Senate Judiciary Chairman Patrick Leahy took to the Senate floor on Wednesday to discuss the possible outlines of a truth and reconciliation commission to investigate the misdeeds of the Bush administration.

Stating that he is in discussion with members of Congress, outside groups, and even the White House, Leahy boiled down his argument to one very rudimentary question: "How can we restore our moral leadership and ensure transparent government if we ignore what has happened?"

"I share that desire to move forward, and to reestablish ourselves as a Nation dedicated to the rule of law, respected and trusted throughout the world," he said, according to prepared remarks. "We also know that the past can be prologue unless we set things right."

Later, he announced that he would hold a hearing to explore how to best establish a commission, one that would not be "comprised of partisans, intent on advancing partisan conclusions."

"We need an independent inquiry that is beyond reproach and outside of partisan politics to pursue and find the truth," he said. "Such a commission would focus primarily on the subjects of national security and executive power in the government's counterterrorism effort."

The Senator's remarks on the floor represent the next step in a politically tricky process to put a truth and reconciliation committee in place. Leahy first announced the idea of such a committee several weeks ago during a speech at Georgetown. Up to this point, the Obama administration has refused to take a stance on his proposal, though the president's chief counsel, Greg Craig, has been in discussion with the Vermont senator.

Leahy does have other allies in the endeavor, most notably his fellow Judiciary Committee member, Sen. Sheldon Whitehouse. The Rhode Island Democrat recently told Salon.com that he is "convinced" that a commission to investigate the Bush administration's authorization of torture is "going to happen."

Outside government, support appears easier to come by. Last week, a group or prominent law enforcement, political and legal officials penned a letter to the president urging him to set up an investigative commission to uncover the successes, malfeasance, and potential illegalities of Bush's counterterrorism policies. The list of signatories included Thomas Pickering, former Under Secretary of State for Political Affairs; Judge William Sessions, former Director of the Federal Bureau of Investigation; and Major General Antonio M. Taguba, USA (Ret.), who led the investigation into the abuses of prisoners at Abu Ghraib.

Another person on that list, Fritz Schwarz, author of "Unchecked and Unbalanced: Presidential Power in a Time of Terror" and an official at the Brennan Center for Justice, told the Huffington Post that President Obama is subjecting the country to national security risks if he does not ensure that such an investigation is undertaken.

"First and most importantly by learning the facts we are less likely to make the same mistakes, assuming we made mistakes," said Schwarz. "The policies that we followed [during the Bush years] have made us lest safe. And if that is true it is absolutely vital to convince the American public that protecting our values includes understanding what went wrong."

"I think there is a national security imperative [to this]," he added. "It is dangerous not to look back, because if we don't look back, we are certain the next time there is a terrorist event in America, which there will be, God willing not as bad as 9/11, we are likely to repeat the same mistakes."

UPDATE: Leahy's office sends over the following advisory, giving the date and time at which hearings to set up a commission will be held.

In a statement delivered on the Senate Floor Wednesday, Leahy announced a hearing entitled "Getting to the Truth Through a Nonpartisan Commission of Inquiry." The hearing will be held Wednesday, March 4, at 10:00 a.m., and will be webcast live online.

Better way to think of it is a "witchhunt" BECAUSE of the SQUANDERING of national security.

Many security organizations world wide as well as U.S. soldiers have testified that the abuses of international law - not to mention many of our own laws as well as constitution - have made the world a more violent place - and made especially the U.S. more vulnerable to attack. We have fanned the flames of radicalism by our actions and that has made us WAY more vulnerable for YEARS to come (see Pakistan, Iran, Taliban, Al Qaeda, Hamas, etc, etc.).

It's time for those that are responsible for this to pay. Give immunity to the low-level operatives that were "just following orders" and concentrate on those at the top that were responsible.

I would think that any "pro-military" person in this country would be DEEPLY offended by the numerous lies that have come out of our Pentagon - and ESPECIALLY their willingness to throw the poor low-ranking personnel they have punished for the sins of their superiors.

Let's get the facts and punish those that created this mess!!

"Witchhunt?" Refering to the hysterically, delusional thinking of some Christians paranoia, used in defense of Bush?
So you think that like the false accusations of the witch trials that these accusations are false? It is clearly true that Bush mis-led the American people. That is not even really under question. Only whether he can legally be held responsible.
National Security? Now you care about it? After Bush has comment the biggest blunder in the history of American National Security?

Truth Commission my ass!
Just like all the other investigations, where are the results?
What we need is an independent investigation with full disclosure and prosecution of all guilty parties.
Politics won't let Leahy's version do the right thing. It would be a waste of time and resources that will most likely lead to immunity or some other special deal. There have been waayyy too many crimes committed to let this investigation proceed like the fake 9/11 commission.
Too many guilty people that deserve to serve time and some that deserve to hang.

Like FDR said about "make me do it", WE have to force this issue and not rely on President Obama to look partisan (although seeking justice for abuses of the Rule of Law would seem a bipartisan effort).
Please go and sign this petition that lists a lot of VERY credible organizations that are lobbying for Investigations (not some milque toast "truthiness" commission).

We don't need a "truth" commission we need a special prosecutor. Our country was hijacked by a cabal of criminals and we need justice, not a commission.

The letter below was sent to Attorney General Eric Holder by a group of 20-plus groups We need ACTION so make some noise, people!!

"We urge Attorney General Eric Holder to appoint a non-partisan independent Special Counsel to immediately commence a prosecutorial investigation into the most serious alleged crimes of former President George W. Bush, former Vice President Richard B. Cheney, the attorneys formerly employed by the Department of Justice whose memos sought to justify torture, and other former top officials of the Bush Administration.

Our laws, and treaties that under Article VI of our Constitution are the supreme law of the land, require the prosecution of crimes that strong evidence suggests these individuals have committed. Both the former president and the former vice president have confessed to authorizing a torture procedure that is illegal under our law and treaty obligations. The former president has confessed to violating the Foreign Intelligence Surveillance Act.

We see no need for these prosecutions to be extraordinarily lengthy or costly, and no need to wait for the recommendations of a panel or "truth" commission when substantial evidence of the crimes is already in the public domain. We believe the most effective investigation can be conducted by a prosecutor, and we believe such an investigation should begin immediately."

Let's just get on with it! Attorney General Holder, do your duty and bring these criminals up on charges! You can start by hauling Rover in and charging him with contempt of Congress. Then you can move on to Ch e ney..war profiteering at its finest! Bush, the big lie! Rumsfeld for tor ture! And Yoo for providing a legal basis for their crimes...and the list goes on and on!

I believe that we as a nation must take responsibility for our past by holding accountable those who comprised a very real and powerful axis of evil right here on the Hill.

For eight very long years this axis of evil took control of our executive, legislative, and judiciary branches ... terrorized people near and far ... and in many ways, brought the world to it's knees.

There is no honorable excuse for dropping the matter.
These evil doers must be prosecuted ... their ability to do further harm disabled, and all their eligible assets liquidated and given back to the people.

I am in the Army and I agree we need an investigation. The President and Vice President and the GOP Congress overstep their bounds along with many in the Pentagon, CIA, DIA and other intelligence agencies. It is time to fix the mess, our values and our way of life depends on it. President O will do the right thing regardless of who is watching! The GOP and their hooded friends don't scare us!

Baby steps. First, let's get the parties impaneled, then we can start following the leads. Keeping it transparent is paramount so that the results have prosecutorial value, unlike the total lack of bite that made up the Watergate, JFK murder, IranGate and 9/11 commissions.

I suspect that this entire process could take as long as five or six years - there is THAT much evidence to be collected, examined, divined and acted upon. If the panel does its job there will be many members of the Bush administration, and nongovernmental civilians, who will end up behind bars. Let the chips fall where they may.

Time served, however, is not enough. Those who benefited politically or economically from their unlawful collusion and conspiracy must also forfeit their collective monetary largesse.

The only problem with Senator Leahy's plan is that if and when we get the whole truth about Bush/Cheney/Rumsfeld/Rove's crimes against humanity, there will be slim chance of hammering out any meaningful reconcilliation.
They conceived a horrific action against a sovereign state, invaded it, overthrew and executed its president and waged war on the civilian population. The enormity of their crimes demand prison time.
Yes, Saddam Hussein was a monstrosity, a ruthless dictator and corrupt to the core, but it wasn't our place to make the change.
Compounding the nefarious with the egregious the foursome based it all on a lie. There were no WMD and they knew it.
I want them brought to trial.
I want the trial open to the public.
I want it in my lifetime.
