RICHARD POPLAWSKI, Pittsburgh Gunman, Kills 3 Police Officers

RAMIT PLUSHNICK-MASTI and DAN NEPHIN   04/ 4/09 10:36 PM ET   AP

Pittsburgh

PITTSBURGH — A gunman wearing a bulletproof vest and "lying in wait" opened fire on officers responding to a domestic disturbance call Saturday, killing three of them and turning a quiet Pittsburgh street into a battlefield, police said.

Police Chief Nate Harper said the motive for the shooting isn't clear, but friends said the gunman recently had been upset about losing his job and feared the Obama administration was poised to ban guns.

Richard Poplawski, 23, met officers at the doorway and shot two of them in the head immediately, Harper said. An officer who tried to help the two also was killed.

Poplawski, armed with an assault rifle and two other guns, then held police at bay for four hours as the fallen officers were left bleeding nearby, their colleagues unable to reach them, according to police and witnesses. More than 100 rounds were fired by the SWAT teams and Poplawski, Harper said.

The three slain officers were Eric Kelly, 41, Stephen Mayhle, 29, and Paul Sciullo III, 37. Kelly had been on the force for 14 years, Mayhle and Sciullo for two years each. Another officer, Timothy McManaway, was shot in the hand and a fifth broke his leg on a fence.

Poplawski had gunshot wounds in his legs but was otherwise unharmed because he was wearing a bulletproof vest, Harper said. He was charged with three counts of homicide, aggravated assault and a weapons violation.

The shooting occurred just two weeks after four police officers were fatally shot in Oakland, Calif., in the deadliest day for U.S. law enforcement since Sept. 11, 2001. The officers were the first Pittsburgh city officers to die in the line of duty in 18 years.

"This is a solemn day and it's a very sad day in the city of Pittsburgh," Harper said. "We've seen this kind of violence happen in California. We never would think this kind of violence would happen in the city of Pittsburgh."

At 7 a.m., Sciullo and Mayhle responded to a 911 call from Poplawski's mother, who remained holed up in the basement during the entire dispute and escaped unharmed, Harper said.

When they arrived at the home, Sciullo was immediately shot in the head. Mayhle, who was right behind him, was also shot in the head.

"It appears he was lying in wait for the officers," Harper said.

Kelly, who was on his way home after completing his overnight shift when he heard the call for help, rushed to the scene and was killed trying to help Sciullo and Mayhle, Harper said. SWAT teams and other officers arrived and were immediately fired on as well.

Don Sand, who lives across the street from Poplawski, said he was woken up by the sound of gunfire. Hunkering down behind a wall in his home, he saw the first two officers go down and then saw Kelly get shot.

"They couldn't get the scene secure enough to get to them. They were just lying there bleeding," Sand said. "By the time they secured the scene enough to get to them it was way too late."

Deputy Chief Paul Donaldson, who lives nearby, was one of the first officers to arrive. He saw Mayhle by a bush to the right of the door; Kelly was in the street and McManaway, his hand injured, was kneeling beside him, yelling that Kelly needed help.

Donaldson suggested using a police van to get them. They draped a bulletproof vest on the window to protect the driver and several officers got into the van to get Kelly and McManaway.

During this time, Poplawski was somehow distracted, Donaldson said.

"We were fortunate that he didn't fire on us. I don't know why he was distracted, but he apparently didn't see us coming down to get them," he said. "It could have been worse."

Poplawski had feared "the Obama gun ban that's on the way" and "didn't like our rights being infringed upon," said Edward Perkovic, his best friend.

Perkovic, 22, said he got a call at work from him in which he said, "Eddie, I am going to die today. ... Tell your family I love them and I love you."

Perkovic said: "I heard gunshots and he hung up. ... He sounded like he was in pain, like he got shot."

Poplawski had once tried to join the Marines, but was kicked out of boot camp after throwing a food tray at a drill sergeant, Perkovic said.

Another longtime friend, Aaron Vire, said Poplawski feared that President Barack Obama was going to take away his rights, though he said he "wasn't violently against Obama."

Vire, 23, said Poplawski once had an Internet talk show but that it wasn't successful. He said Poplawski owned an AK-47 rifle and several powerful handguns, including a .357 Magnum.

Obama has said he respects Americans' constitutional right to bear arms, but that he favors "common sense" gun laws. Gun rights advocates interpret that as meaning he would approve some curbs on assault and concealed weapons.

Poplawski had been laid off from his job at a glass factory earlier this year, said another friend, Joe DiMarco. DiMarco said he didn't know the name of the company, but knew his friend had been upset about it.

The last Pittsburgh police officers killed in the line of duty were Officers Thomas L. Herron and Joseph J. Grill, according to a Web site that tracks police killings. They died after their patrol car collided with another vehicle while chasing a stolen car on March 6, 1991.

In 1995, an off-duty officer was shot with his own gun after he confronted a group of teenagers about graffiti. Tests later showed the officer had been drinking.

According to the National Law Enforcement Officers Memorial Fund, 133 law enforcement officers died in the line of duty in 2008, a 27 percent decrease from year before and the lowest annual total since 1960.

Poplawski had often fought with neighbors and had even gotten into fist fights with a couple, Sand said.

"This is a relatively really quiet neighborhood except for him," Sand said. "He was just one of those kids that we knew to stay clear from."

Harper confirmed police had responded to calls from the Poplawski house several times but said the incidents were still being investigated.

Rob Gift, 45, who lives a block away, said the well-kept single-family houses with manicured lawns are home to many police officers, firefighters, paramedics and other city workers.

"It's just a very quiet neighborhood," Gift said.

And don’t buy the White House hype that the USA Patriot Act is a necessary tool to fight terrorism. It is a dangerous law that infringes on the rights of every American citizen and, as one brave aide told President Bush, something that undermines the Constitution of the United States.
both parties have a total disregard for the constitution. Time for a 3rd party.

Ok, well I'm sure this post will be closing out soon. Before we go I'd just like to say to all of you who insulted my intelligence, I don't hold a grudge. I know you've got nothing to work with so you really have no choice. To all of you who came on strong but faded when you realized I wasn't going to stray from utilizing logic, and facts ,again, I know you have nothing to work with.
I will close with this; if you expect people who are opposed to you on the gun issue to forego their ability to defend themselves and their families from a violent attack just because your are not inclined to do so and because well, it would just make you feel better if they couldn't either. Well, I think I've spelled out our position on that pretty clearly.

Indeed, you've proven to all of us, you are a legend in your own mind.

The "facts" you've presented (ad nauseum) are:

Gun bans (which no serious proposal exists to enact) will not be enacted.

Dems can not be trusted to stop with "reasonable legislation" (because you say so).

Republicans WOULD ACCEPT "reasonable legislation" (though never citing any Republican who has made this statement) (again, because you say so).

Having guns allows you to protect yourself, your family and your neighbors from, the boogyman, the Government, the Liberals (who do not have guns you believe), even though there are more statistics in evidence that MORE PEOPLE ARE KILLED BY THEIR OWN GUNS than by any other weapon of choice.

You have been bleating about this for a day and a half. One question for you; HAVE YOU ever shot another human being?

I ask because I saw guys with your kind of "bravado" in the Military. They were the most likely candidates to "freeze" in action. This is such a common occurrence that it has become "common knowledge". He who speaks the loudest, is simply trying to convince themselves.
05:12 PM on 04/05/2009
No, I never have shot anyone. I hope I never do. I know of seasoned police officers that have and they were never the same. I know a gun can be a deterent to violent attack.
That would be my preference, Your assumption that I am blood thirsty is quite bigoted.
I have had my CCW for over 20 years now without incidence let's hope it stays that way. My house has never caught fire but I am very disciplined about keeping my smoke alarms in working order.
Well you have a republican right here willing to discusss what we might be willing to accpet. Yet everyone here runs for ths high weeds when I've proposed it.
The "boogeyman" huh? wow, could you possibly be anymore disingenious.
How about all of those "boogeymen:" south of the Border that Eric Holder says we need to
keep guns from..Aren't you just getting yourself in deeper? So, what legislation would you accept without going any further sir?

Americans need to chill out over their gun laws. The fact is America isn't any worse off or different than other countries like Afghanistan, Pakistan, Iraq and many other countries in Africa.

All these countries have the right to bear arms as well as about 5% of their populations having most of the money while the rest struggle to make ends meet. All have the same type of religious fervor with large segments being the same as the Taliban with a different title in their respective areas.

Even their electoral processes appear quite similar with them being tainted with corruption and electoral disputes.

About the only difference is all these countries except for the U.S. allow their citizens to visit Cuba without it being against the law.

Ban "Assault" rifles! (Special permits for "documented collectors")

Ban "armor piercing", "dum-dum", and "fragmenting" ammo.

Ban "High-power" sniper rifles (again, special permits).

Shut down "gun-show" exemptions on "no-background" sales!

Fund ATF to functionality, re-emphasize their "Firearms enforcement" mission.

Regulate "personal inventory" for non-provable collectors, with a quantity threshold automatically enacting a mandatory "in-depth" investigation of the individual.

I'm sure there are more "reasonable things" that we could do, but this would be a start.

The issue will never be "left alone for all time", as, over time, new technology and new circumstance may require "NEW LEGISLATION". It's called ADAPTATION.
05:16 PM on 04/05/2009
Please put the "quality threshold" and "personal inventories" and "in depth" investigations in laymans terms for me?

Why should it be Democrats who must leave issues "alone for all time?" Why can't Republicans get a little more responsive to the realities of the 21st century? Things have changed drastically since the constitution was written and the amendments added. There is a thing called TECHNOLOGY. It has changed all of our lives, for better and for worse. It is up to governments to do something about the "for worse" part, especially since many people are apparently still living in their heads in the time of single-shot weapons.

Fortunately he is alive and has friends with similar views who are not afraid to be interviewed.

Somehow, many of us have come to believe that state and federal governments have no authority to limit any right granted to citizens under the U.S. Constitution. This has never been true. In the case of "fundamental" rights, granted under the first Ten Amendments to the U.S. Constitution (i.e., the Bill of Rights), state and federal governments can limit those rights if they have a compelling governmental interest and the law is narrowly tailored to achieve that interest, by the least restrictive means possible. To illustrate, our right to the free exercise of our religion does not grant us the right to deny our children necessary medical care -- no matter what the tenets of our religion might proscribe. Our Second Amendment right to bear arms is no more sacrosanct than our right to the free exercise of our religion, to free speech, or any other fundamental right.

We all sit here butting heads arguing over whether guns should be banned, but it's really a moot point. The real issue is WILL they banned. The answer is no, here's why. The democrats know that it is political suicide, and democrats care about nothing more than retaining power, not dead civilians, not dead police officers, not dead children. It's the democrats "collateral damage"
Additionally, many gun owners would be open to "some" gun legislation if we could be assured it would end there. But we all know that they can't be trusted to leave it alone, don't we?

There it is..

They won't be banned. Not because of political calculation, but because of the 2nd Amendment, and because we once again have an administration which understands and believes in the constitution and the rule of law.

When we DIDN'T, (lo these mere months ago) you almost never heard a peep from the right about which amendments in the Bill of Rights were being trampled and shredded day upon day. Because I guess they had their money, and if they didn't, they had their guns - and really, what else matters?
01:58 PM on 04/05/2009
The DEMOCRATS?? So you're saying that if all those gun-toting Democrats would just agree, the Republicans would be willing to ban guns? OK, you can put down the crack-pipe now....more twisted logic from the sick minds of the gun-obsessed right.

Probably another ditto head who followed the extreme right wing dialogue telling these folks to go out and make a run on the gun stores because a President Obama would change the gun laws. Republicans need to look in the mirror, but that will be very hard to do. Those radio jockeys don't know or care who is listening and following their every word. This is extremely dangerous because man of the people who are following have no business with a gun, period. All haters!!! I am sure that Limbaugh and Hannity et al are trying to figure out how to spin these mass killings as an Obama fight back. I now conclude that they are pure evil and only interested in lining their pockets with millions despite hurting the people of this country.

So, following your logic, I guess this was President Obama's fault?

'Coz, fer sher, he's done nothing since he got in office but to tell people to arm themseves, and to be afraid - very afraid.

So we have a man with a history of aggression and maybe mental illness who "...feared that President Barack Obama was going to take away his rights, though he said he "wasn't violently against Obama." Instead he kills three officers? YIKES.

Sounds like a DAMN fine idea to control guns when people like these get their hands on assault rifles. The NRA always claims that it just wants hunters to have guns and that people should be able to protect themselves. Where do "an AK-47 rifle and several powerful handguns, including a .357 Magnum" figure into that equation? I agree that we have much to fear from domestic "terrorism" like this. I'm all for a ban on these classes of guns. Mere citizens DON't need them. Stop citing the constitution on these spurious grounds.

If you think that Bad Guy's will play by the rules and that more rules will make you safer you are wrong.

By definition, an assault rifle is capable of automatic fire.
All civilian versions are neutered to semi-auto, like any other civilian rifle.
Civilians cannot own assault rifles.

So either this was an already illegal assault rifle, or you and the press are ignorant of what the term actually means. Both are likely.
