WILKES-BARRE, Pa. — For years, the juvenile court system in Wilkes-Barre operated like a conveyor belt: Youngsters were brought before judges without a lawyer, given hearings that lasted only a minute or two, and then sent off to juvenile prison for months for minor offenses.

The explanation, prosecutors say, was corruption on the bench.

In one of the most shocking cases of courtroom graft on record, two Pennsylvania judges have been charged with taking millions of dollars in kickbacks to send teenagers to two privately run youth detention centers.

"I've never encountered, and I don't think that we will in our lifetimes, a case where literally thousands of kids' lives were just tossed aside in order for a couple of judges to make some money," said Marsha Levick, an attorney with the Philadelphia-based Juvenile Law Center, which is representing hundreds of youths sentenced in Wilkes-Barre.

Prosecutors say Luzerne County Judges Mark Ciavarella and Michael Conahan took $2.6 million in payoffs to put juvenile offenders in lockups run by PA Child Care LLC and a sister company, Western PA Child Care LLC. The judges were charged on Jan. 26 and removed from the bench by the Pennsylvania Supreme Court shortly afterward.

No company officials have been charged, but the investigation is still going on.

The high court, meanwhile, is looking into whether hundreds or even thousands of sentences should be overturned and the juveniles' records expunged.

Among the offenders were teenagers who were locked up for months for stealing loose change from cars, writing a prank note and possessing drug paraphernalia. Many had never been in trouble before. Some were imprisoned even after probation officers recommended against it.

Many appeared without lawyers, despite the U.S. Supreme Court's landmark 1967 ruling that children have a constitutional right to counsel.

The judges are scheduled to plead guilty to fraud Thursday in federal court. Their plea agreements call for sentences of more than seven years behind bars.

Ciavarella, 58, who presided over Luzerne County's juvenile court for 12 years, acknowledged last week in a letter to his former colleagues, "I have disgraced my judgeship. My actions have destroyed everything I worked to accomplish and I have only myself to blame." Ciavarella, though, has denied he got kickbacks for sending youths to prison.

Conahan, 56, has remained silent about the case.

Many Pennsylvania counties contract with privately run juvenile detention centers, paying them either a fixed overall fee or a certain amount per youth, per day.

In Luzerne County, prosecutors say, Conahan shut down the county-run juvenile prison in 2002 and helped the two companies secure rich contracts worth tens of millions of dollars, at least some of that dependent on how many juveniles were locked up.

One of the contracts _ a 20-year agreement with PA Child Care worth an estimated $58 million _ was later canceled by the county as exorbitant.

The judges are accused of taking payoffs between 2003 and 2006.

"Bob Powell never solicited a nickel from these judges and really was a victim of their demands," he said. "These judges made it very plain to Mr. Powell that he was going to be required to pay certain monies."

For years, youth advocacy groups complained that Ciavarella was ridiculously harsh and ran roughshod over youngsters' constitutional rights. Ciavarella sent a quarter of his juvenile defendants to detention centers from 2002 to 2006, compared with a statewide rate of one in 10.

The criminal charges confirmed the advocacy groups' worst suspicions and have called into question all the sentences he pronounced.

Hillary Transue did not have an attorney, nor was she told of her right to one, when she appeared in Ciavarella's courtroom in 2007 for building a MySpace page that lampooned her assistant principal.

Her mother, Laurene Transue, worked for 16 years in the child services department of another county and said she was certain Hillary would get a slap on the wrist. Instead, Ciavarella sentenced her to three months; she got out after a month, with help from a lawyer.

"I felt so disgraced for a while, like, what do people think of me now?" said Hillary, now 17 and a high school senior who plans to become an English teacher.

Laurene Transue said Ciavarella "was playing God. And not only was he doing that, he was getting money for it. He was betraying the trust put in him to do what is best for children."

Kurt Kruger, now 22, had never been in trouble with the law until the day police accused him of acting as a lookout while his friend shoplifted less than $200 worth of DVDs from Wal-Mart. He said he didn't know his friend was going to steal anything.

Kruger pleaded guilty before Ciavarella and spent three days in a company-run juvenile detention center, plus four months at a youth wilderness camp run by a different operator.

"Never in a million years did I think that I would actually get sent away. I was completely destroyed," said Kruger, who later dropped out of school. He said he wants to get his record expunged, earn his high school equivalency diploma and go to college.

"I got a raw deal, and yeah, it's not fair," he said, "but now it's 100 times bigger than me."

Let's say you are the "co-owner" of a company that is likely to have business before a certain court. The presiding Judge of that court calls you up and tells you that "in order to receive a FAVORABLE RULING, you will have to PAY!

Is there any person out there that doubts that if you TOOK THIS TO THE STATE BAR they wouldn't have done a thorough investigation and that the JUDGE wouldn't have been effectively PRECLUDED FROM EXTORTING MONEY?

That would be my # 1 exhibit against the CORPORATE entity in this case.

We don't know if the prosecutor is honest, effective, or prosecuting to the full extent in this case as it is presented. I suspect that we are in a "gray area" as far as the State Law is concerned, but a LEGAL FUND should be started, to assist these Children and their families in their pursuit of JUSTICE!

It may be that by offering a "deal", whereby the Judges can plead "guilty" on the Bribery charges, the Prosecutor is "setting them up" to have little defense on the charges that may come for "Illegally incarcerating" these kids. The "gray area" that I am unsure of is that I'm not sure what statutes there may be in PA for "illegally" imprisoning ANY INDIVIDUAL in the STATE PENAL SYSTEM (which I suspect these prisons would still be considered, even though they are Privately run).

My bottom line is; These kids (and their families) are certainly likely to SUE THE STATE for their illegal imprisonment, and the STATES TAXPAYERS are going to be "on the hook" for the bill. EVERY TAXPAYER IN THE STATE SHOULD BE SCREAMING over the INHERENT POTENTIAL FOR CORRUPTION that exists in this system, and DEMANDING that the SYSTEM BE DISMANTLED!

My second "bottom-line" is that WE, THE AMERICAN TAXPAYERS, also need to STAND UP and start MAKING NOISE!

The SYSTEM OF PRIVATIZATION, as practiced and implemented by THE REPUBLICAN PARTY, IS A SYSTEM THAT IS RIFE WITH POTENTIAL CORRUPTION!

At its core, the system places SIGNIFICANT RESPONSIBILITY for MAJOR GOVERNMENTAL OPERATIONS, into the hands of the PRIVATE SECTOR, whose ONLY MANDATE IS to MAKE A PROFIT! (see American Corporate Law; THIS IS LITERALLY THE ONLY LAW THAT A CEO, CORPORATE DIRECTOR, or CORPORATE PRESIDENT (virtually any corporate rep) can be PERSONALLY PROSECUTED FOR!

FAILURE TO DO "WHATEVER IT TAKES" to show a profit is THE CRIME that applies to Corporate Individuals, and ANYTHING ELSE is prosecuted in the realm of the "CORPORATE PERSON" which means that there is no criminal charge, only $$$ that the Corporation may be required to pay.

If PROFIT minus FINES still equals PROFIT, the CEO, BOARD OF DIRECTORS, etc... ARE GOLDEN!

Unfortunately, the backlash to the civil rights movement has been a return to the law and order movement in this country. Organizations such as the Equal Justice Initiative eji.orgg) are necessary as many of our children, typically minority, some as young as 13, are in adult prisons and on death row. Not that we don't have a serious problem with juvenile crime, but the excesses of a culture that breeds judges such as these, and the vultures on Wall Street leave few options for many of our children and the conservative response is often a punitive, repressive, law and order one that creates more problems than it solves. Not just for social justice, but in our economy, and in all areas of our day to day life.

The imprisoning of juveniles, particularly juveniles with education disabilities, has been a special form of child abuse perpetrated by school districts ---- See Harvard Civil Rights Project report: "Opportunities Suspended: The Devastating Consequences of Zero Tolerance.­" School districts and county mental health facilities have been illegally falsifying, censoring, and withholding juveniles' records,and forcing them into "alternative programs" for "at-risk" children and into the juvenile justice system---- follow the money trail. Is anyone out there who cares that children in the united States are being so abused and so systematically, and that the Office for Civil Rights in both the U.S. Dept. of Education and Health and Human Services, are doing absolutely nothing to enforce laws to protect children in this country?
And the taxpayer is being forced to pay for this.

2.) Seize everything the two judges own (their families be damned), and use it toward the massive settlements the state is going to have to pay out for this appalling tragedy.

As a Pennsylvania resident this story did not surprise me. The state of Pennsylvania has been looking more and more corrupt over the past 8 years. I like some residents have been hoping that the feds with start to take a long look at the type of politics that is being practiced here including the cities of Pittsburgh and Philadelphia . If I am not mistaken the state of Pennsylvania has more young people locked up than any other state in America. That my friend is a sure sign of piss poor leadership!

It's not just Pennsylvania, but our whole country. The administration of the past 8 years has demonstrated a me-first attitude, operated in secret with breath-taking disregard for the rights of others and was clearly about enriching themselves and their coterie of friends and colleagues, so why should we be surprised when 2 judges decide to follow suit? Devastating, but somehow, I think we will probably hear more stories such as this.

I wouldn't be so sure, more investigations should be done b/c these privately run detention centers are all over the US. Disgusting. Put it together with all the non-violent drug "criminals" behind bars and just think of all the unnecessarily ruined lives. It's not justice, it's greed in service of a police state.

Yes... Privatization of prisons and anti-regulation, anti-law mentality.­.... We need to nationalize these privatized institutions immediately, and get people in office who believe in enforcing the laws and not just about muttering platitudes about "oversight­."
