Franken: Minnesota Supreme Court Rejects Bid To Be Seated

ST. PAUL, Minn. — The Minnesota Supreme Court on Friday blocked Democrat Al Franken's petition for an election certificate that would put him in the U.S. Senate without waiting for a lawsuit to run its course.

The decision means the seat will remain empty until the lawsuit and possible appeals in state court are complete. Republican Norm Coleman's lawsuit challenging Franken's recount lead is at the end of its sixth week, and both sides expect it to last at least a few more weeks.

After a state board certified recount results showed Franken 225 votes ahead, he sued to force Gov. Tim Pawlenty and Secretary of State Mark Ritchie to sign an election certificate. Franken argued that federal law stipulates each state will have two senators when the Senate convenes, and that law trumped a state law that blocks such certificates while lawsuits are pending.

But the state Supreme Court disagreed. In their ruling Friday, the justices said states aren't required to issue such certificates by the date that Congress convenes.

The justices wrote in their unsigned opinion that "if the Senate believes delay in seating the second Senator from Minnesota adversely affects the Senate, it has the authority to remedy the situation and needs no certificate of election from the Governor to do so."

Coleman's team hailed the ruling for giving the state courts space to sort out Coleman's lawsuit.

"This wise ruling will ensure that Harry Reid, Al Franken and Chuck Schumer cannot short-circuit Minnesota law in their partisan power play," Coleman adviser Ben Ginsberg said, referring to two Democratic leaders in the Senate.

Franken attorney Marc Elias said the campaign was disappointed.

"Obviously we had hoped for a different result, but we accept the ruling of the Supreme Court," he said.

The three-judge panel in Coleman's lawsuit heard motions Friday by Franken to dismiss the suit and by Coleman to declare a recount rule illegal.

Coleman attorneys defended their legal case, pointing to evidence of inconsistencies and incomplete voter registration records.

Coleman attorney Jim Langdon said rejected ballots were reviewed with "different sets of eyes with standards applied differently."

Coleman's attorneys argued their side had presented evidence showing at least 1,725 rejected absentee ballots should be opened and counted. By Franken's analysis, only nine rejected ballots had been shown to be valid.

In other arguments, Coleman is questioning a recount rule that's at the heart of his claim that some people got two votes because both a damaged and replacement ballot for them were counted. Coleman attorney Joe Friedberg said the campaign initially accepted a rule guiding recount officials to count the original ballots, but he said the campaign did so "presuming that there would be an equal number of originals and duplicates."

The problem, Friedberg said, was that some of the duplicates weren't properly marked.

Franken attorney David Lillehaug said both campaigns and the secretary of state's office agreed on the rule, which he said is legal.

"The attempt to back out," he said, "is always after Sen. Coleman decides he didn't like the results."

Ginsberg obviously didn't read the part of the opinion that SPECIFICALLY GAVE the Democratic Senate the power to seat Franken immediately:

"...if the Senate believes delay in seating the second Senator from Minnesota adversely affects the Senate, it has the authority to remedy the situation and needs no certificate of election from the Governor to do so."

The Supreme Court seemed to say that they CAN supercede the court if they choose to. They won't because Franken doesn't want to win that way. But they could.

Now Scaramouche is pissd. He's sick of politics. He's sick of Lock-step party voting blocks. He's sick of the niavete of simple people who think the election of an individual trumps the election of the party. This Franken-Coleman circus rips the pretty facade that hides the ugliness and hypocracy of a political system bankrupted by both parties in their attempt to gain leverage at the expense off the country they espouse to serve. A plague on both their houses. This government needs a total clean out and start over. The same sad crap will eventually emerge from our idealism, but hopefully before it does, some intelligent governing will briefly emerge to clean up the current mess .

Isn't it interesting; when it looked like Coleman had won the election, he expressed the desire for Franken to quit. Now that Franken has the lead, Coleman doesn't want to quit. How sad for him. The Republicans, like every other authoritarian regime, just can't take rejection.

Part of the reason why he wanted Franken to quit was to save MN the cost of the recount (even though it was mandated by law). Now Coleman wants the state to hold a new election, which will be much costlier than the recount was and which IS NOT mandated by law.

Neocon Republicans have turned to any trick in the book to win,including gerrymandering and so many poisoned elections through manipulation of our courts and fraudulent caging schemes which have eliminated the voting rights of so many minorities and the elderly.Add to that voting machines and contracts given to crony companies like Diebold that can't even process a receipt for a recount.Radio programs our soldiers listen to in theatre,giving only Rush Limbaughs views and you have more voter fraud and manipulation than you can shake a stick at.Spare me the BS about our court system.We saw the SCOTUS issue illegal rulings that stopped vote counting in Florida and allowed a complete failure to head our nation for eight years, culminating into the economic global mess we're in now.We need all Neocon Republican influence removed from our government permanently.Yes,it's a difficult and extreme step,but so is getting rid of most of the scourges on our planet.

What this whole saga illustrates is that there's a hole in MN law regarding elections; It needs to state that the victor of the re-count process shall be seated ("certified") on a temporary status / basis while any legal challenges proceed. Etc, with all due legal nomenclature.

The MN legislature could write such laws _now._

We may see that happen. We've got a pretty good system - have from the get, but we perfect it more after each problem crops up.

I understand that many would rather deride our process than respect it, it boggles. If only they understood our process before insulting it. Many Minnesotans are proud of the process and outraged by Coleman and the NRSC's thumbing their nose at it.
