The Big Winners In Stimulus Compromise: The Upper-Middle Class

When President Obama outlined on January 8 the rationale for the economic stimulus bill, "The American Recovery and Reinvestment Act," he clearly identified the men and women most in trouble:

Nearly two million jobs have now been lost, and on Friday we are likely to learn that we lost more jobs last year than at any time since World War II. Just in the past year, another 2.8 million Americans who want and need full-time work have had to settle for part-time jobs.

The House-Senate compromise, however, cuts funds for extended health care coverage for the unemployed; cuts $30 billion in aid to state governments to prevent reductions in social services to the poor and out-of-work; and also cuts a special "Making Work Pay" tax holiday from $500 to $400 for an individual, and from $1,000 to $800 for a couple, for low-to-middle-income workers still hanging on to their jobs

Amid all the cutting, however, one group emerged unscathed: the upper-middle class, the not-quite-super-rich, but certainly not on the ropes. Most of these folks, in terms of income and employment, are what could be called the un-needy, a group clearly distinct from those Obama identified as the core target of the legislation. The "compromise" legislation includes $70 billion, or just under 10 percent of the whole package, to be used expressly to take care of these affluent people.

In fact, these lucky men and women make so much money that they fall into the ever-expanding grasp of the alternative minimum tax (AMT). The AMT was originally designed in 1969 to prevent the nation's millionaires and billionaires from using tax loopholes to pay zero income tax. That year, 155 very wealthy taxpayers paid no federal tax whatsoever. This year, if the law remains as it is currently crafted, the AMT would, through bracket creep, apply to as many as 25 million taxpayers, including those making in the $85,000 to $250,000 range, depending on how many deductions they claim (the more deductions, the more likely the AMT comes into play).

There is a strong case to be made that the AMT was never intended to apply to people in these income categories - for example two public school teachers married to each other -- and Congress in recent years has repeatedly passed temporary one-year "patches" postponing the downward reach of the tax provision.

Some economists argue, however, that patching the AMT is one of the least effective ways for Congress to stimulate the economy and create jobs. As the Huffington Post has reported, the Congressional Budget Office and Brookings-Urban Institute Tax Policy Center have both described the AMT as a poor use of federal dollars.

Why then has Congress added the $70 billion AMT patch to the bill, while cutting other expenditures right and left?

The most obvious answers are 1) the people who make $80,000 to $250,000 are influential and vocal in pressing their complaints to Congress; 2) an AMT-induced tax hike would produce an outcry; 3) and people in this class have become the most contested "swing" voters in elections -- running the gamut from presidential to state legislative elections.

Once these upper-middle-class voters were a reliably Republican constituency, but over the past generation, Democrats have made major inroads, evinced in the success of Bill Clinton, Al Gore, John Kerry and Barack Obama in the well-to-do suburbs of New York, Philadelphia, Boston, and along the entire California coast.

A major consequence is that leaders of both parties are vying intensely for this crucial segment of the electorate -- Republicans to staunch the hemorrhaging, Democrats to speed it up. Thus, the $70 billion AMT patch has become inviolable.

Best way to stimulate the economy...

Instead of spending a lot of money we don't have...

Cut ALL income taxes and the corporate tax too.

This would result in a loss in federal receipts of about 1.5 Trillion... Still leaving them with about 1 Trillion.

That much money back in everyone's pockets means more spending... which leads to an increase in federal receipts means they wouldn't loose the whole 1.5T.

No corporate tax would mean more jobs and more companies would be inclined to stay here.

Cut back spending, remove some unnecessary departments (DEA, Dept. of Education), maybe cut back the Pentagon budget... Smaller is better, It means more efficient.

Stop making us pay for the bad business decisions of educated business men. Bankruptcy is a natural part of the business cycle, bailing them out only keeps the living dead walking longer.

Last but not least, Abolish the Federal Reserve System - While the Government taxes us from the front they tax from behind through this nasty phenomenon called Inflation.

Just a thought... may have some bugs in the system, it might require some adaptation... But on the upside... we don't burry our children and grandchildren in debt.

Your idea is terrible and makes no economic sense. It would lead to another depression in this country.

Tax cuts go to people who have jobs. People who have jobs are cutting back on their consumption. Give them more money, and they'll save it, so they have a cushion in case they lose their job. Same with businesses. Tax cuts only go to businesses which are making money. If they make more money, they won't hire workers. They'll save the money, in case their business prospects get worse.

Meanwhile the unemployed and businesses which are losing money won't get any help at all from tax cuts.

I would argue that we are already in a depression... and if we aren't yet, we certainly are in a recession about to slip over the edge into depression.

I should have been more specific, by cut all taxes, I meant abolish the income tax and dismantle the IRS. With every American receiving more income in each paycheck, it is impossible to say that there would not be increased spending and investment. And yeah, some individuals might save more, but this is a free country (isn't it?), shouldn't that be their right?

As far as the businesses, if they're not having to pay a tax twice on their earnings (once when the company makes it then again when execs are paid) they are much more likely to create jobs... not to mention they'll have to deal with increased demand from consumers having more money. Let's make it easier for small businesses to create local jobs in the community instead of relying on big multinational corporations or the government for jobs.

please tell me how tax cuts for the already-rich are not considered "pork".
obama and his team ought to strip out ALL tax cuts, instead, focusing on pure jobs and spending.

after everyone gets back to work, then the tax roll-out can begin, once everyone has something to tax, that is. until then, they are just talking about pie in the sky that hasnt happened yet.

As stated below ad nauseum, based on historical tax rates (2008, and years and years before that) which included the same limits on the application of the AMT, this limit for another year is not tantamount to a tax cut. In fact, it merely keeps the tax rate and tax structure the same.

The chart above is misleading at best as it describes the tax that would be in place for this group IF for the first time in many, many years the AMT wasn't limited. Then, the other chart shows the decrease from the previous chart which is not in force.

This article is based entirely on the fiction that if the AMT isn't limited, here are the rates. Based on these non-actual, non-reality, non-limited rates, look at how the "upper middle class" made out like bandits from the stimulus bill.

The whole premise of the article is absurd, and was designed and written to infuriate the masses.

The easiest thing they could have done is to cancel taxes for people under 50,000 a year. Are they that foolish? Imagine this group walking around with an extra 3 to 4 thousand dollars in their pocket. Fix your house, buy a car, new appliances, kids tuition, you could go on and on. A simple solution, easily administered. Always ignore the obvious and simple. Take care of the special interest
groups.

See below, they are already "cancelled". Family income at this level is NOT taxed NOW. In fact, many of these folks CURRENTLY qualify for Earned Income Tax Credit Checks from the government. Thus, THEY PAY NEGATIVE FEDERAL INCOME TAXES. NOW.

How do you propose to REDUCE this level of taxation? You can't reduce below 0%. The only option would be to write them bigger checks?

I don't know about the earned income credit because I don't know anybody who has ever been affluent enough to have a child. However I do know people who make less than $30,000 per year who pay federal income tax -- and those people can't afford dental care, live hand to mouth, often can't afford medical insurance premiums, haven't taken vacations in years, will never be afford to make a down payment on a home, have no savings, will never be able to retire, etc.

During the campaign, Obama talked a lot about helping the middle-class, even giving tax cuts to the upper middle class. I don't recall he had much to say about the poor or the working poor. So I feel he's delivering on what he promised.

There are so many people earning less than $40,000 per year (as I do) that I don't think it is realistic that anything substantial can be done to help them: Even a little tax break would have a major revenue impact. It's easier and safer to make the much smaller upper middle class happy and let them loudly sing your praises than to try to staunch the suffering of lower income people at all.

Obama is supporting his own class, the people he hears and sympathizes with who feel the pinch when writing those large private school tuition checks and making payments on their vacation homes. That's natural and expected, too, just as Bush supported his even richer class.

Federal Income Tax is a seperate tax from Social Security and Medicare (withholding) taxes. We are discussing FEDERAL INCOME TAX on this blog.

It is okay to disagree about the tax package, but not okay to vilify the upper middle class. These folks are not the ones that created this debacle. They didn't earn hundreds of millions of dollars in bonuses. They are not throwing people out of their homes. They are doctors, engineers, plumbers, electricians, small business owners. They are hard working people who are trying to take care of their family, put children through college, save for retirement, help elderly parents, donate to charity. Being a part of the the upper middle class is the aspiration we all have for ourselves and our children. It would be a terrible thing if our society only consisted of the super rich and the poor. We need the middle class to thrive and grow and we need to do all we can (education, job training, investment in emerging industries) to increase this sector of our population.

The article is insulting and inaccurate: we pay taxes....lots of taxes!

Personally, my husband and I paid more than $34,000 in federal taxes last year.

We were Texas residents the last couple of years--no income tax in Texas, BUT, the politicians in every county gouge the homeowners. Of course, the more expensive your home, the more you pay.

We paid a property tax rate of 3.1%; the property tax on the structure alone came to $13,500; then there was the $8,000 we paid directly to the school district; then were were various fees for the municipalities.

The insinuation that citizens in our income bracket don't pay taxes is ludicrous--and downright insulting. Indeed, four out of every five dollars collected in federal income tax is paid by persons with an adjusted gross income of $65,700 or greater.

Agreed. Great post.

There is a lot of outrage here by people who PAY NO FEDERAL INCOME TAXES based on their own posts. They seem to be uniformly uninformed, uneducated, unjustifiably angry, unwilling to even consider facts relative to US taxation realities (even if directly from IRS website), and stubbornly subscribe to the class warfare BS this article espouses.

As I posted in detail below, and even as described in this BS article above:

The AMT was established in 1969 to prevent 155 very rich individuals from avoiding tax entirely. Now, in 2008, 25 MILLION people could be discriminated against based on the application of the AMT in its 4 decades old form. Thus, each and every year, for years, the AMT has been limited in application to avoid this effect. Democrats. Republicans. Democratic Congress. Republican Congress. Democrat AND Republican Congress. Uniformly limited year after year.

That the AMT has once again been limited, just as it has been for years upon years, is not news. It is beyond disingenuous to state or imply that "the upper middle class" made out like bandits from the stimulus package, and the AMT limit included in it.

To NOT limit the AMT would result in a MASSIVE TAX INCREASE based on historical tax rates this group pays.

I agree 100% - we pay our fair share of taxes, yet we are phased out of many tax credits - we lose the child tax credit, we are not eligible for the college tuition tax credit, our children are not eligible for financial aid for college. We work hard for EVERYTHING we have and pay our own way. As a result we are able to take care of our families, send our children to college, save for retirement, donate to charity.

Edsall's spin although very effective at stoking class warfare, is completely inaccurate.

1) AMT has been routinely limited on an annual basis for several years to prevent tax discrimination. Challenge yourself, and do a little research BEFORE you share your outrage. There is nothing new or scandalous. It happens every year.....INCLUDING 2008.........in fact the AMT should be repealed.

2) For all the moral outrage about so-called "upper middle class" people getting tax breaks, the MAJORITY of Americans pay zero federal income tax. So, there is a credibility gap with the outrage-especially if it comes from the majority who don't pay squat. And, I don't want to hear about sales tax, and social security tax, and medicare tax. The AMT applies to Federal income Tax. We all pay Social Security, Medicare, and Sales tax.

3) The $85K threshold is the level at which a family of four BEGINS to pay tax, after deductions etc. In fact, in 2008, according to the IRS website www.irs.gov/eitc a married family of 4 with income up to $41,646 qualifies for a CHECK for up to $4,824 through the Earned Income Tax Credit program. Some of the most enraged bloggers here don't even know about the EITC. Nor, are they aware that this program costs the government MORE money than Social Security on an annual basis.

If you're so dead set on me giving up my AMT limit, I'm sure you're equally willing to give up the EITC.....

No wonder the yuppies love their boy, Obama! Aid to the poor, to cities, and to the states are all slashed in the lame and ineffective stimulus package that made it through the Senata, but the UPPER MIDDLE CLASS got a windfall. We should have voted for Jeremiah Wright.

Last night on MSNBC Richard Engle was reporting from Baghdad in front of the new US Embassy. He said it was larger than Vatican City. Cost to U S taxpayers. $700 million. Where is the rightwing whiners on this. Silent, totally silent.

Admittedly, that's pretty pricey. But that's less than one tenth of one percent of the crap sandwich of a bill that's being served up. And while I feel nice about the tax break I'm gonna get, I still think this "stimulus" package is a bad idea in its current form.

Seriously, why can't we just put that money into creating jobs through border protection and interior immigration enforcement? Lord knows Phoenix needs help right now.

I agree with the author that patching the AMT is not the most effective form of stimulus, but it's sloppy and disingenuous to call patching the AMT a "tax cut" for the upper middle class. The AMT is patched EVERY year to avoid what would amount to a huge tax increase on the middle class. Not patching it this year would mean burdening an already struggling middle class with a giant tax hike.
