Inauguration Day, asking senators for unanimous consent to skirt rules and schedule a hearing as early as Friday.

"These errors were not intentional; they were honest mistakes," Baucus said after he and other committee members met with Geithner behind closed doors on Tuesday.

It was not clear Tuesday whether committee Republicans would sign off on Baucus' request for a quick hearing.

The panel's senior Republican, Sen. Chuck Grassley of Iowa, hasn't decided whether the revelations are reason enough to oppose Geithner, said spokeswoman Jill Kozeny. He believes they are "serious, and whether or not it's disqualifying is to be determined," she said.

Another prominent Republican, however, spoke up for Geithner. Utah Sen. Orrin Hatch, another committee member, said he continues to support the nominee.

"I have no problem," Hatch told Fox News. "He's a very, very competent guy."

After senators met with Geithner, the panel released 30 pages of documents detailing his tax errors -- and also how he came to employ a housekeeper whose legal immigrant work status had briefly lapsed in 2005.

Senate Majority Leader Harry Reid, D-Nev., dismissed the events as "a few little hiccups," and said he was "not concerned at all" about the impact.

Obama reiterated his support for Geithner.

"He's dedicated his career to our country and served with honor, intelligence and distinction," incoming White House spokesman Robert Gibbs said. "That service should not be tarnished by honest mistakes, which, upon learning of them, he quickly addressed."

Geithner, plucked from his job as president of the Federal Reserve Bank of New York to serve as Obama's treasury secretary, told transition officials and senators that he didn't know he owed self-employment taxes when he worked for the International Monetary Fund.

He failed to pay self-employment taxes for money he earned 2001 to 2004 while working for the IMF, according to materials released by the Senate committee. In 2006, the IRS notified him that he owed $14,847 in self-employment taxes and $1,885 in interest from 2003 and 2004, which he paid after an audit. The IRS waived penalties for those tax years.

Transition officials discovered last fall that Geithner also had not paid the taxes in 2001 or 2002. He paid $19,176 in back taxes and $6,794 in interest for 2001 and 2002 several days before Obama announced his choice, the committee documents showed. All told, Geithner had failed to pay $34,023 in self-employment taxes for the years 2001 to 2004.

Geithner and his supporters have said his mistake was a common one for people hired by international organizations that don't pay the employer share of Social Security taxes. The IRS estimated in 2007 that as many as half those employees had made tax-filing mistakes, and offered a group settlement to let them correct the errors. Geithner told Obama's team and senators that an accountant had reviewed his tax returns after Geithner prepared them and didn't discover the problem.

But some tax experts said the problem is not that common.

Tom Ochsenschlager, vice president of tax for the American Institute of Certified Public Accountants, said it would be difficult for someone preparing a tax return for a self-employed person to skip the Social Security and Medicare tax lines.

"It's such a basic mistake that I kind of wonder if we know all the facts," Ochsenschlager said of Geithner's situation.

Geithner filed amended tax returns for 2001 through 2006 after Obama's team reviewed his records.

The committee's materials said Geithner "has experience with Social Security tax issues." He filed the taxes late for his household employees in 1996 for years 1993 to 1995; he incorrectly calculated Medicare taxes for his household employees in 1998 and received an IRS notice; and he received notices from the Social Security Administration and the IRS after not filing 2003 and 2004 forms for his household employees, the report states.

Geithner also said he didn't realize a housekeeper he paid in 2004 and 2005 did not have current employment documentation as an immigrant for the final three months she worked for him, the documents indicated.

One of his housekeepers' legal authorization to work in the United States expired on July 15, 2005, and the person continued to work for Geithner until October of that year, the committee's report states.

Geithner is the second Obama Cabinet choice to face controversy. New Mexico Gov. Bill Richardson withdrew his name on Jan. 4 as Obama's commerce secretary after questions surfaced about a federal investigation concerning contributions and a state contract.

Geithner's tax problem was at least the second time such a situation has touched an Obama appointee. Nancy Killefer, the management consultant selected last week to become the new administration's chief performance officer, failed to pay unemployment compensation taxes, apparently on household employees. In 2005, the District of Columbia placed a $946.69 tax lien on her home over the unpaid taxes. Over a year and a half, she had failed to pay $298 in taxes plus the rest in interest and penalties, and she cleared up the debt within a few months.

The allegations were first reported by the Wall Street Journal:

According to people familiar with the matter, Mr. Geithner employed a housekeeper whose immigration papers expired during her tenure with Mr. Geithner, currently president of the Federal Reserve Bank of New York. The woman went on to get a green card to work legally in the country and federal immigration authorities didn't press charges against her, these people said.


The second issue involved taxes due while Mr. Geithner worked for the International Monetary Fund between 2001 and 2004. As an employee, Mr. Geithner was technically considered self-employed and was required to pay Social Security and Medicare taxes for himself as both an employer and an employee.

He apparently failed to do so, resulting in Internal Revenue Service audits his last two years at the IMF. As soon as the IRS brought the issue to his attention, he paid the taxes with interest, these people said.

The obvious difference in this case between Bush and Obama is that Bush's people would be so incompetent that they would not have identified the errors in the first place. But Obama having a competent vetting team found the error and did not try to hide it.

All you on your high horse who think they can put their lives under the same scrutiny of this vetting process and they not find some mistakes you made are just fooling yourselves.

I don't know how anyone can believe his conduct is either common or innocent.

He took a deduction for equipment in a business that was defunct prior to the tax year.
He claimed "dependent care" deductions for his kids overnight camping trips. Even after his accountant told him those deductions were not allowed, he never filed an amended return to pay them until after Obama had selected him.

Clearly this man is a tax cheat.

Geithner formerly worked for Kissinger Assoc. He is a member of the Council on Foreign Relations. He is a member of Bilderberg. He was a Director at IMF. And he screwed up on his taxes.

Let's not forget the issue of his employing an illegal immigrant. When will this country wake up and realize that it is not okay to ship and jobs overseas and it is not okay to hand our jobs here at home over to criminals (which is what you are if you entered this country illegally). Especially in this economy, our jobs should be going to Americans first.

You do not need to be insulting. As you mentioned, her papers expired while she was in his employ. If it is his responsibility to know when to pay his taxes, then it is certainly hers to know when to renew her employment papers. I am a teacher. If I let my teaching license expire, then I can no longer legally teach and I will be barred from my job until I renew it. End of story. And try to refrain from any insulting cracks about my being a teacher and my reading comprehension.

I am part of a group that provides assistance to illegal immigrants, mainly teaching them English and computer skills so they can get better jobs. They are wonderful people. I have made many friends. There are three doctors in our group providing free healthcare.

Of course, we don't check papers and everyone is wlecome to our "school". Therefore, we don't really know that they are illegal. :-)

I agree with the first part of your post, and I don't want to see any more of our jobs going overseas or taken illegally.

An "illegal immigrant" for the last three months of a two year employment because her documentation expired isn't the same as Geitner willfully and knowingly hiring an illegal. She had documentation for 21 months of her employ by him.

The IMF provides materials making clear workers need to pay their payroll taxes and how to do it. Not that a high-finance guy like Geithner didn't already know it. This is a problem for the would-be Treasury secretary.

It is good that the issue is being discussed and Senators are asking him questions about it.

However, unless there is more to it than reported in the media thus far, it seems that Geithner made mistakes in his tax returns. And it is not an uncommon mistake for someone working a regular job and doing consulting.

IRS caught his mistakes for 2004 nd 2003, but not for prior years. The transition team caught the same mistake in 2001 and 2002 records, and Geithner resolved it by filing amended returns.

If that's it, I have no problems with him being confirmed. We shouldn't throw away qualified and capable people for such mistakes.

Every job that I ever took, I signed a bunch of papers the day I started the job. I don't even remember what I signed.

This mistake described in the article is a very common one. It happens all the time with consultants hired by companies, for example university professors, who also have a regular job.

This is an embarrassment nothing more but tro//s have your fun for now because he will be confirmed. Every year the finance committee gets together they always comment how messed up our tax code really is mostly because mostly you tro//s put in tax breaks for the rich.

I'm going back and forth with IRS now with a bloated tax bill because I was let go from my employer in 2005 because I became disabled yet my old company kept on reporting the disability MetLife sends me as wages. The point is nobody is immune from the complexities of the tax code.

They say accountants or this case economists should never do there own taxes like lawyers should never defend themselves or doctors should never treat themselves.

Off topic my wife said something I never heard today but I thought it was quite interesting.

We were watching a series of documentaries on Hit ler and they mentioned how Hit ler thought it was divine providence that he had survived so many assa sination atemps and my wife without missing a beat said "Get over yourself just because you are alive is not proof you are immortal".

It was probably said before but I thought is was insightful.

Not a troll here, but someone who knows taxes. If you paid the for your disability insurance premiums yourself out of POST-tax dollars, then your disability is generally not taxable. However, if your employer paid the premiums for you or you used pre-tax dollars to pay for the disability, then generally your disability is treated as wages. Many even though you are no longer employed, you are treated as if you are receiving wages. And yes, many companies report disability on W-2s--that is not unusual.

As for Mr. Geithner, I am sure he is a nice guy, but the mistake he made has nothing to do with the tax code being complex. If you are self-employed, then you are responsible for paying self-employment taxes. Mr. Geithner signed a document given to him by the IMF acknowledging he was self-employed and required to pay self-employment taxes. Also, he received QUARTERLY reports from the IMF calculating for him how much self-employment taxes was required to be paid. Also, he received other documents from the IMF reminding him to pay his self-employment taxes.

It may have been a mistake, but it makes him look like a royal idiot who doesn't read what he signs and routinely ignores important documents sent by his employer--that is not confidence inspiring.

As President of the Federal Reserve Bank of New York his salary was $398,000 in 2007.

So you can speculate that his income while a contractor for the IMF as "Director of the Policy Development and Review Department " was say $300,000 after deductions in 2003, 2004.

That means he would have paid over $90,000 in income taxes in both 2003 and 2004.

The error that the IRS found was an additional (approx) $7,500 in 2003 and 2004.

It was an error, it's not that he didn't pay his taxes.

The issue is not that he didn't pay income taxes, but rather that he failed to pay self-employment taxes. It doesn't matter if the amount he failed to pay was small or large in comparison to the other taxes he paid.

Here's what Mr. Obama's opponents are going to say (and rightfully so): How do you explain the fact that Mr. Geithner signed a document provided by the IMF acknowledging that he was self-employed and required to pay self-employment taxes, and then forgot to calculate and pay his self-employment taxes several years in a row? Also, how do you explain the fact that the IMF provided various other documents to him notifying him of his obligation to pay self-employment taxes?

Either you explain it by saying he doesn't read what he signs and ignores important documents provided by his employer and makes a glaring mistake several years in a row on a series of tax returns, or you explain it by saying he though he wouldn't get caught precisely because it wasn't a huge amount of money (comparatively) and he though he would save 7K+ a year in taxes every year. Neither explanation inspires confidence in the individual nominated to head the agency which oversees the IRS.

Mr. Obama has an important agenda to move forward. He doesn't need to let something like this distract him. Again, he can appoint someone else to the Treasury and just allow this whole issue to simply disappear.

What are "self employment taxes"?

I am a consultant who works on contract.

At the end of the year I receive a 1099 form from each client who has paid me for my contracts.

If I were making $300,000 a year I would take all of my 1099 forms to an accountant, along with all my business receipts and let the accountant work out what I am supposed to pay.

What I am saying is that his accountant made a mistake.

The debate here seems to follow the theory that the range of opinions is a circle; the far right and the far left are very close to eachother. Both sides would say that its no big deal for someone that they support. The far right had no problem with Gonzalez as Attorney general just as the far left has no problem with Holder's nomination.

Its the folks that don't have their blinders on that can criticize Joe the Plumber for not paying taxes as well as Tim Geithner. They can also criticize Gonzalez' trashing of the Justice Department as well as Holder's active participation in the pardon of Marc Rich.

People, its not Joe the Plumber anymore. Its Joe the War Reporter. He reported that he is on Israel's side, and that other side is all wrong and that's all anyone needs to know.
Joe's important. He's the only hope for the Republican Party in 2012.

The point was if he's your man, then he can do no wrong. If he's the other sides man, its a huge issue.
