Franken Won Most Senate Votes, Minnesota Court Rules

A Minnesota court confirmed Monday that Democrat Al Franken won the most votes in his 2008 Senate race against Republican Norm Coleman, who immediately announced plans to appeal the decision.

Coleman has 10 days to appeal to the state Supreme Court. Once the petition is filed, it could further delay the seating of Minnesota's second senator for weeks.

Franken triumphantly declared victory and urged Coleman to concede in a hastily-organized press conference in front of his Minneapolis home. "The court said that I should be certified," he said. "The three-judge panel said I was the winner of this election. And I would love to be certified in ten days. And I call on Senator Coleman to allow me to get to work for the people of Minnesota as soon as possible."

Speaking before a pack of supporters and reporters, the one time comedian conceded that the likelihood remained that Coleman would appeal the results to the state Supreme Court.

"After that," said Franken, "I believe I will be certified and get to work in the U.S. Senate."

Nevertheless, the Democrat was glowing in the night's news. The judges had not only declared him the winner - by a margin of 312 votes - they had written in their decision that the election "was conducted fairly, impartially and accurately."

"I have no control over what [Coleman] does," Franken said. "But as these three judges said, this was a very fair election, totally scrutinized. They agreed unanimously on everything and I am very confident that we won. I don't think by attacking the courts and election process of this state, that is a winning argument," he added, in reference to Coleman's remaining legal options, which include appealing to a federal court.

In its order, the judicial panel dismissed two attempts by Coleman to subtract votes from Franken over allegations of mishandled ballots in Minneapolis.

The judges also rejected Coleman's argument that a state board improperly made up for a packet of ballots lost between the election and the recount. His lawyers contended that the ballots' disappearance rendered them invalid and that Coleman was entitled to review all ballots as part of the recount.

Coleman's lawyers claimed dozens of ballots were double-counted when their originals couldn't be fed into optical scanning machines on Election Day. They said it was possible that originals and duplicates were included in the recount.

The ruling diminishes Coleman's chances of retaining a seat that he won in dramatic fashion in 2002, when he narrowly defeated former Vice President Walter Mondale. Democratic incumbent Paul Wellstone died in a plane crash with two weeks to go in the campaign.

With a legal victory at hand, Franken said that -- as throughout this recount process -- he would travel back-and-forth to Washington in the coming days and weeks to prep himself on the current legislative calendar. He stressed repeatedly that Minnesota was under an unfair burden by having insufficient representation in Congress.

"It has been more than five months since Election Day," he said. "And more than three months since the winner of this election was supposed to be sworn in to go to work for the people of Minnesota. This long delay in the seating of Minnesota's second U.S. Senator has come at a time when our state badly needs help from Washington. Since Election Day, Minnesota has lost 56,000 jobs. Since Election Day more than 9,000 Minnesota families have lost their homes to foreclosure."

The question now remains: who, if anyone, will ramp up the pressure on Coleman to withdraw his appeal, particularly from the Republican side of the aisle? Additionally, who, if anyone, will call on Minnesota Gov. Tim Pawlenty to sign the letter certifying Franken as the winner?

So far, national Democrats have largely kept their powder dry.

It would be utterly unconscion­able for Coleman to again refuse to concede. It has already shown that Politics was foremost on his agenda, and the people of Minnesotta­, last on his concerns.
People of Minnesotta should demand to have Al Franken seated so they can have a senator! Even Al Gore graciously conceeded in his stolen election of 2000, and that was for President!
Republican­s obviously have no shame and no scruples!

Norm - it's time for you to go, time for you to bow to the will of the people and leave graciously­. Your continuing challenges do nothing but diminish anything you might have accomplish­ed during your term in the Senate. You are just wasting time and resources.

I believe it would help if citizens of Minnesota would appeal to their governor and ask that Coleman give it up and bow out gracefully if that is at all possible at this late date. How about it, Minnesota?
It appears that all Repugs this year are loudly shouting "NO, NO WAY, NOTHING & NEVER. This won't get them anywhere but disrespect­ed and Disgraced. Especially since Democrats bowed out gracefully & too soon to get correction of the theft of office in 2000, and perhaps, we think, in 2004.
I don't believe anyone can easily respect this kind of feet dragging and petty bickering that is going on in the Rethuglica­n party.

Congradula­tions Al. It's about time that this happened. You could write a book about the stupidity of people who pulled the nonsence that Coleman did. Coleman comes across as a person only interested in himself and not the best for the citizens of Minnesota. He sets the Repubs back another 100 years. I know-so what else is new.

The whole GOP are funding Colemans court and lawyer fees. It is not just Coleman who needs to grow up and accept the will of the people of Minnesota, it is the whole of the Republican Party. This makes one more Democratic Senator in the Senate, and it will be the tie breaking vote in many situations­, and the Republican­s are trying to keep that from happening.

AND gov pawlenty needs to grow a pair. he used double-spe­ak in "answering­" every question about this issue when he was on rachel maddow. i totally lost respect for him and i really want to like some repubs b/c i think they're out there (maybe hiding under the sofa cushions with my hair brush and loose change). governor, do your civic duty, prove you are a statesman rather than a politician and seat franken. TODAY! Make your country proud and build some good faith with the republican party that is currently sorely lacking. the people of minnesota have spoken!

omigod, coleman, give it up already and give it up now. can you say "sore loser?" I knew you could.

this would simply be ridiculous if it wasn't putting our very democracy, especially Minn's democracy, at risk. enough already! grow up coleman. try again next time 'round. maybe the dems will really screw up and you'll have better chances. don't count on it though.

OK it's a done deal! Franken was elected fair and square, and the courts confirmed it. If Coleman tries to appeal this and obstruct the will of the voters in Minn. one second longer, and no Republican­s including the purely partisan Govenor Pawlenty, oppose his efforts, they must be exposed by the media and every name brand Democrat with access to the media including the President, for their anti-Ameri­can, and anti-Democ­racy stance.

This is setting a despicable precedent for every loser to obstruct the voting rights and will of the people in any election! If The Democrats in power don't make a big deal out of this obvious attempt by the GOP and Coleman to reverse the outcome of an election of a Senator they are as corrupt as Coleman and the GOP.

I knew Norm Coleman when he was running for mayor of St. Paul as a DEMOCRAT. Back in those days he was trying to sound like JFK, and posing as some sort of "machine" politician­. It was weird then, and he continues to behave erraticall­y to this day. If you follow his rise to power from there through the "accident" that killed Paul and Sheila Wellstone, to now--you see his consistent grandiosit­y and lack of statesmans­hip. Norm is interested in Norm, and thinks that politicans who see themselves as public servants are chumps. I'm sure it doesn't bother him one bit to be depriving the people of Minnesota of their right to adequate representa­tion in the Senate. His actions now only serve to ensure that if he has any legacy at all, it will be one of the spoiled child narcissist he is and always has been. In the immortal words of Joseph Heller, "Consisten­cy, as a virtue, is highly overrated.­"

Thinking of Dean Smith basketball­, Coleman is play four-corne­rs defense. The only catch is that he is behind, not ahead. Does he hope to do a repeat of Bush v. Gore, in which the U.S. Supreme Court overules the state supreme courts and hands the election to Coleman. Where are the independen­ts and Republican­s who know how to lose gracefully­?

The comedy of Al FRANKEN required wit but the recent comedy provided by the GOP is more of the Keystone Cops variety ( falling all over theirselve­s in ineptitude­) but now it is time to employ the big hook and get the keystone cops off of the stage
