The labor movement's mostly unspoken tactic to pass the Employee Free Choice Act -- its legislation of generational importance -- seeped out into public Tuesday when Senate Majority Leader Harry Reid (D-Nev.) was asked about the bill's chances for passage.

"We, of course, are looking for 60 votes," he said. "I think, frankly, they're there. Now remember: these are procedural votes. These aren't votes on the substance of the bill."

Sixty is the Senate's magic number, the tally needed to end a filibuster by invoking cloture and moving to a final vote. Senators who oppose a bill generally vote against cloture, effectively killing the bill. But Democrats and their labor allies hope to wipe that calculus off the board and persuade some opponents of the bill to vote for cloture even if they vote against the final bill. If 60 vote for cloture, only 50 are needed for final passage (Vice President Joe Biden can break a tie.)

"I think getting 60 votes on the procedural aspects of it is certainly there," Reid said.

Earlier Tuesday, Sen. Ben Nelson (D-Neb.), the kind of centrist who might vote against the bill but for cloture, told reporters that he opposed the bill as currently formulated. He left open the possibility of voting for a modified version or of voting for cloture.

Reid said that if he got Republican cooperation with some of the agenda over the next few months, EFCA could come up before the August recess.

"Reid understands his parliamentary procedure well and people who are gloating about Senators not 'supporting' the bill may be missing the trees for the forest," said a Democratic strategist working on the legislation. "It's definitely possible, as Reid is saying, for Senators to vote against the bill itself but for cloture."

"The GOP has successfully moved the markers of a majority to 60 in their quest of continuous obstruction. The reality of procedure is we need 60 votes to proceed to vote on the bill, and then 50 on final passage. There will inevitably be different coalitions together on each vote, but we're confident we'll get the numbers we need on each step to pass the Employee Free Choice Act," said a labor official.

The opposition, though, has seen the unions coming and plans to give centrist senators no quarter behind procedural arguments. "This bill is a mortal threat to American freedom and we will never forgive somebody who votes for cloture or for passage," former House SpeakerNewt Gingrich told the Conservative Political Action Conference in February.

"There is only one vote on card check and it has a 60-vote threshold," said a lobbyists working against the bill. "Any senator believing they can get away with a procedural argument is underestimating the intelligence of the American people and supporting legislation that will crush small business and increase unemployment."

Without filibuster - Ladies and Gentlemen, I present Harriet Miers Associate Justice of the Supreme Court of the United States of America.

I'm not sure that doing away with the filibuster is the way to go. Think of the last 8 years. Now think of the last 8 years without a filibuster. As bad as it was, it would have been even worse without the f word.

So far, we have an easy decision for voters in 2010. If they want change, they vote Democratic ticket. If they want Bush, they vote Republican ticket. There are no Republican candidates that vote on behalf of their constituents.

Someone needs to get out a real blitz campaign and inform the every day person what this Employee Free Choice Act really is. I was in a job meeting tonite (non-union) and the owner talked about the right to a secret ballot being taken away from employees under this act. NOT TRUE!!! This lie continues to be repeated time after time everywhere without enough challenge by legislators, lobbyists, media and people who just believe everything they are told. It needs to stop.

No one is forced into anything with this bill. To say so is just a lie.

It adds a second option to unionize. That is all.

Why are conservatives afraid of freedom of choice and the right to unionize? Why are they afraid of a method of fair treatment for employees? Why are they afraid of having to sit at a table and discuss and come to agreement regarding the treatment of said employees? Employees working in an atmosphere of non representation is nothing more than a dictatorship. Considering a person spends at a minimum 1/3 of their life working, should they continue working in a dictatorship atmosphere or have some say over the control of their lives?

WHY ARE CONSERVATIVES SO AFRAID OF UNIONS? WHY WHY WHY?
A good employer has nothing to fear but fear itself. Conservatives seems to like to use fear in every aspect of control and this my friend just may be changing in tomarrows world.

What do you have a against actually learning about the bill which gives employees an option of what path to take to unionization.

That sounds pretty free to me.

Fair Censuses..... what do republicans have against them? The last redistricting drew arbitrary lines through communities to benefit republican areas. Grouping black people into their own district as to not overtake the republican vote in a mixed community.... Now thats Fair....

Actually the American people are smart enough to understand that abuse of the filibuster is an undemocratic means to tyranny by the minority. They voted for a Democratic majority in the House and Senate and a Democratic President, because they want the policies of the Democratics to become law. They do not want minority Republicans thwarting their will through parliamentary maneuvers.

Republicans just keep digging a deeper and deeper hole for themselves. My advice: Stop digging!

Back when Union's were vital in creating the middle class - the worker was paid $1 for every $25 that the boss made. Today the number is a mind-numbing $340 to $1 that we can spend at WalMart! This is progress! Shameful greedy patriots!

Speaking of Wal-Mart..they will spend millions perhaps billions to stop EFCA. Just imagine all the workers at Wal-Mart making $15/hour...this would instantly upgrade the workers buying power and jolt the economy. Instead Wal-Mart would rather have their workers make $7-9/hr and barely survive..that way they are FORCED to buy cheap foreign crap at Wal-Mart. 5 of the top 10 most wealthy individuals in the U.S. are members of the Walton family, whose combined net worth is over $100 BILLION dollars.

Wal-Mart does not realize that happy well paid employees are more productive able to buy more goods!

The profit comes with steady sales numbers over time.

Wal-Mart and other employers want to maximize short term profits, so workers get laid off.
