NEW YORK — The government must release sealed documents that could reveal new details about the origins and scope of the prostitution investigation that brought down former New York Gov. Eliot Spitzer, a judge ordered Thursday.

U.S. District Judge Jed S. Rakoff wrote in federal court in Manhattan that the documents, which were FBI applications for wiretaps, should be unsealed "given the strong and obvious public interest in disclosure." He ordered them released by Tuesday.

Prosecutors, who can appeal the decision, had no immediate comment.

The New York Times sued late last year to get access to the documents, which name the 67 people besides Spitzer who were clients of Emperor's Club VIP, a high-end prostitute service. The Times has agreed to allow the government to withhold the names of the customers in the documents.

None of those customers except Spitzer has ever been identified and no client was ever charged. Four people who operated the ring were charged with prostitution and money laundering and have pleaded guilty.

The government has voluntarily unsealed a search warrant application for Emperor's e-mail account, but it withheld applications for wiretaps on cell phones, including one used by a woman who booked appointments with prostitutes.

Prosecutors had argued the release of the documents would violate the privacy of callers and reveal sensitive investigative techniques.

But Rakoff found that "any threats to privacy are eliminated by the redactions (of names) previously agreed to" by prosecutors and the Times.

Spitzer resigned last year after details were revealed of a tryst with one of the ring's prostitutes in a Washington hotel. Investigators had been looking into the governor's affairs after noticing unusual activity _ later shown to be payments to prostitutes _ in his bank accounts.

He was sabotage to get off Wall Street crooks. New York is already trying to get rid of it's new mayor. Elliot is a hero & I hope he finds a way to get back on top. God! People are stipiid. Men have affairs... almost all of them. But few are hereos, and you let an affair let Wall Street crooks put us in a Depression and that's all you can think of to say?

Read Spitzer's amazing piece published in February of 2008 in the Wash. Post, calling Bush the Predatory Lenders' Partner in Crime--as far back as 2003, he and the other 50 attorneys general had been seeking to prosecute brokers selling misleading and unconscionable mortgages, and the Bush administration SUED them to stop the prosecutions. Spitzer says that had they been allowed to act to stop the abusive lending, much of our misery might have been avoided or mitigated. Funny, he was outed shortly thereafter, alone among the 67 clients who were taped with their hookers.

Thanks BNS, he is hon-her-ed. Righteous (progressive), if not 'righteous righteous (life giving) fifty percent' of the population :-).

Laura D knows her onions. She gave a talk near Stanford and asked "Who has heard of TIA?" Four or so hands of forty went up. In June 2007 for heaven's sake. It was an elderly Commonwealth Club gathering however, but even so ...

Her most in interesting items to me were

a) that she had met and been totally taken in by the charm of some noble lord - UK head of G.CH. Q - lovely chap; pity about the (end of) civil rights in the UK.

b) She mentioned that Sta. si-. style informers at fifteen citizens to one inf. orm. er were being introduced. (Completed, I understand).

c) She mentioned that predictive (AI?) software was being run on databases of citizen's information to predict what they would do in various scenarios ... (See Jeffery Deaver The Broken Window for a few ideas). Very useful for Sept, Oct 08. Except election cancellation itself cancelled, apparently.

Spitzer was " conveniently " outted by special interests on The Street-----it`s not about sex--it`s about discrediting him to throw off any future investigations-----possibly m a.doff--???

You are absolutely right. Spitzer's got the goods on some big people, otherwise they wouldn't come after him like this.
(As for speculation, which isn't cool, I was hoping it was something related to a 911 investigation.)

Why should the names of the customers be withheld? Aren't there committing a crime by participating in an illegal business?

But GIVE US the Wall Street derivatives fraud / Mortgage fraud tapes and reports that Spi. tzer was going to publicise.

Anyone in the dark at the level of sur. ve. illance and the 'convenient' availability of these 'timely' wir. et. aps of Democrats, and the T. IA, TA. LON programs - hear Laura Donohue of Stanford Law -

I'll bet that by now Spitzer regrets the anti-pout photo more than prostitution scandal.

I'd much rather have all the emails and tapes pertaining to the outing of Valerie Plame, the firing of all of those DOJ attorneys and the rigging of the intelligence to justify a lie and send us to war.

I really couldn't care less about anybody's sex life, legal or illegal.

Exactly. This was just a way to get rid of someone who was intent on prosecuting fraud on Wall Street and they made him pay.

Well said...what a shame....Spitzer was on the right track but the powers that be cared too much about their own hides and used his sex capades to hide their ineptitude.

The judge who ordered that has a bone to pick with Spitzer, and that isn't the way to make anything "right". I certainly don't condone Spitzer's conduct, but "cruel and unusual punishment" comes in many forms.
